RESOLUTION NO. R2006-202
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARlAND,
TEXAS, AUTHORIZING THE SUBMISSION OF A PASS-THROUGH
FINANCING APPLICATION TO THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR THE EXPANSION OF CULLEN PARKWAY
FROM FM 518 TO BELTWAY 8.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
WHEREAS, the 78th Texas Legislature passed HB 3588, amended by HB 2702,
authorizing the Texas Department of Transportation (TxDOT) to enter into an agreement
with a public entity that provides for the payment of pass-through financing to a public entity
as reimbursement for the construction, maintenance, or operation of a toll or non-to!1 facility
on the state highway system by the public entity, and;
WHEREAS, the Texas Transportation Commission has adopted rules regarding the
policies and procedures governing the department's implementation of the pass-through
financing program, and;
WHEREAS, the City of Pearland has identified a project suitablH for development
under TxDOT's pass-through financing program, identified as the expansion of Cullen
Parkway (FM 865) from West Broadway Drive (FM 518) to Beltway .'3, and:
WHEREAS, the expansion of Cullen Parkway from a 2-lane undivided facility to a
divided 4-lane facility will address the mobility needs of existing and proposed local and
regional economic development and provide a safer transportation facility to serve the new
3000+student area high school anticipated to open in 2009, and;
WHEREAS, the City has invested approximately $7.4 million dollars to realign Old
Chocolate Bayou Road to the FM 518/ Cullen intersection and extended Cuilen Bivd. to
Magnolia Blvd. as part of their ongoing road bond program; and
WHEREAS, this project is included in the City's Comprehensive Plan as a major

thoroughfare with an ultimate 6-lane section and in the Houston-Galveston Area Council's
Year 2025 Regional Transportation Plan as a short term improvement, and;
WHEREAS, the City of Pearland wants to insure that its mobility and safety needs
are addressed in a timely manner.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS:
Section 1. That the City Manager is authorized to submit a pass-through financing
application to the Texas Department of Transportation for the expansion of Cullen Parkway
from FM 518 to Beltway 8, and that the Pearland City Council request the Texas
Transportation Commission's timely review and approval of the City's pass-through
financing project.
