2024-05-13 City Council Regular Meeting MinutesPearland City Council Minutes May 13, 2024 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES MAY 13, 2024 The City Council of Pearland, Texas convened in a meeting on Monday, May 13, 2024 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I.CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:44 p.m. II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Cole gave the Invocation and Councilmember Thumann led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III.ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Tony Carbone Councilmember Joseph Koza Councilmember Mona Chavarria Councilmember Clint Byrom Councilmember Layni Cade Councilmember Chad Thumann Councilmember Rushi Patel City Manager Trent Epperson City Attorney Darrin Coker City Secretary Frances Aguilar All members were present. IV.CITIZEN COMMENTS Breck Hamrock, 3712 Lockheed St., expressed his concerns with wheelchair accessibility of buildings, sidewalks and transportation within the city of Pearland. Diana Clark, 2714 N. Peach Hollow Cir., expressed her concern about the safety and infrastructure in the Lower Kirby District. Ellison Schoellopf, 3335 Worthington Dr., expressed her concern about Pearland's response to Palestine. Hannah Alm-Gibson, 3342 Worthington Dr., expressed her concern about our government's response to the Israeli occupation. Consideration and Possible Action - Approve the minutes of the Pearland City Council Special Meeting of April 22, 2024 and Regular Meeting of April 22, 2024. B. Consideration and Possible Action - Approve appointment to citizen boards and commissions as presented in the staff report. C. Consideration and Possible Action - Second and Final Reading of Ordinance No. 374-5 - An Ordinance of the City Council of the City of Pearland, Texas, amending Chapter 31, Wrecker Service, of the City of Pearland Code of Ordinances in its entirety, as it may have been, from time to time; having a savings clause, a severability clause, a penalty clause, and a repealer clause; providing for codification and an effective date. D. Consideration and Possible Action - Second and Final Reading of Ordinance No.1358-28 - An Ordinance of the City Council of the City of Pearland, Texas, amending non-development usage and service fees; containing a savings clause, a severability clause, a repealer clause, providing for publication and an effective date. E. Consideration and Possible Action - Resolution No. R2024-82 - A Resolution of the City Council of the City of Pearland, Texas, adopting the required policies pertaining to the Hurricane Harvey - Infrastructure Community Development Block Grant - Regional Mitigation Program (CDBG-MIT) Contract Number 24-065-017-E174 from the Texas General Land Office (GLO). F. Consideration and Possible Action - Resolution No. R2024-51 - A Resolution of the City Council of the City of Pearland, Texas, awarding the purchase of VT Scada licensing tags, to Trihedral, Inc., in the estimated amount of $76,397.25. G. Consideration and Possible Action - Resolution No. R2024-74 - A Resolution of the City Council of the City of Pearland, Texas, amending a unit price contract for the purchase of motor fuel from Houston- Pasadena Apache Oil Company, in the additional amount of $250,000.00 (total contract amount of $1,250,000.00). H. Consideration and Possible Action - Resolution No. R2024-76 - A Resolution of the City Council of the City of Pearland, Texas, approving a Change Order with Nerie Brothers Construction LLC, in the amount of $263,267.00 (total contract amount of $2,826,724.00), associated with the South Corrigan Transite Pipe Water Line Replacement Project. I. Consideration and Possible Action - Resolution No. R2024-79 - A Resolution of the City Council of the City of Pearland, Texas, approving a Change Order with PLW, LLC, in the amount of $294,202.00 (total contract amount of $70,890,117.00), associated with the John Hargrove Water Reclamation Facility Project. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. VI. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2024-65 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an expenditure of the Pearland Economic Development Corporation, in the amount of $467,600.00, with the Pearland Chamber of Commerce for a sixteen (16) month contract to manage the Pearland Innovation HUB for small business assistance in Pearland. Councilmember Chavarria made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-65. Matt Buchanan, President with Pearland Economic Development Corporation; Brian Malone, Vice President with Pearland Economic Development Corporation; and Jim Johnson, President with Pearland Chamber of Commerce addressed Council regarding the Pearland Innovation HUB. AYES: Carbone, Koza, Chavarria, Byrom, and Thumann. NAYS: Cade and Patel. The motion carried. 2. Consideration and Possible Action - Resolution No. R2024-80 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract associated with the Natatorium Air Handler Replacements Project, to American Mechanical Services, in the amount of $2,174,444.44. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-80. Brian Kisiel, Senior Account Manager with American Mechanical Services was available to answer questions from the Council. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 3. Consideration and Possible Action - First Reading of Ordinance No. 1494-5 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 1494-4,establishing prima facie speed limits established for vehicles under the provisions of Section 545.356, Texas Transportation Code, upon certain streets and highways, of parts thereof, Page 3 of 5 DocuSign Envelope ID: D6EAE7F1-30BF-4217-9CD4-7632633BE2F2 Pearland City Council Minutes May 13, 2024 within the corporate limits of the City of Pearland, as set out in this ordinance and providing a penalty (McHard Road from Cullen Blvd to Mykawa Road; and FM 2234 from the City Limits to CR 94). Councilmember Byrom made the motion, seconded by Councilmember Cade to approve the First Reading of Ordinance No. 1494-5. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 4. Consideration and Possible Action - First Reading of Ordinance No. 1502-1 - An Ordinance of the City Council of the City of Pearland, Texas, amending Chapter 4, Alcoholic Beverages, Section 4-2, General Requirements of the City of Pearland Code of Ordinances as it applies to Food and Beverage Certificate holders (i.e., restaurants); having a savings clause, a severability clause, and a repealer clause; provid-ing for publication, codification, and an effective date. Councilmember Cade made the motion, seconded by Mayor Pro-Tem Carbone to approve the First Reading of Ordinance No. 1502-1. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 5. Consideration and Possible Action - Resolution No. R2024-83 - A Resolution of the City Council of the City of Pearland, Texas, amending the City Council Rules and Order of Business (“Rules”) as guidelines for the organization and governance of the City Council. Councilmember Thumann made the motion, seconded by Mayor Pro-Tem Carbone to approve Resolution No. R2024-83. VII. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VIII. OTHER BUSINESS There were no other business items. IX. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION 1. Council Discussion - Regarding a staff member for city council. Councilmember Patel and Councilmember Cade discussed adding a staff member for city council. X.
