2023-10-02 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES MINUTES OF THE REGULAR MEETING HELD IN-PERSON BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND,TEXAS, MONDAY, OCTOBER 2,2023, AT 6:30 PM IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR. CALL TO ORDER Chairperson Isenberg opened the meeting for the P&Z Regular Meeting at 6:31 P.M. In attendance were: P&Z Chairperson Derrell Isenberg P&Z Vice Chairperson Jennifer Henrichs P&Z Commissioner Brandon Dansby P&Z Commissioner Henry Fuertes P&Z Commissioner Brad Kuhn P&Z Commissioner Angela McCathran Also, present were Deputy City Attorney Lawrence Provins, Assistant City Engineer Francisco Reyes, Associate Engineer John De La Rosa, Community Development Director Vance Wyly, Community Development Assistant Director Martin Griggs, Senior Planner Florence Buaku, Planner I Patrick Bauer, Planning Intern Logan Farris and Administrative Assistant Shelby Lowe. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the P&Z Commission. These items will be enacted/approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. CONSIDERATION AND POSSIBLE ACTION - EXCUSED ABSENCES Excuse the absence of Commissioner Brandon Dansby and Commissioner Brad Kuhn from the September 18, 2023 Meeting. Chairperson Isenberg read into the record the items on the Consent Agenda. Commissioner Dansby made the motion to approve, Vice Chairperson Henrichs seconded the motion. Motion passed 6-0. NEW BUSINESS Chairperson Isenberg read into the record the items on Consideration and Possible Action —PLAT 23-108: Final Plat of Yanni Gardens. CONSIDERATION AND POSSIBLE ACTION - PLAT 23-108: FINAL PLAT OF YANNI GARDENS Public Hearing: A request by James Mahoney, of Landpoint, the applicant; on behalf of Pearland 28, LLC, owner; for approval of the Final Plat of Yanni Garden creating 29 single family lots, and 6 reserves on 11.0001 acres of land located on the west side of Hatfield Road about 550 feet south of Orange Street. Legal Description: A Subdivision of 11.0001 acres of land situated in the H.T.&B. R.R. Company Survey, Abstract No. 544 City of Pearland, Brazoria County, Texas. General Location: West of Hatfield Road south of Orange Street. Senior Planner Buaku presented the staff report with exhibits. Senior Planner Buaku stated that the final plat conforms to all the criteria of the UDC for approval. Staff recommends approval. The applicant was not present. Chairperson Isenberg called for public input. There were no persons wishing to speak for or against the proposed request. Commissioner Fuertes and Senior Planner Buaku discussed the preliminary plat and the near-by lift station. No further discussion from Staff, P&Z Commission or Public input. CONSIDERATION AND POSSIBLE ACTION - VARP 23-15: VARIANCE FROM THE MAXIMUM 3:1 LOT DEPTH TO LOT WIDTH RATIO IN THE R-1 DISTRICT Public Hearing: A request by Chris L Hendrick of Wilson Survey Group, applicant on behalf of Michael and Kelcee Torre, owners; for approval of a Variance Permitted in Section 2.6.1.1 (b)(1) of the Unified Development Code, Ordinance No. 2000-T, from Section 3.2.14.2 (c) to allow the creation of 1 lot that exceeds the maximum 3 to 1 Lot Depth to Lot Width Ratio described to wit: Legal Description: A Subdivision of 1.464 Acres in the H.T. & B. Survey, Section 21, Abstract No. 309 in the City of Pearland, Brazoria County, Texas. General Location: 3053 Navarre Rd, Pearland. Senior Planner Buaku presented the staff report with exhibits. Senior Planner Buaku stated that the plat variance conforms to all the criteria of the UDC for approval. Staff recommends approval. The applicant was not present. Chairperson Isenberg called for public input. There were no persons wishing to speak for or against the proposed request. Commissioner Fuertes, Deputy City Attorney Provins and Assistant Director Griggs discussed staff administratively approving plat variances like this one, the need for this plat variance and the upcoming UDC rewrite. No further discussion from Staff, P&Z Commission or Public input. Chairperson Isenberg read into the record the items on Consideration and Possible Action —Zone Change Application: ZONE 23-12. CONSIDERATION AND POSSIBLE ACTION -ZONE CHANGE APPLICATION: ZONE 23-12 Public Hearing: A request by Lisa To, applicant, on behalf of Simplice Guelson, owner, for approval of a zone change for 0.4135 acres of land from Neighborhood Service (NS) District to Single-Family Residential-2 (R-2) District, to wit: Legal Description: Lot 16 and Lot 17, in Block 2, of Willowcrest Addition, Section 1, an addition in Brazoria County, Texas, according to the map or plat thereof, recorded in Volume 9, Page 90 of the Map Records of Brazoria County, Texas. General Location: 2315 & 2317 Cedar Street, Pearland, Texas. Planner I Bauer presented the staff report with exhibits. Planner I Bauer stated that the zone change application conforms to all the criteria of the UDC for approval. Staff recommends approval. Applicant, Lisa To at 3707 West Center Drive, Houston, Texas 77042, was in attendance in Council Chambers to present to the P&Z Commission. Ms. To stated that they were originally going to develop a duplex on this site, but they decided to develop a single-family residence. She stated that the residential home will be anywhere from 1,900 to 2,900 square feet. Chairperson Isenberg called for public input. Resident, Stacy Wagner at 2310 Pear Court, Pearland, Texas 77581 , asked if this zone change would affect his property or school taxes. Commissioner Fuertes explained the difference between NS and R-2 zoning districts. He stated that this parcel came before the P&Z Commission prior for a CUP application for an assisted living facility. Commissioner Fuertes stated that R-2 zoning would be better for this parcel and will blend in better with the existing neighborhood. Commissioner Dansby asked staff if this zone change, or development would affect Mr. Wagner's taxes.Assistant Director Griggs stated that he was not sure if his taxes would be affected but adding a residence that would pay taxes would help to alleviate taxes overall. Commissioner Fuertes stated that having a residence on this parcel would boost property value compared to the current undeveloped lot. No further discussion from Staff, P&Z Commission or Public input. Chairperson Isenberg read into the record the items on Consideration and Possible Action—Zone Change Application: ZONE 23-12. Commissioner McCathran made the motion to approve, Commissioner Kuhn seconded the motion. Motion passed 6-0. CONSIDERATION AND POSSIBLE ACTION -COMPREHENSIVE PLAN PEARLAND2040 Public Hearing: Consideration and Possible action regarding the Adoption of the Pearland204O Comprehensive Plan. Assistant Director Griggs presented the staff report with exhibits. Comprehensive Plan Consultants with Kimley Horn, Mike Shelton and Josie Ortiz, were in attendance and assisted with the presentation. Chairperson Isenberg called for public input. There were no persons wishing to speak for or against the proposed request. Commissioner Fuertes stated that appreciated serving on the CPAC and the process of creating the Comprehensive Plan. He asked staff if when the Comprehensive Plan was presented to City Council, if they had any issues with the plan. Assistant Director Griggs stated that there was an issue with the ADU section. Assistant Director Griggs, Commissioner Fuertes and Mike Shelton discussed 'Missing Middle',a common theme when discussing the Comprehensive Plan and build to rent communities. No further discussion from Staff, P&Z Commission or Public input. Chairperson Isenberg read into the record the items on Consideration and Possible Action — Comprehensive Plan Pearland204O. Commissioner Fuertes made the motion to recommend Comprehensive Plan Pearland2040 as presented, Vice Chairperson Henrichs seconded the motion. Motion passed 6-0. DISCUSSION ITEMS 1. City Council Update Report: Presented by Assistant Director Griggs. Assistant Director Griggs stated that at the September 25, 2023, City Council Regular Meeting, City Council approved the second reading of the zone change at 2510 Roy Road from R-1 to GC (ZONE 23-11)with a vote of 4-3. 2. Commissioners Activity Report: Vice Chairperson Henrichs and Deputy City Attorney Provins discussed plats recording flood lines. Deputy City Attorney Provins recommended that Vice Chairperson Henrichs send concerns to staff. Commissioner Fuertes stated that he was out of the country this past week and is appreciative of our infrastructure. 3. Pearland Economic Development Prosperity Meeting with the P&Z Commission: October 9, 2023 at 6:30pm 4.
