JOINT PUBLIC HEARING AGENDA ITEM MEETING OF APRIL 17, 2006 Zone Change No. 2006-15Z TO: City Council Planning and Zoning Commission SUBJECT: A request by Jerry McGinty, applicant for Star Two Twin Lakes, L.P., owner, for an amendment to Ordinance No. 2000M, the Zoning Map of the City of Pearland, for approval of a change in zoning district from classification Planned Development District (PD) to Planned Development District (PD), an amendment to the existing Planned Development District (PD) for Twin Lakes LEGAL 64.8110 acres of land, being the Final Plat of Twin Lakes DESCRIPTION: Section One, as recorded in Volume 24, Pages 232 and 233, of the Plat Records of Brazoria County, Texas, City of Pearland, Brazoria County, Texas GENERAL Generally Located on the East Side of Veterans Drive, and LOCATION: Approximately 1,000 Feet South of Walnut Street APPROVAL PROCESS: After this Joint Public Hearing, the requested zone change application will be considered as follows: Planning and Zoning Commission: April 17, 2006* City Council for First Reading: May 8, 2006* City Council for Second Reading: May 22, 2006* (*dates subject to change if item is tabled) SUMMARY: The developer for Twin Lakes residential subdivision is proposing an amendment to the approved Planned Development District (PD) for Twin Lakes subdivision, which is located on the east side of Veterans Drive, and south of Walnut Street (south of the police station). The Twin Lakes PD was approved on March 22, 2004, by the City Council. JPH 04-17-06 2006-15Z Page 1 At a joint workshop between the City Council and the Planning and Zoning Commission on March 20, 2006, the developer presented modifications to the existing PD regarding fencing types that were specific to the PD approved in 2004. The applicant is proposing to relocate the solid 8 foot polymason wall that was to be constructed between the detention basins and the railroad tracks on the east boundary of the property to the back property lines of the homes that back up to the detention basins. The original PD indicated the fence would be a wrought iron or aluminum fence along the rear property line. The movement of the fence from the far eastern boundary along the tracks would remove the requirement for the wrought iron fence, so only one fence would be built. The Polymason fence will be concrete instead. No other changes within the PD are being considered. PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property.
