A Resolution of The City Council of the City of Pearland, Texas,
authorizing the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with the Buyboard Purchasing System
for the purchase of three (3) Fire Apparatus replacements and loose
equipment for two (2) existing units, in the amount of $4,912,744.78, from
Siddons Martin Emergency Group.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That contract pricing has been obtained through interlocal cooperative partner
the Buyboard Purchasing System for the purchase of three (3) Fire Apparatus replacements and
loose equipment for two (2) existing units.
Section 2. That the City Manager or his designee is hereby authorized to participate in an
interlocal cooperative pricing arrangement with the Buyboard Purchasing System for the purchase
of three (3) Fire Apparatus replacements and loose equipment for two (2) existing units, in the
amount of $4,912,744.78, from Siddons Martin Emergency Group.

Additional: NOTE: Due to global supply chain constraints, any delivery date contained herein is a good faith estimate as of
the date of this order/contract, and merely an approximation based on current information. Delivery updates will be made
available, and a final firm delivery date will be provided as soon as possible.'
The price includes factory travel for 4 department personnel on two trips: approval visits and final inspection, and four days
of department training. The price includes the purchase and EVS installation of a 6-position David Clark intercom system and
installation of customer provided: radio with remote radio head, cradle point, an antenna on the cab roof, radio speaker, two
MDT mounts and a touch screen. The price also includes installation of a full width mudflap and pump discharge caps.
*Lead times as short as 33 months are available for this configuration. Short lead times are available on a first -come, first -
served basis with receipt of a customer purchase order and a signed proposal. Once received, an official lead-time will be
communicated
**EPA 2024 engines are available on a first come, first served basis with receipt of a customer purchase order and a signed
proposal. Once the order is placed, Pierce will advise if an EPA 2024 engine has been secured. If an EPA 2024 model engine is
secured, the increase amount of $62,500 per unit will be deducted.
***The Vital Trends warranty starts when the factory 1-year warranty ends.
****The price of loose equipment includes projected yearly inflation increases Loose equipment, poly, and equipment
mounting is not included in the total price. An increase of $9,831 per unit shall apply to the loose equipment -build out total
for each calendar year after 2023 until the equipment is ordered
Additional documents for the 8-year maintenance plan, 7-year Vital Trends extended warranty package, and itemized loose
equipment -build out are included.
Taxes: Tax is not included in this proposal. In the event that the purchasing organization is not exempt from sales tax or any
other applicable taxes and/or the proposed apparatus does not qualify for exempt status, it is the duty of the purchasing
organization to pay any and all taxes due. Balance of sale price is due upon acceptance of the apparatus at the factory.
Late Fee: A late fee of .033% of the sale price will be charged per day for overdue payments beginning ten (10) days after
the payment is due for the first 30 days. The late fee increases to .044% per day until the payment is received. In the event a
prepayment is received after the due date, the discount will be reduced by the same percentages above increasing the cost
of the apparatus.
Cancellation: Customer may decrease the quantity of units or cancel this order entirely without any cancellation fee if
written notice is provided to Siddons Martin Emergency Group, LLC on or before November 30 2023. After this date, the
cancellation provisions set forth below will apply to any reduction in quantity or cancellation of the order.
In the event this proposal is accepted and a purchase order is issued then cancelled or terminated by Customer before
completion Siddons-Martin Emergency Group may charge a cancellation fee. The following charge schedule based on costs
incurred may be applied:
(A) 10% of the Purchase Price after order is accepted and entered by Manufacturer;
(B) 20% of the Purchase Price after completion of the approval drawings;
(C) 30% of the Purchase Price upon any material requisition.
The cancellation fee will increase accordingly as costs are incurred as the order progresses through engineering and into
manufacturing. Siddons-Martin Emergency Group endeavors to mitigate any such costs through the sale of such product to
another purchaser; however, the customer shall remain liable for the difference between the purchase price and, if

applicable, the sale price obtained by Siddons-Martin Emergency Group upon sale of the product to another purchaser, plus
any costs incurred by Siddons-Martin to conduct such sale.
Acceptance: In an effort to ensure the above stated terms and conditions are understood and adhered to, Siddons-Martin
Emergency Group, LLC requires an authorized individual from the purchasing organization sign and date this proposal and
include it with any purchase order. Upon signing of this proposal, the terms and conditions stated herein will be considered
binding and accepted by the Customer. The terms and acceptance of this proposal will be governed by the laws of the state
of Texas. No additional terms or conditions will be binding upon Siddons-Martin Emergency Group, LLC unless agreed to in
writing and signed by a duly authorized officer of Siddons-Martin Emergency Group, LLC.

500 hour/ 6 Month Chassis Preventative Maintenance
Includes changing engine oil, oil filter(s), fuel filter(s), air filter, crank case (element only), def filter, air

filter, differential fluid inspection, complete chassis lubrication. 104 point visual inspection with

SMEG Aerial Preventative Maintenance
Includes OEM primary and 25 hour inspection, cleaning and lubricating all ladder points, minor cable
adjustment if necessary, top off hydraulic fluids and perform drift test on all cylinders. Operate and
inspect all ladder appliances. Replacement of hydraulic filters if necessary, will be an additional cost
and estimate provided to customer prior to completion.
A/C System Maintenance
Includes evacuate system and weigh refrigerant level. Replace OEM drier(s), replace service port
valves/caps, clean compressor screen, clean evaporator screens, vacuum test system, recharge with
refrigerant and perform system leak test.
TAK-4 Maintenance
Includes inspection and checks on all TAK-4 components including proper ride height and
adjustments required.
T3 Rear Axle (All -Steer) Maintenance
Includes inspection and checks on all TAK-3 component, torque verification and complete system
lubrication.
CAFS Annual Maintenance
Includes removal and replacement of all filters, drain and refill fluids. Operate and inspect all sytem
operation upon service completion.
Foam System "Only" Maintenance
Includes removal and replacement of all fluids and filter, remove and clean in -line foam strainer(s).

Wheels off Brake Inspection

All work for above pricing is to be performed at a Siddons Martin service facility. Any other parts and or labor not related to
maintenance costs provided above will be approved by the department before further services are performed. Maintenance
package pricing valid for 6-months from the date indicated on page 1.
* Additonal fees will apply for OEM aerial inspection(s) recommended at hourly intervals if requested by Customer
This maintenance agreement is between CUSTOMER and Siddons-Martin Emergency Group. In consideration for the amount
charged to CUSTOMER, CUSTOMER is entitled to receive the maintenance plan package from any approved SMEG service
center. The term of this agreement begins as of the date the vehicle is delivered to Customer.
In consideration for the amount paid by YOU, YOU will receive the number of scheduled maintenances as indicated above.
CUSTOMER can only use the scheduled maintenance on the vehicle identified above.
By signing below, CUSTOMER acknowledges that:
• The information contained above is to the best of your knowledge correct. You have read this agreement, understand,
and accept all the provisions herein including the fact that this agreement is non -cancelable, this agreement is not a warranty,
an insurance policy or a guarantee.
• Customer will receive the scheduled maintenances indicated above. The scheduled maintenance must be used
consecutively within the guidelines of the plan with any missed scheduled maintenance being CUSTOMER's responsibility.
CUSTOMER can only use the scheduled maintenance on the vehicle listed above. CUSTOMER is solely responsible for
performing and scheduling all services and maintenance required to keep the vehicle in safe working order and in order to
maintain any manufacture warranty
• CUSTOMER agrees that no verbal representation have been made that are not in this agreement. The maintenance
package expires after on the anniversary of the delivery date of the vehicle plus the number of YEARS as set forth in this
agreement. For example, if the vehicle is delivered on 06/25/2023 and YEARS is 3, then the agreement would expire on
06/25/2026.
• The purchase price of the maintenance package may be included in the purchase price of the vehicle but the price of the
maintenance package is separate from the price of the vehicle and is not a requirement to purchase the vehicle.
• This agreement is non -transferable.
• This agreement does not cover, nor will the agreement pay for:
o Work performed by anyone other than a SMEG service center.
o Any items not specifically listed under this maintenance plan agreement.
• You are responsible for scheduling all maintenance work with the SMEG service center.
Agreement: means the service maintenance package pricing agreement.
You, Your: means customer named in the heading of the agreement.
Vehicle: means the vehicle described in the heading of the agreement.

LIMITED WARRANTY AGREEMENT TERMS AND CONDITIONS
A. COVERAGE:
1. TIER 1: SQUAD
i, ENGINE: Internally lubricated parts limited to bearings, cam followers, camshaft and cam
bearings, connecting rods, connecting rod bearings, constant velocity valve, crankshaft, hydraulic
lifters, intake and exhaust valves and valve guides, main thrust washers, oil pan and oil pan gasket,
oil cooler and housing, oil pump, oil pump housing and gears, oil pump pick up screen, tube, and
tube seal, oil pump pressure relief springs and valves, oil pressure sending unit, pistons, piston
rings, piston oil cooling jets, pushrods, radiator, rocker arms, rocker arm shafts, timing chain and
gears, timing chain tensioners, timing gear cover and timing gear case seal, valve keepers (locks),
valve retainers, valve springs, valve cover and valve cover gasket, and wrist pins. The following
related components are covered: exhaust manifold; flywheel housing and gasket; front crank seal,
front housing gasket, intake manifold includes gasket), rear main seal; thermostat and housing; and
vibration dampener. The engine block, alternator, cylinder liners, cylinder heads, cylinder liner
seal, and head gasket, are covered if damaged by a covered component or wear -out failure showing
no neglect or fault of operation; no progressive damage.
ii. HYBRID/ALTERNATIVE COMPONENTS: Tri%North Globa1TM may approve the use of certain OEM
and non -OEM add -on components and systems designed to extend oil change intervals; deliver
alternative fuels such as CNG, LNG, and others; reduce fuel consumption or reduce component heat,
wear, and failure (Extra Components). The Extra Components are not automatically covered by this
Agreement. Any initial failure and progressive damage of any kind traced to the use of unapproved
or approved Extra Components will not be covered by this Agreement and are the responsibility of
the Customer. Extra Components use will not void this Agreement, as long as their use is approved,
in writing, by TrUNorth GlobalT'^ prior to the approval of this Agreement.
iii. APPLICABLE FLUIDS, PARTS, TAXES AND LABOR. Up to $150 in shop supplies covered per claim
occurrence.
iv. TRANSMISSION: Internally lubricated parts of the manual or automatic transmission limited to
bands, bearings, blockers, bushings, drums, gear sets, governor, oil pump, shaft(s), input shaft,
power take -off, shift forks, synchronizers, thrust washers, torque converter, valve body and XY
shifter. The transmission case is covered only if damaged by a covered component. Clutch covered
if failed; parts only and up to $1,500 USD in labor within the warranty term and no progressive
damage.
v. DIFFERENTIALS: Internally lubricated parts limited to axle shafts, bearings, bushings, carrier
case, gear sets, limited slip clutch pack, as well as power divider: bearings, gears, shafts, and shift
fork. The differential housing is covered only if damaged by a covered component.
vi. TURBO PACKAGE: TURBOCHARGER(S) includes bearings, internal variable vane assembly,
turbines, turbine shaft, turbo actuator, turbocharger housing, and turbo oil return seal; charge air
cooler. FUEL PUMP(S); fuel injector hard lines, fuel lift pump, fuel transfer pump,fuel injection
pump, intake manifold, governor, and fuel tank. ENGINE FUEL INJECTORS: includes failed injectors

Internal component failure only. The turret housing is covered only if damaged by a covered
component. Seals, gaskets and/or hoses are not covered.
5. APU PACKAGE OPTION: (Only covered if purchased) Internally lubricated hard parts limited to
pistons, pistons rings, wrist pins, connecting rods, connecting rod bearings, crankshaft, main
bearings, thrust washers, camshaft and caul bearings, rocker arm shafts, rocker arms, push rods,
hydraulic lifters, intake and exhaust valves and guides, valve springs, oil pump and housing, oil
sump and housing, valve keepers (locks), gears, timing gear cover, valve cover, and oil pan. The
following related components are covered: exhaust manifold; fuel pump; fuel injection pump;
injectors; and water pump, no progressive damage. The engine block and cylinder head are
covered if damaged by a covered component or wearout failure showing no neglect or fault of
operation; no progressive damage. Any damage resulting from a seal leak or a blown head gasket is
not covered.
B. AGREEMENT PERIOD: The term of this Agreement is based on the time selected on page 1, section
IV. The term begins on the Agreement Date on page 1, section I and expires when its time limit is
reached. This Agreement may be transferred ONLY to another municipality or emergency response
company, one time, with an approved Inspection and ECM printout, completed Transfer Request
Form, and paid fee to TriiNorth Global', the Authorized Administrator, (additional paperwork may
be required). For transfer questions, contact Customer Service at 800-903-7489 ext. 801.
C. LIMITS OF LIABILITY: If the initial cause of the failure is traced to any component listed in section
VIII., A., the initial component and Any progressive damage is specific and limited to the limit of
liability for that initial component; unless otherwise listed. The repair costs will be counted against
the listed component's limit of liability AND the vehicle's Total Aggregate Limit, unless otherwise
listed. All prices listed in USD.
i. SQUAD TIER 1: TriiNorth GlobalTM's Liability shall not exceed $30,000 for Engine; $20,000 for
Transmission; $15,000 for Differential(s); $20,000 combined for Turbo Package; $15,000
combined for Aftertreatment Systems; $12,500 combined for Body and Bolt On; $12,5000
combined for Electrical. The Total Aggregate Limit for SQUAD covered components shall not
exceed $125,000.
ii. BATTALION TIER 2: TriiNorth GlobalTM's Liability shall not exceed $30,000 for Engine; $20,000
for Transmission; $15,000 for Differential(s); $20,000'combined for Turbo Package; $15,000
combined for Aftertreatment Systems; $17,500 combined for Body and Bolt On; $20,000 combined
for Electrical; $5,000 combined for Cabin Comfort; $15,000 combined for Steering, Suspension, &
Brakes. The Total Aggregate Limit for BATTALION covered components shall not exceed $157,500.
iii. APU Package Option: If purchased, $5,000 combined for components listed in section A,
subsection 3. APU Package. This Limit of Liability is included in the Squad or Battalion Total
Aggregate Limit.
iv. Apparatus Equipment Option: If purchased, $35,000 combined for components listed in section
A, subsection 4. Apparatus Equipment Option. This Limit of Liability is separate from the SQUAD or

BATTALION Total Aggregate Limit listed above.
v. Aerial Package Option: If purchased, $35,000 combined for components listed in section A,
subsection 5. Aerial Package Option. This Limit of Liability is separate from the SQUAD or
BATTALION Total Aggregate Limit listed above. vi. Claims paid for the associated Maintenance,
Wear, and Replacement Program will be deducted from the respective Limit of Liability component
categories listed above.
D. THIS PROGRAM HAS ZERO STANDARD DEDUCTIBLE PER COVERED CLAIM OCCURRENCE.
E. TOWING OR MOBILE MECHANIC MILEAGE REIMBURSEMENT: Reimbursement will be calculated
to the Original Equipment Manufacturer (OEM) dealer or certified repair facility, whichever is
nearest to the breakdown origin. This is an added service for valid and approved claims. There is a
$350 USD limit per covered occurrence and a limit of three occurrences per warranty term.
F. This section does not apply to this Limited Warranty Agreement.
G. REQUIRED MAINTENANCE: Required Maintenance begins on the Agreement Date and continues
until all component coverage expires. TrUNorth Global' has the right to deny warranty coverage if
the required maintenance is not performed according to these requirements. (OEM extended
intervals honored only if OEM Standards are adhered to and approved by TrQNorth G1oba1TM at
inception of Limited Warranty Agreement). Maintenance and cleaning are not covered by TriiNorth
G1oba1TM.
i. Customer must have services completed by an OEM dealership or a licensed service facility
(Puerto Rico residents must have services completed by an OEM dealership(s)).
ii. Customer must keep ALL receipts and work orders that verify the services performed. Logs or
receipts that are handwritten and CANNOT be verified by the service facility ARE NOT accepted.
These receipts must include: correct Vehicle Identification Number (VIN), the miles/KM/hours at
time of service, and date of service.
iii. TYPE 3 Emergency Vehicle requires the engine oil and filters must be maintained and replaced
according to OEM specifications or every six (6) months/25,000 miles/500 hours (whichever
occurs first) by a licensed service facility with a thirty (30) day/2,500 mile/50-hour tolerance
(whichever occurs first). Additionally, the vehicle and associated components must be maintained
in accordance with the NFPA (National Fire Protection Association) standards.
iv. Transmission and Differential fluids must be replaced according to OEM specifications or yearly
(whichever occurs first) by a licensed service facility with a thirty (30) day tolerance.
v. Aftertreatment Systems must be maintained to OEM specifications in order to validate any claim
for these components.
vi. The vehicle's odometer and ECM must be maintained and in proper working condition.
Documentation of odometer and ECM changes must be submitted to TrQNorth Global'"'.
vii. Apparatus Equipment and Aerial Package components must be maintained to OEM
specifications and NFPA standards in order to validate any claim for these components.
viii. APU must be maintained according to OEM specifications or every six (6) months/1,000 hours

(whichever occurs first) including oil and filter change(s).
H. CLAIM PROCEDURE AND BREAKDOWN RESPONSIBILITIES: "Breakdown" means the failure of any
original or replacement part covered by this Agreement originally designed to work in normal
service with proper maintenance as recommended by the OEM and mandated by this Agreement. A
component will be deemed "failed" or "wear -out failure" when wear exceeds the OEM's tolerable
limits, TruNorth Global' will pay for parts and labor necessary to repair or replace the approved
covered parts. The price of replacement parts shall not exceed the OEM's suggested retail price for
parts. Replacement parts will be the same quality as the covered parts and may include new,
remanufactured, or used parts with TrtiNorth GlobalTr's approval. Labor allowances are derived
from the nationally recognized labor time schedules.
i. If breakdown occurs, please call TrtiNorth G1oba1TM Claims immediately at 800-903-7489 ext. 820
- 24 hours a day/7 days a week or email: Claims@TruNorthWarranty.com. Customer must have
services completed by an OEM dealership or licensed service facility.
ii. Customer must obtain authorization from TrtiNorth G1obaITM prior to beginning any covered
repairs. An authorization cannot be made until all diagnostic information is received. Service
center/Repair facility has 10 business days once authorization is made to complete repairs. If
repairs are not completed after 10 business days, TrtiNorth G1oba1TM reserves the right to revoke
authorization without appeal. Please contact TrtiNorth G1obaITM at 800-903-7489 ext. 820 for a
claim extension request.
iii. Customer must authorize the service center/repair facility to perform necessary diagnostic
work. Customer will be responsible for the costs of diagnostics if the breakdown is not covered.
iv. Customer must provide all information as TriiNorth GIoba1TM requests and provide proof of
vehicle's regular maintenance as required in this Agreement (See G. Required Maintenance) within
five (5) days from the day of request. Documented and verifiable proof that the Required
Maintenance was performed will be required prior to any authorization for repairs. If Customer
fails to provide any requested documents within this time period, TrtiNorth Globa1TM may deny the
claim.
v. Upon the report of a claim, Customer and/or the service center/ repair facility must follow up
with TrtiNorth G1obaITM within 15 days with the following information: estimates (including
detailed cause of failure, failed components, and detailed list of required parts and labor costs), a
recent time stamped ECM fault code history report (must include current ESN/VIN and show first
& last occurrences of active/inactive codes prior to clearing history for diagnostics), pictures of
failed components, picture(s) of corresponding NFPA tag(s) (if applicable), current odometer and
ECM miles/km/hours, and/or anything requested by the TruNorth GlobalT"' Claims Administrator.
If neither customer nor the service center/repair facility contacts TrtiNorth Global"' within this
time period, TrtiNorth G1oba1TM may deny the claim. Clearing history for diagnostics before
reporting active/inactive fault codes to Trallorth Globa1TM may result in denial of a claim.
vi. Allow Trallorth GIoba1TM to examine/inspect the vehicle, if requested.
vii. Final decisions regarding the initial cause of failure are determined by TrtiNorth GlobalT"',

viii. Claims are paid directly to the service center/repair facility only.
ix. Upon completion of authorized repairs, service center/repair facility must provide confirmation
of road test, and submit part/labor warranty information, verification of payment for non -covered
balance, and final invoice. This information must be received, and all monies paid prior to release
of the vehicle.
I. HOW THIS AGREEMENT IS CANCELLED OR VOIDED:
i. TritNorth Globa1TM may void this Agreement for (a) non-payment or return of any charge when
due, (b) misrepresentation by Customer entering into this Agreement, (c) submission of a
fraudulent claim, (d) failure to comply with all the Limited Warranty Agreement Terms and
Conditions, or (e) transfer by Customer without TrQNorth Globa1T''''s consent (see section B).
Failure to act when required will void this Agreement as of the date any requirement was due and
not performed. Once voided, the Agreement rights and privileges are forfeited including the
validation of any claim and the right to any refund. ii. In the event Customer elects to cancel this
Agreement, no refund of the purchase price is available to the customer. If there is an extenuating
circumstance(s), contact Customer Service at 800-903-7489 ext. 801.
ii. In the event Customer elects to cancel this Agreement, no refund of the purchase price is
available to the customer. If there is an extenuating circumstance(s), contact Customer Service at
800-903-7489 ext. 801.
iii. The lien holder may cancel this Agreement for non-payment, repossession, or total loss. A
written request for cancellation and documentation verifying the event must be received within
(30) days of the cancelable event.
iv. A pro -rated refund will ONLY be considered in a total loss situation. If a pro -rated refund is
available, proof of total loss will be required within thirty (30) days of the total loss event. In the
case of a lien holder cancellation, the lien holder will be named on the pro -rated refund check.
TrQNorth GIoba1TM will refund a pro -rated portion of the Agreement charge TrUNorth G1oba1TM
received less an Administration Fee and the percentage for the number of days in force from the
Agreement Date. TrflNorth GlobalT'' will also deduct a claims administration fee per processed
claim(s) and the amount TruNorth G1oba1TM contributed toward any paid claim(s).
J. DISPUTE RESOLUTION: This Agreement shall be governed by and in accordance with the laws of
the State of North Carolina, USA without regard to conflict of law principles. In the event of any
dispute between parties arising out of or related to this Agreement in any way, including for breach
of this Agreement, the dispute shall be settled by arbitration administered by the American
Arbitration Association (AAA). Either party may submit a Demand for Arbitration to the AAA.
Arbitration is the sole method of dispute resolution between parties for arbitrable claims.
Arbitration shall be administered in accordance with AAA's Commercial Arbitration Rules. Unless
prohibited by law, either party's Demand for Arbitration must be submitted within 90 days of
when a claim or any portion of the claim is denied, or 90 days from any other conduct on which the
dispute is based. An arbitration demand is made by sending the Demand for Arbitration to AAA,
with a copy to the other party. The arbitration will be heard by a single arbitrator selected by
AAA.The arbitrator shall have the power to rule on his or her own jurisdiction, including

any objections with respect to the existence, scope, or validity of the arbitration agreement or the
arbitrability of any claim or counterclaim. THE PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL
AND WAIVE ALL RIGHTS TO SERVE AS A CLASS REPRESENTATIVE OR RECEIVE ANY PART OF A
CLASS RECOVERY. Each of the parties will pay equally all arbitration fees and arbitrator
compensation. The inperson arbitration hearing will take place only in Mecklenburg County, North
Carolina, USA unless both parties agree in writing to a different hearing location. A decision from
the arbitrator(s) will be binding and final. The determination and award of the arbitrator(s) may
be filed by the prevailing party in a court of proper jurisdiction and shall thereafter have the full
force and effect of a judgment at law. This arbitration provision contains mutual benefits and is
binding upon all parties, their successors, and assigns. This arbitration provision will survive
bankruptcy and will survive any termination, amendment, expiration, or performance of this
Agreement. If any portion of this arbitration provision is held invalid, the remainder shall remain in
effect. The parties agree that any action, suit, or proceeding arising out of or related to this
Agreement in any way, not submitted to arbitration, shall be instituted only in the state or federal
courts located in Mecklenburg County, North Carolina, USA.
K. WHAT IS NOT COVERED: This Agreement does not cover and shall not be liable for:
i. Damage resulting from the failures of related components but not limited to unless otherwise
listed in Section. A: actuators; bolts; charge air cooler duct work; clamps; connectors; EGR valves
linkages; electronic control devices; external fittings; external oil coolers and lines; fasteners;
hydraulic clutch master; jake brakes; linkage; manual or automatic transmission clutch-disc(s);
mounts; oil, fuel or coolant lines; pressure plate; radiators; seals and gaskets; shift levers; slave
cylinder(s); sliding clutch(es); thermostat; and throw out or pilot bearing; vacuum controls; VPod
and waste gates are not covered (unless otherwise listed). Coverage listed does not include: any
related electrical system or electrical component contamination, or corrosion.
ii. Any malfunction, damage, or wear caused by faulty installation, misapplication, abrasion,
inadequate or improper maintenance, negligence, tampering, or substitution of component parts.
iii. The improper design, manufacture, installation, operation, or maintenance of structures,
accessories, equipment, or materials not approved by OEM.
iv. Component malfunction due to contamination or corrosion. Wear and tear, excessive oil
consumption, loss of compression, overheating, and/or the gradual reduction in operating
performance are not covered. Components deemed "out of service" due to expiration are not
covered.
v. A vehicle if it has a salvage title or is a non-U.S. or Canadian specified vehicle.
vi. Shop materials or hazardous waste disposal charges or costs covered by any warranty of the
manufacturer.
vii. State required dealer warranty, a repairer's guarantee, or costs incurred to improve operating
performance if the components are within manufacturer's tolerance or specification. This includes
but is not limited to manufacturer or aftermarket up -grades or design changes, valve and ring
repairs designed to improve engine compression, reduce oil consumption, or to remove sludge or

carbon deposits, and improvements for diminished performance.
viii. Failure caused by or involving modification(s) or alteration(s) made to the vehicle that was not
performed by the Original Equipment Manufacturer or selling dealer. Examples include but are not
limited to: emission control, exhaust system, and engine modifications.
ix. Continued operation of an impaired vehicle, in excess of 12 hours or where the vehicle is in limp -
mode, Berate, or has experienced stop engine lights. An estimate will be required by the Authorized
Administrator and any coverage, if applicable, will be limited to the initial failed component.
Part(s) only. No progressive damage will be covered.
x. Operating the vehicle without proper levels of fluids, lubricants or coolants, or using improper or
contaminated fluids
xi. Failure of a non -covered part.
xii. Failure caused by corrosion, rust, dirt, or dust.
xiii. Any loss or breakdown resulting from racing or other competitive driving, operator error,
accident/collision, fire, theft, vandalism, riot, war, lightning, earthquake, windstorm, hail, water,
freezing, flood, salt, environmental damage, or Acts of God is not covered.
xiv. Incidental or consequential loss or damage, loss of time and use, inconvenience, profits or
wages, towing expense, lodging, meals, and storage resulting from a breakdown.
xv. Any liability or property damage, injury or death of any person, punitive or exemplary damage,
and/or attorney fees arising out of the operation or use of the vehicle.
xvi. If the odometer or ECM has been stopped, altered, or misrepresents the vehicle's actual

*Lead times as short as 42 months are available for this configuration. Short lead times are available on a first -come, first -
served basis with receipt of a customer purchase order and a signed proposal. Once received, an official lead-time will be
communicated
**The Vital Trends warranty starts when the factory 1-year warranty ends.
***The price of loose equipment includes projected yearly inflation increases. Loose equipment, poly, and equipment
mounting is not included in the total price. A discount of $12 452 shall apply to the loose equipment -build out total each
year before the delivery date when the equipment is ordered A total discount of $49,810 is available if the equipment is
ordered in calendar year 2023.
Additional documents for the 8-year maintenance plan, 7-year Vital Trends extended warranty package, and itemized loose
equipment -build out are included.
Taxes: Tax is not included in this proposal. In the event that the purchasing organization is not exempt from sales tax or any
other applicable taxes and/or the proposed apparatus does not qualify for exempt status, it is the duty of the purchasing
organization to pay any and all taxes due. Balance of sale price is due upon acceptance of the apparatus at the factory.
Late Fee: A late fee of .033% of the sale price will be charged per day for overdue payments beginning ten (10) days after
the payment is due for the first 30 days. The late fee increases to .044% per day until the payment is received. In the event a
prepayment is received after the due date, the discount will be reduced by the same percentages above increasing the cost
of the apparatus.
Cancellation: Customer may cancel this order without any cancellation fee if written notice is provided to Siddons Martin
Emergency Group LLC on or before November 30, 2023. After this date, the cancellation provisions set forth below will
apply.
In the event this proposal is accepted and a purchase order is issued then cancelled or terminated by Customer before
completion Siddons-Martin Emergency Group may charge a cancellation fee. The following charge schedule based on costs
incurred may be applied:
(A) 10% of the Purchase Price after order is accepted and entered by Manufacturer;
(B) 20% of the Purchase Price after completion of the approval drawings;
(C) 30% of the Purchase Price upon any material requisition.
The cancellation fee will increase accordingly as costs are incurred as the order progresses through engineering and into
manufactunng. Siddons-Martin Emergency Group endeavors to mitigate any such costs through the sale of such product to
another purchaser however the customer shall remain liable for the difference between the purchase price and, if
applicable, the sale price obtained by Siddons-Martin Emergency Group upon sale of the product to another purchaser, plus
any costs incurred by Siddons-Martin to conduct such sale.

Emergency Group, LLC requires an authorized individual from the purchasing organization sign and date this proposal and

binding and accepted by the Customer. The terms and acceptance of this proposal will be governed by the laws of the state

This maintenance agreement is between CUSTOMER and Siddons-Martin Emergency Group. In consideration for the amount
charged to CUSTOMER, CUSTOMER is entitled to receive the maintenance plan package from any approved SMEG service
center. The term of this agreement begins as of the date the vehicle is delivered to Customer.
In consideration for the amount paid by YOU, YOU will receive the number of scheduled maintenances as indicated above.
CUSTOMER can only use the scheduled maintenance on the vehicle identified above.
By signing below, CUSTOMER acknowledges that:
• The information contained above is to the best of your knowledge correct. You have read this agreement, understand,
and accept all the provisions herein including the fact that this agreement is non -cancelable, this agreement is not a warranty,
an insurance policy or a guarantee.
• Customer will receive the scheduled maintenances indicated above. The scheduled maintenance must be used
consecutively within the guidelines of the plan with any missed scheduled maintenance being CUSTOMER's responsibility.
CUSTOMER can only use the scheduled maintenance on the vehicle listed above. CUSTOMER is solely responsible for
performing and scheduling all services and maintenance required to keep the vehicle in safe working order and in order to
maintain any manufacture warranty
• CUSTOMER agrees that no verbal representation have been made that are not in this agreement. The maintenance
package expires after on the anniversary of the delivery date of the vehicle plus the number of YEARS as set forth in this
agreement. For example, if the vehicle is delivered on 06/25/2023 and YEARS is 3, then the agreement would expire on
06/25/2026.
• The purchase price of the maintenance package may be included in the purchase price of the vehicle but the price of the
maintenance package is separate from the price of the vehicle and is not a requirement to purchase the vehicle.
• This agreement is non -transferable.
• This agreement does not cover, nor will the agreement pay for:
o Work performed by anyone other than a SMEG service center.
o Any items not specifically listed under this maintenance plan agreement.
• You are responsible for scheduling all maintenance work with the SMEG service center.

LIMITED WARRANTY AGREEMENT TERMS AND CONDITIONS
A. COVERAGE:
1. TIER 1: SQUAD
i. ENGINE: Internally lubricated parts limited to bearings, cam followers, camshaft and cam
bearings, connecting rods, connecting rod bearings, constant velocity valve, crankshaft, hydraulic
lifters, intake and exhaust valves and valve guides, main thrust washers, oil pan and oil pan gasket,
oil cooler and housing, oil pump, oil pump housing and gears, oil pump pick up screen, tube, and
tube seal, oil pump pressure relief springs and valves, oil pressure sending unit, pistons, piston
rings, piston oil cooling jets, pushrods, radiator, rocker arms, rocker arm shafts, timing chain and
gears, timing chain tensioners, timing gear cover and timing gear case seal, valve keepers (locks),
valve retainers, valve springs, valve cover and valve cover gasket, and wrist pins. The following
related components are covered: exhaust manifold; flywheel housing and gasket; front crank seal,
front housing gasket, intake manifold includes gasket), rear main seal; thermostat and housing; and
vibration dampener. The engine block, alternator, cylinder liners, cylinder heads, cylinder liner
seal, and head gasket, are covered if damaged by a covered component or wear -out failure showing
no neglect or fault of operation; no progressive damage.
ii. HYBRID/ALTERNATIVE COMPONENTS: TruNorth Global" may approve the use of certain OEM
and non -OEM add -on components and systems designed to extend oil change intervals; deliver
alternative fuels such as CNG, LNG, and others; reduce fuel consumption or reduce component heat,
wear, and failure (Extra Components). The Extra Components are not automatically covered by this
Agreement. Any initial failure and progressive damage of any kind traced to the use of unapproved
or approved Extra Components will not be covered by this Agreement and are the responsibility of
the Customer. Extra Components use will not void this Agreement, as long as their use is approved,
in writing, by TriiNorth Global" prior to the approval of this Agreement.
iii. APPLICABLE FLUIDS, PARTS, TAXES AND LABOR. Up to $150 in shop supplies covered per claim
occurrence.
iv. TRANSMISSION: Internally lubricated parts of the manual or automatic transmission limited to
bands, bearings, blockers, bushings, drums, gear sets, governor, oil pump, shaft(s), input shaft,
power take -off, shift forks, synchronizers, thrust washers, torque converter, valve body and XY
shifter. The transmission case is covered only if damaged by a covered component. Clutch covered
if failed; parts only and up to $1,500 USD in labor within the warranty term and no progressive
damage.
v. DIFFERENTIALS: Internally lubricated parts limited to axle shafts, bearings, bushings, carrier
case, gear sets, limited slip clutch pack, as well as power divider: bearings, gears, shafts, and shift
fork. The differential housing is covered only if damaged by a covered component.
vi. TURBO PACKAGE: TURBOCHARGER(S) includes bearings, internal variable vane assembly,
turbines, turbine shaft, turbo actuator, turbocharger housing, and turbo oil return seal; charge air
cooler. FUEL PUMP(S); fuel injector hard lines, fuel lift pump, fuel transfer pump,fuel injection
pump, intake manifold, governor, and fuel tank. ENGINE FUEL INJECTORS: includes failed injectors

4. AERIAL PACKAGE OPTION: (Only covered if purchased) Aerial ladder controls; turret hydraulics;
remote nozzles; remote nozzle controls; turntable; boom, hydraulics, and control components.
Internal component failure only. The turret housing is covered only if damaged by a covered
component. Seals, gaskets and/or hoses are not covered.
5. APU PACKAGE OPTION: (Only covered if purchased) Internally lubricated hard parts limited to
pistons, pistons rings, wrist pins, connecting rods, connecting rod bearings, crankshaft, main
bearings, thrust washers, camshaft and cam bearings, rocker arm shafts, rocker arms, push rods,
hydraulic lifters, intake and exhaust valves and guides, valve springs, oil pump and housing, oil
sump and housing, valve keepers (locks), gears, timing gear cover, valve cover, and oil pan. The
following related components are covered: exhaust manifold; fuel pump; fuel injection pump;
injectors; and water pump, no progressive damage. The engine block and cylinder head are
covered if damaged by a covered component or wearout failure showing no neglect or fault of
operation; no progressive damage. Any damage resulting from a seal leak or a blown head gasket is
not covered.
B. AGREEMENT PERIOD: The term of this Agreement is based on the time selected on page 1, section
IV. The term begins on the Agreement Date on page 1, section I and expires when its time limit is
reached. This Agreement may be transferred ONLY to another municipality or emergency response
company, one time, with an approved Inspection and ECM printout, completed Transfer Request
Form, and paid fee to TriiNorth Global', the Authorized Administrator, (additional paperwork may
be required). For transfer questions, contact Customer Service at 800-903-7489 ext. 801.
C. LIMITS OF LIABILITY: If the initial cause of the failure is traced to any component listed in section
VIII., A., the initial component and Any progressive damage is specific and limited to the limit of
liability for that initial component; unless otherwise listed. The repair costs will be counted against
the listed component's limit of liability AND the vehicle's Total Aggregate Limit, unless otherwise
listed. All prices listed in USD.
i. SQUAD TIER 1: TrfNorth Globa1TM's Liability shall not exceed $30,000 for Engine; $20,000 for
Transmission; $15,000 for Differential(s); $20,000 combined for Turbo Package; $15,000
combined for Aftertreatment Systems; $12,500 combined for Body and Bolt On; $12,5000
combined for Electrical. The Total Aggregate Limit for SQUAD covered components shall not
exceed $125,000.
ii. BATTALION TIER 2: TriiNorth GlobalTM's Liability shall not exceed $30,000 for Engine; $20,000
for Transmission; $15,000 for Differential(s); $20,000 combined for Turbo Package; $15,000
combined for Aftertreatment Systems; $17,500 combined for Body and Bolt On; $20,000 combined
for Electrical; $5,000 combined for Cabin Comfort; $15,000 combined for Steering, Suspension, &
Brakes. The Total Aggregate Limit for BATTALION covered components shall not exceed $157,500.
iii. APU Package Option: If purchased, $5,000 combined for components listed in section A,
subsection 3. APU Package. This Limit of Liability is included in the Squad or Battalion Total
Aggregate Limit.
iv. Apparatus Equipment Option: If purchased, $35,000 combined for components listed in section
A, subsection 4. Apparatus Equipment Option. This Limit of Liability is separate from the SQUAD or

BATTALION Total Aggregate Limit listed above.
v. Aerial Package Option: If purchased, $35,000 combined for components listed in section A,
subsection 5. Aerial Package Option. This Limit of Liability is separate from the SQUAD or
BATTALION Total Aggregate Limit listed above. vi. Claims paid for the associated Maintenance,
Wear, and Replacement Program will be deducted from the respective Limit of Liability component
categories listed above.
D. THIS PROGRAM HAS ZERO STANDARD DEDUCTIBLE PER COVERED CLAIM OCCURRENCE.
E. TOWING OR MOBILE MECHANIC MILEAGE REIMBURSEMENT: Reimbursement will be calculated
to the Original Equipment Manufacturer (OEM) dealer or certified repair facility, whichever is
nearest to the breakdown origin. This is an added service for valid and approved claims. There is a
$350 USD limit per covered occurrence and a limit of three occurrences per warranty term.
F. This section does not apply to this Limited Warranty Agreement.
G. REQUIRED MAINTENANCE: Required Maintenance begins on the Agreement Date and continues
until all component coverage expires. TrQNorth Global' has the right to deny warranty coverage if
the required maintenance is not performed according to these requirements. (OEM extended
intervals honored only if OEM Standards are adhered to and approved by TrUNorth Global' at
inception of Limited Warranty Agreement). Maintenance and cleaning are not covered by TruNorth
Globa1TM.
i. Customer must have services completed by an OEM dealership or a licensed service facility
(Puerto Rico residents must have services completed by an OEM dealership(s)).
ii. Customer must keep ALL receipts and work orders that verify the services performed. Logs or
receipts that are handwritten and CANNOT be verified by the service facility ARE NOT accepted.
These receipts must include: correct Vehicle Identification Number (VIN), the miles/KM/hours at
time of service, and date of service.
iii. TYPE 3 Emergency Vehicle requires the engine oil and filters must be maintained and replaced
according to OEM specifications or every six (6) months/25,000 miles/500 hours (whichever
occurs first) by a licensed service facility with a thirty (30) day/2,500 mile/50-hour tolerance
(whichever occurs first). Additionally, the vehicle and associated components must be maintained
in accordance with the NFPA (National Fire Protection Association) standards.
iv. Transmission and Differential fluids must be replaced according to OEM specifications or yearly
(whichever occurs first) by a licensed service facility with a thirty (30) day tolerance.
v. Aftertreatment Systems must be maintained to OEM specifications in order to validate any claim
for these components.
vi. The vehicle's odometer and ECM must be maintained and in proper working condition.
Documentation of odometer and ECM changes must be submitted to TriNorth Global".
vii. Apparatus Equipment and Aerial Package components must be maintained to OEM
specifications and NFPA standards in order to validate any claim for these components.
viii. APU must be maintained according to OEM specifications or every six (6) months/1,000 hours

(whichever occurs first) including oil and filter change(s).
H. CLAIM PROCEDURE AND BREAKDOWN RESPONSIBILITIES: `Breakdown" means the failure of any
original or replacement part covered by this Agreement originally designed to work in normal
service with proper maintenance as recommended by the OEM and mandated by this Agreement. A
component will be deemed "failed" or "wear -out failure" when wear exceeds the OEM's tolerable
limits. TrfNorth G1oba1TM will pay for parts and labor necessary to repair or replace the approved
covered parts. The price of replacement parts shall not exceed the OEM's suggested retail price for
parts. Replacement parts will be the same quality as the covered parts and may include new,
remanufactured, or used parts with TriiNorth GlobalT's approval. Labor allowances are derived
from the nationally recognized labor time schedules.
i. If breakdown occurs, please call TrfNorth G1oba1TM Claims immediately at 800-903-7489 ext. 820
- 24 hours a day/7 days a week or email: Claims@TruNorthWarranty.com. Customer must have
services completed by an OEM dealership or licensed service facility.
ii. Customer must obtain authorization from TrfNorth GlobalT" prior to beginning any covered
repairs. An authorization cannot be made until all diagnostic information is received. Service
center/Repair facility has 10 business days once authorization is made to complete repairs. If
repairs are not completed after 10 business days, TriiNorth G1oba1TM reserves the right to revoke
authorization without appeal. Please contact TriiNorth G1oba1TM at 800-903-7489 ext. 820 for a
claim extension request.
iii. Customer must authorize the service center/repair facility to perform necessary diagnostic
work. Customer will be responsible for the costs of diagnostics if the breakdown is not covered.
iv. Customer must provide all information as TriiNorth G1oba1TM requests and provide proof of
vehicle's regular maintenance as required in this Agreement (See G. Required Maintenance) within
five (5) days from the day of request. Documented and verifiable proof that the Required
Maintenance was performed will be required prior to any authorization for repairs. If Customer
fails to provide any requested documents within this time period, TriiNorth G1oba1TM may deny the
claim.
v. Upon the report of a claim, Customer and/or the service center/ repair facility must follow up
with TruNorth G1oba1TM within 15 days with the following information: estimates (including
detailed cause of failure, failed components, and detailed list of required parts and labor costs), a
recent time stamped ECM fault code history report (must include current ESN/VIN and show first
& last occurrences of active/inactive codes prior to clearing history for diagnostics), pictures of
failed components, picture(s) of corresponding NFPA tag(s) (if applicable), current odometer and
ECM miles/km/hours, and/or anything requested by the TruNorth G1oba1TM Claims Administrator.
If neither customer nor the service center/repair facility contacts TriiNorth G1oba1TM within this
time period, TrfNorth G1oba1TM may deny the claim. Clearing history for diagnostics before
reporting active/inactive fault codes to TrUNorth G1obaI1TM may result in denial of a claim.
vi. Allow TrQNorth G1oba1TM to examine/inspect the vehicle, if requested.
vii. Final decisions regarding the initial cause of failure are determined by TriiNorth GlobalT"'.

viii. Claims are paid directly to the service center/repair facility only.
ix. Upon completion of authorized repairs, service center/repair facility must provide confirmation
of road test, and submit part/labor warranty information, verification of payment for non -covered
balance, and final invoice. This information must be received, and all monies paid prior to release
of the vehicle.
I. HOW THIS AGREEMENT IS CANCELLED OR VOIDED:
i. TrQNorth Global' may void this Agreement for (a) non-payment or return of any charge when
due, (b) misrepresentation by Customer entering into this Agreement, (c) submission of a
fraudulent claim, (d) failure to comply with all the Limited Warranty Agreement Terms and
Conditions, or (e) transfer by Customer without TriiNorth GlobalTM's consent (see section B).
Failure to act when required will void this Agreement as of the date any requirement was due and
not performed. Once voided, the Agreement rights and privileges are forfeited including the
validation of any claim and the right to any refund. ii. In the event Customer elects to cancel this
Agreement, no refund of the purchase price is available to the customer. If there is an extenuating
circumstance(s), contact Customer Service at 800-903-7489 ext. 801.

iii. The lien holder may cancel this Agreement for non-payment, repossession, or total loss. A
written request for cancellation and documentation verifying the event must be received within
(30) days of the cancelable event.
iv. A pro -rated refund will ONLY be considered in a total loss situation. If a pro -rated refund is
available, proof of total loss will be required within thirty (30) days of the total loss event. In the
case of a lien holder cancellation, the lien holder will be named on the pro -rated refund check.
TrQNorth Global' will refund a pro -rated portion of the Agreement charge TriiNorth Globa1TM
received less an Administration Fee and the percentage for the number of days in force from the
Agreement Date. TriiNorth GlobalTM will also deduct a claims administration fee per processed
claim(s) and the amount TrQNorth Globa1TM contributed toward any paid claim(s).
J. DISPUTE RESOLUTION: This Agreement shall be governed by and in accordance with the laws of
the State of North Carolina, USA without regard to conflict of law principles. In the event of any
dispute between parties arising out of or related to this Agreement in any way, including for breach
of this Agreement, the dispute shall be settled by arbitration administered by the American
Arbitration Association (AAA). Either party may submit a Demand for Arbitration to the AAA.
Arbitration is the sole method of dispute resolution between parties for arbitrable claims.
Arbitration shall be administered in accordance with AAA's Commercial Arbitration Rules. Unless
prohibited by law, either party's Demand for Arbitration must be submitted within 90 days of
when a claim or any portion of the claim is denied, or 90 days from any other conduct on which the
dispute is based. An arbitration demand is made by sending the Demand for Arbitration to AAA,
with a copy to the other party. The arbitration will be heard by a single arbitrator selected by
AAA.The arbitrator shall have the power to rule on his or her own jurisdiction, including

any objections with respect to the existence, scope, or validity of the arbitration agreement or the
arbitrability of any claim or counterclaim. THE PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL
AND WAIVE ALL RIGHTS TO SERVE AS A CLASS REPRESENTATIVE OR RECEIVE ANY PART OF A
CLASS RECOVERY. Each of the parties will pay equally all arbitration fees and arbitrator
compensation. The inperson arbitration hearing will take place only in Mecklenburg County, North
Carolina, USA unless both parties agree in writing to a different hearing location. A decision from
the arbitrator(s) will be binding and final. The determination and award of the arbitrator(s) may
be filed by the prevailing party in a court of proper jurisdiction and shall thereafter have the full
force and effect of a judgment at law. This arbitration provision contains mutual benefits and is
binding upon all parties, their successors, and assigns. This arbitration provision will survive
bankruptcy and will survive any termination, amendment, expiration, or performance of this
Agreement. If any portion of this arbitration provision is held invalid, the remainder shall remain in
effect. The parties agree that any action, suit, or proceeding arising out of or related to this
Agreement in any way, not submitted to arbitration, shall be instituted only in the state or federal
courts located in Mecklenburg County, North Carolina, USA.
K. WHAT IS NOT COVERED: This Agreement does not cover and shall not be liable for:
i. Damage resulting from the failures of related components but not limited to unless otherwise
listed in Section. A: actuators; bolts; charge air cooler duct work; clamps; connectors; EGR valves
linkages; electronic control devices; external fittings; external oil coolers and lines; fasteners;
hydraulic clutch master; jake brakes; linkage; manual or automatic transmission clutch-disc(s);
mounts; oil, fuel or coolant lines; pressure plate; radiators; seals and gaskets; shift levers; slave
cylinder(s); sliding clutch(es); thermostat; and throw out or pilot bearing; vacuum controls; VPod
and waste gates are not covered (unless otherwise listed). Coverage listed does not include: any
related electrical system or electrical component contamination, or corrosion.
ii. Any malfunction, damage, or wear caused by faulty installation, misapplication, abrasion,
inadequate or improper maintenance, negligence, tampering, or substitution of component parts.
iii. The improper design, manufacture, installation, operation, or maintenance of structures,
accessories, equipment, or materials not approved by OEM.
iv. Component malfunction due to contamination or corrosion. Wear and tear, excessive oil
consumption, loss of compression, overheating, and/or the gradual reduction in operating
performance are not covered. Components deemed "out of service" due to expiration are not
covered.
v. A vehicle if it has a salvage title or is a non-U.S. or Canadian specified vehicle.
vi. Shop materials or hazardous waste disposal charges or costs covered by any warranty of the
manufacturer.
vii. State required dealer warranty, a repairer's guarantee, or costs incurred to improve operating
performance if the components are within manufacturer's tolerance or specification. This includes
but is not limited to manufacturer or aftermarket up -grades or design changes, valve and ring
repairs designed to improve engine compression, reduce oil consumption, or to remove sludge or

carbon deposits, and improvements for diminished performance.
viii. Failure caused by or involving modification(s) or alteration(s) made to the vehicle that was not
performed by the Original Equipment Manufacturer or selling dealer. Examples include but are not
limited to: emission control, exhaust system, and engine modifications.
ix. Continued operation of an impaired vehicle, in excess of 12 hours or where the vehicle is in limp -
mode, derate, or has experienced stop engine lights. An estimate will be required by the Authorized
Administrator and any coverage, if applicable, will be limited to the initial failed component.
Part(s) only. No progressive damage will be covered.
x. Operating the vehicle without proper levels of fluids, lubricants or coolants, or using improper or
contaminated fluids
xi. Failure of a non -covered part.
xii. Failure caused by corrosion, rust, dirt, or dust.
xiii. Any loss or breakdown resulting from racing or other competitive driving, operator error,
accident/collision, fire, theft, vandalism, riot, war, lightning, earthquake, windstorm, hail, water,
freezing, flood, salt, environmental damage, or Acts of God is not covered.
xiv. Incidental or consequential loss or damage, loss of time and use, inconvenience, profits or
wages, towing expense, lodging, meals, and storage resulting from a breakdown.
xv. Any liability or property damage, injury or death of any person, punitive or exemplary damage,
and/or attorney fees arising out of the operation or use of the vehicle.
xvi. If the odometer or ECM has been stopped, altered, or misrepresents the vehicle's actual
miles/km/hours. Factory ECM parameters, codes, warning systems, and alarms cannot be altered
and must be in working order at all times while this Agreement is in effect.
xvii. Abuse, misuse, spin -out, shock load, over -rev, overloading or hauling that exceeds the
manufacturer's recommendations for the vehicle.
xviii. A pre-existing breakdown, failure, or an improper prior repair whether performed prior to
purchase or sale date. These conditions may not have been known to the parties at time of vehicle
sale.
