A Resolution of the City Council of the City of Pearland, Texas, certifying and
assuring of its efforts aimed at Affirmatively Furthering Fair Housing, in
compliance with U.S. Department of Housing & Urban Development (HUD)
regulations.
Whereas, the City has taken meaningful action that, taken together addressed significant
disparities in protected classes, vulnerable populations, significant disparities in housing needs,
and access to opportunity, replacing segregated living patterns with truly integrated and balanced
living patterns, transforming racially or ethnically concentrated areas of poverty into areas of
opportunity, and fostering and maintaining compliance with civil rights and fair housing laws; and
Whereas, the City acknowledges its duty to affirmatively further fair housing consideration
in the program that extends to all participant’s activities and programs relating to housing and
urban development; and
Whereas, the City will take appropriate actions to overcome the effects of any
impediments identified through any analysis and maintain records reflecting that analysis and
actions in this regard.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City of Pearland will institute best efforts to promote awareness of
actions aimed at Affirmatively Furthering Fair Housing (AFFH).
Section 2. The Mayor of the City of Pearland has been designated with the legal
authority to take this action on behalf of the community, per the City’s Governing Body (City of
Pearland – City Council Resolution No. R2023-318).
Section 3. This Resolution is effective immediately upon its Passage and approval.

Dear Mayor Cole,
Congratulations on your Regional Mitigation Program award! The GLO is excited to help your community facilitate
the implementation of your projects. We are currently in the process of drafting your contract. The following
items are needed as part of the contracting process:
Certification of Duty to Affirmatively Furthering Fair Housing. To complete the certification requirement, the City
must provide a document, signed by the Chief Elected Official, stating that the City took meaningful action that,
taken together addressed significant disparities in protected classes, vulnerable populations, significant disparities
in housing needs, and access to opportunity, replacing segregated living patterns with truly integrated and
balanced living patterns, transforming racially or ethnically concentrated areas of poverty into areas of
opportunity, and fostering and maintaining compliance with civil rights and fair housing laws. The City must
acknowledge the duty to affirmatively further fair housing consideration in the program that extends to all
participant's activities and programs relating to housing and urban development. To finalize the certification, a
signature from the Chief Elected Official must be affixed at the bottom. This is an acknowledgment that the
applicant will take appropriate actions to overcome the effects of any impediments identified through any analysis
and maintain records reflecting that analysis and actions in this regard. In addition, the signer is indicating that
they have the legal authority to take this action on behalf of the community.
An updated Census Map for the three projects (Herridge Miller Subdivision flood drainage improvements, Hickory
Creek/Garden Acres flood drainage improvements, and Hickory Slough Embankment slope replacement) the
census map submitted with the application does not sufficiently identify the boundaries of the service area. Per
the application guidelines, all applications must include a census map identifying the benefit area. Target area
projects must use Low and Moderate -Income Summary Data (LMISD) to document beneficiaries and must provide
LMISD maps which clearly show all the census geographic areas (i.e., census tract, block group) within the
applicant's jurisdiction. Please provide updated maps that identify the boundaries of the service area. Be sure to
include the identifier on the legend. Locations and boundaries of all project target areas must be clearly
delineated by identifiable features, such as named streets, railroads, streams, etc. Maps must clearly depict the
following information:
• Boundaries of the city, county, and/or service area;
• Locations of the target area community or communities within the city, county, and/or service area; and
• Locations of all proposed project activities within the target areas (e.g., sewer/water lines, lift stations, street
pavement, water storage tanks, wastewater treatment plants etc.). Applicants using LMISD to document project
beneficiaries must provide maps which show:
• All of the census geographic areas (e.g., census tracts, block groups) within the applicant's jurisdiction where
census data is used to document project beneficiaries as well as locations of the project activities on the same
census maps; and
• Census tract numbers and block group numbers, which must be legible on these census maps.
Updated LMISD Document for the Herridge Miller Subdivision flood drainage improvements project the LMISD
document submitted with the application is mislabeled as Hickory Creek and Garden Acres Subdivision. Please
provide an updated LMISD document for the Herridge Miller Subdivision flood drainage improvements project.
Please attach the requested documentation to this email no later than close of business 14 December 2023.
