AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED 10/26/
BETWEEN THE STATE OF TEXAS AND THE CITY OF OR THE
REVISION 12ZULLANKE14 CONSTRUCTION, EXISTENCE, USE, OPERATIbN, AND MAINTENANCE OF HIGHWAY
SIGNAL PROJECT(S) AT THE LOCATION(S) SHOWN ON EXHIBIT 1, ATTACHED HERETO AND MADE A
PART HEREOF, IN THE CITY OF mactPROVIDING FOR THE EXECUTION
OF SAID AGREEMENT; AND DECLARIO-TFERERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Pearl •
SECTION 1. That the certain agreement dated 10/26/67 between the State
of Texas and the City of har_ , for the XIMAIXatImixmaxx revision,
construction, existence, use, operation, and maintenance of certain highway traffic
signal(s) at the location(s) shown on EXHIBIT 1, attached hereto and made a part
hereof, in the City of Watarlrn , be and the same is hereby
approved, and is hereby authorized to execute said
agreement on behalf of the City of Maisel , and to transmit the
same to the State of Texas for appropriate action.
SECTION 2. The fact that the improvements contemplated under the above mentioned
agreement are needed, creates an emergency which for the immediate preservation
of the public peace, health, safety, and general welfare requires that this Ordi-
nance take effect immediately from and after its passage, and it is accordingly
so ordained.

at the location(s) shown on EXHIBIT 1, attached hereto and made a part hereof,
in the City: r
AGREEMENT :land
NOW, therefore, in consideration of the premises and of the mutual cove-
nants and agreements of the parties hereto to be by them respectively kept and
performed, as hereinafter set forth, it is agreed as follows:
1. The State will furnish the necessary funds for the actual construction,
revise
prepare plans and specifications, git4tKIT said highway traffic signal(s), super-
vise construction, and upon completion of construction, will furnish the power and
operate and maintain said highway traffic signal(s) .
2. The City hereby consents to the construction of the highway traffic
signal(s) shown on EXHIBIT 1 by the approval of the location and manner of construc-

tion as shown on plans and described in specifications attached hereto, marked
EXHIBIT 2, and made a part hereof.
3. The City will exercise no control whatsoever over the operation,
maintenance, use, or existence of the highway traffic signal(s) without written
authority from the State Highway Engineer.
4. The State shall have the authority to make such changes in the design
and operation of the highway traffic signal(s) as it may deem necessary and advis-
able to promote the safe, convenient, and orderly movement of traffic.
5. The City will be responsible for the police enforcement required for
securing obedience to the highway traffic signal(s) .
6. In the event the terms of this Agreement are in conflict with the
provisions of any other existing Agreements and/or Contracts between the City and
the State, this Agreement shall take precedence over the other Agreements and/or
Contracts.

Dear Sir:
As requested by Mr. B. J. Courtright, City Councilman, attached are
three copies of a sketch showing the proposed fire run interconnect
system which is needed to initiate a special flashing sequence at the
above-named signalized intersection upon actuation of a push button
at the Pearland Fire Station. We will await action by the City of
Pearland to negotiate the necessary agreements with the Houston
Lighting and Power Company and Southwestern Bell Telephone Company
for the joint use of their existing utility poles. After we have
received copies of these agreements, it will be necessary that we
secure Administrative approval prior to the installation of this
operation.
Approval has been received for the revision of this signal to provide
for a full actuated operation, and we will proceed with this work as
men and materials are available.

Dear Sir:
The project plans for revising the existing traffic signal to include
a full-traffic-actuated operation and installation of 12-inch signal
indications have been completed. These along with the covering Agreement
are being submitted to you at this time so that the needed improvements
can be installed at the earliest possible date. Since we do not wish to
delay these primary safety improvements, the special flashing operation
requested in Mr. McClellan's letters of August 16 and 20, 1967 has not
been included. When the City obtains permission from the utility companies
for the. State to utilize their poles to support the interconnect cable as
outlined in our letter of August 24, 1967, and when we receive Administra-
tive approval, this special operation can easily be added to the project.
In the meantime we would like to proceed with the primary signal revisions,
however, we must have City approval of the plans and execute an Agreement
to cover the work.
Attached are four copies of the State's standard Agreement (Traffic Signal
Type 1A) , the accompanying Ordinance, City Secretary's Certificate,
(Form 1074), a print of the project plans, and the title sheet tracings.

We received Mr. McClellan's letters of August 16, 1967, requesting that an all-red
flashing sequence be added to the proposed modification of the above-named signal.
It is necessary that such a modification have Administrative approval prior to the
installation. Should this approval be obtained, the Highway Department will bear
the entire cost of the installation, maintenance, and operation of this interconnect
cable and control relays. In order to minimize the cost involved in making this
installation, we will request that the City of Pearland negotiate an agreement with
the local utility companies for the joint use of their poles to support the fire run
control cable.
These modifications will require field studies and additional financing; therefore,
it is anticipated that it will be approximately six weeks before these plans will
be submitted to you for your concurrence and approval.

Gentlemen:
The City of Pearland would like to secure a
permit from your Company which would allow the Texas
Highway Department to install a three conductor cable
here in Pearland. This would be similar to a service
entrance drop to be located on your poles on the north
side of Broadway (FM 518) from the intersection of
Highway 35 east to the Fire Station, a distance of two
blocks . This conductor cable would be for the purpose
of throwing a switch at. the Fire Station that would cause
the signal light at the. inter,.ection of Broadway and
Highway 35 to flash red for a period of 90 seconds . This
would permit the fire trucks to cross this intereection
without difficulty caused by traffic or accident.

the State Highway Department to forward plans for
the alterations in the traffic controls at Highway
F.M. 518 and Highway 35 as soon as possible.
Also, the motion called for a request to the
State Highway Department that provisions be made to
be able to lock this traffic light on red blink for
a period of 60 to 90 seconds . Control witch to be •
located at the fire station and the Pearland Volunteer
Fire Department will assume all labor and material
cost involved in this switch. The Fire Department
would also like to have a red blinking light in front
of the fire station which is located on Highway 516
and Grand Boulevard. The signals to be used during fire
runs only.

Speed checks were made on FM 518 from the fire station southwest to the
new shopping center at the Sherwood Forest addition. These speed checks
have been shown in red on the attached drawing. They were made July 31,
1967, between 9:30 a.m. and 2:00 p.m. and represent the normal off-peak
characteristics along FM 518. It is apparent from the review of the speed
conditions occurring along this section of FM 518 that we cannot recom-
mend zone speeds lower than those submitted at the City Council meeting
on July 23, by Er. Lipscomb. As such, it is requested that you process
the ordinance based on the recommended zone speeds.
• 14e have received approval for alterations in the traffic controls at
FM 518 and SH 35 to provide an actuated type signal to replace the existing
fixed-time control. Plans for these changes will be prepared by this
office and will be submitted for your approval prior to actual construction.

You have requested permission to install on our poles a two
wire, 120 volt traffic signal control cable from the Pearland Fire Station
along a utility easement just south of and parallel to Broadway (FM 518)
extending from Grand Boulevard to South Main Street (State Highway 35) ,
then along the west side of South Main to the northwest corner of the
Broadway intersection.
In order to provide clearance for this circuit on our poles,
certain rearrangement of our facitities will be necessary. We are sure
you will understand that since the rearrangement of our facilities is
solely for your needs, we must ask that you pay the estimated cost of
the work amounting to $90.00. There is of course no cost involved to
the City for the use of poles on which City-owned cable is installed
and where proper clearance is presently available requiring no additional
construction by our Company.
If this is in accordance with your understanding, we would
appreciate your indicating acceptance by signing in the space provided
below and returning the original of this letter to us. Your acceptance
will be our authority to proceed with this work and bill the City of
Pearland the estimated cost of $90.00.
