2024-04-08 City Council Regular Meeting Minutes Pearland City Council Minutes April 08, 2024 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES APRIL 8, 2024 The City Council of Pearland, Texas convened in a meeting on Monday, April 8, 2024 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Cole gave the Invocation and Mayor Pro-Tem Koza led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Joseph Koza Councilmember Tony Carbone Councilmember Mona Chavarria Councilmember Adrian Hernandez Councilmember Layni Cade Councilmember Rushi Patel City Manager Trent Epperson City Attorney Darrin Coker City Secretary Frances Aguilar All members were present except for Councilmember Chad Thumann. Mayor Cole announced that it was Child Abuse Awareness Month and Autism Awareness Month. IV. CITIZEN COMMENTS There were no citizen comments. V. PUBLIC HEARING NO. 1 1. Public Hearing - A public hearing of the City Council of the City of Pearland on the proposed reallocation of unprogrammed Community Development Block Grant (CDBG) Annual Action Plan funding for HUD Program Years 2019, 2020, 2021, and 2022, for the purpose of matching Texas General Land Office Disaster Recovery funding for City of Pearland Capital Improvement Program (CIP) roadside ditch improvements in Brookland Acres Subdivision (DR2102) and along Garden Road/O'Day Road (DR2103) and Woody Road (DR2104). Presentation provided by Joel Hardy, Grants/Special Projects Administrator. There were no citizen comments. Mayor Cole closed the Public Hearing. VI. CONSENT AGENDA A. Consideration and Possible Action - Approve the minutes of the Pearland City Council Special Meeting of March 25, 2024, and Regular Meeting of March 25, 2024. B. Consideration and Possible Action - Resolution No. R2024-63 - A Resolution of the City Council of the City of Pearland, authorizing the City's participation in the FY2024 High-Intensity Drug Trafficking Area (HIDTA) Program (grant total of $11,000.00), as funded by the Office of National Drug Control Policy, and designating an authorized official. C. Consideration and Possible Action - Resolution No. R2024-61 - A Resolution of the City Council of the City of Pearland, Texas, (“City”) suspending the effective date for ninety days in connection with the rate increase filing made on or about March 6, 2024, by CenterPoint Energy Houston Electric LLC; authorizing the City’s continued participation in a coalition of cities known as the “Texas Coast Utilities Coalition of Cities;” authorizing participation in proceedings at the Public Utility Commission of Texas; authorizing the hiring of attorneys and consultants; requiring reimbursement of reasonable legal and consultant expenses; requiring proof of notice; finding that the meeting complies with the Open Meetings Act; making other findings and provisions related to the subject; and declaring an effective date. D. Pulled for discussion. E. Consideration and Possible Action - Resolution No. R2024-59 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a professional service contract with Black & Veatch Corporation, for preliminary engineering services associated with the Southdown Regional Lift Station and Force Main Project, in the estimated amount of $91,698.00. Councilmember Carbone made the motion, seconded by Councilmember Cade, to approve Consent Agenda items A - E except for D. AYES: Koza, Carbone, Chavarria, Hernandez, Cade, and Patel. NAYS: None. Consideration and Possible Action - Resolution No.2024-66 - A Resolution of the City Council of the City of Pearland, Texas, approving Special Event Permit No. EVNT23-00078 to host the Mafia Mania Concert and Festival Event. Mayor Pro-Tem Koza made the motion, seconded by Councilmember Cade, to approve Resolution No. R2024-66. AYES: Koza, Carbone, Chavarria, Hernandez, Cade, and Patel. NAYS: None. The motion carried. VII. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2024-69 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the defeasance and redemption of certain of the City’s Certificates of Obligations Series 2019B and 2020B (TIRZ related projects); and making certain findings and containing other provisions related thereto. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Koza, to approve Resolution No. R2024-69. John Robuck, Financial Advisor, with BOK, Inc. addressed Council regarding the City's Certificates of Obligations Series. AYES: Koza, Carbone, Chavarria, Hernandez, Cade, and Patel. NAYS: None. The motion carried. 2. Consideration and Possible Action - Resolution No. R2024-62 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire fee title to certain property for public facility improvements; all of that certain tract or parcel containing 20.35 Acres (886,331 square feet) of land situated in the H. T. & B. R. R. Company Survey, Section 19, A-243 , Pearland, Brazoria County, Texas, being all of a called 20.3472 acre tract of land conveyed to SA 2011 LLC as described in deed recorded under Brazoria County Clerk’s File Number (B.C.C.F. No.) 2013002026, in the Official Records of Brazoria County, Texas for the construction and maintenance of public facility improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. AYES: Koza, Carbone, Chavarria, and Cole. NAYS: Hernandez, Cade, and Patel. The motion carried. 3. Council Discussion - Regarding the voluntary annexation of PID 559432 located at the corner of Glenview Dr. and Deleon Ln. Mayor Cole opened the discussion. Presentation was presented by Vance Wyly, Director of Community Development. James Laird, 222 Saint James Place, applicant, was present to answer questions from the Council. IX. OTHER BUSINESS There were no other business items. X. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. XI. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 7:46 p.m. Section 551.071 - Consultation with City Attorney regarding legal advice related to state and municipal regulations. Conducted. Section 551.087- Discussion regarding Economic Development Negotiations Conducted. Section 551.072 - Consultation with City Attorney regarding the sale, lease or exchange of real property. Conducted. Section 551.074 - Discussion regarding membership on City Boards and Commissions. Conducted. Darrin Coker, City Attorney read the motion into record, "Consideration and Approval of the City Council of the City of Pearland, Texas, authorizing the Pearland Economic Development Corporation to enter into a Loan Assistance Agreement with Project #2404" as discussed in Executive Session. Councilmember Carbone made the motion, seconded by Councilmember Hernandez, to authorize staff to enter into a loan assistant agreement with (Project #2204) as discussed in Executive Session. AYES: Koza, Carbone, Chavarria, Hernandez, Cade, and Patel. NAYS: None. The motion carried. 5.Consideration and Possible Action - Regarding the sale, lease, purchase or exchange of real property. No action was taken. 6.Consideration and Possible Action- Regarding membership on City Boards and Commissions. No action was taken.
