R2020-CUP20-00014-1 2024-04-22 RESOLUTION NO. R2020-CUP20-00014-1 A Resolution Nunc Pro Tunc of the City Council of the City of Pearland correcting the unintentional execution of Resolution No. R2020-CUP20-00014 which failed by a vote of one vote For and four votes Against (1-4). WHEREAS, on November 16, 2020, the City Council and the City’s Planning and Zoning Commission conducted a joint special meeting (Meeting) to conduct a public hearing and City Council considered action to approve Conditional Use Permit (CUP-20-00014) for truck (Heavy) and Bus Rental or Sales within the Stonebridge Planned Development District, to accommodate a U-Haul dealer on approximately 4.5066 acres (Generally located at 1853 Pearland Parkway, Suite 123, Pearland, Texas); and WHEREAS, during the Meeting, City Council received a staff report and public testimony regarding CUP-20-00014; and WHEREAS, the City Council considered a motion to approve Resolution No. R2020- CUP20-00014 (Resolution), and the motion failed by a vote of one vote For and four votes Against as reflected in approved minutes of the Meeting attached hereto as Exhibit “A”; and WHEREAS, despite the fact the approved minutes reflect that the motion to approve the Resolution failed by a vote one vote For and four votes Against, the Resolution, attached hereto as Exhibit “B,” was unintentionally executed. WHEREAS, because the Resolution failed to receive sufficient votes to be approved, it has no force or effect to allow property uses sought by CUP20-00014; and BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the facts recited in the preamble to this Resolution are hereby found by the City Council to be true and correct and are incorporated herein by reference and expressly made a part hereof. Section 2. That the City Council hereby determines that Resolution No. R2020- CUP20-00014 was unintentionally executed, and therefore has no force or effect to allow the property uses sought by CUP20-00014. Length, width, and height of trucks and equipment parked on the premises shall not exceed dimensions of a 15-foot U-Haul Truck. 4. No part of a truck or equipment shall encroach into the adjacent fire lane when parked. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to City Council for consideration and decision. The City Council of the City of Pearland finds and determines that the Resolution adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section V. All rights and remedies, which have accrued in the favor of the City under this Resolution and its amendments thereto, shall be and are preserved for the benefit of the City. Section VI. Since last year when we discontinued this service, every day I receive multiple phone calls from customers asking for U-Haul services so I know this will serve the community well.
