Ord. 1012-5 2023-08-281 ORDINANCE NO. 1012-5 An Ordinance of the City Council of the City of Pearland, Texas, repealing Chapter 20, Offenses and Miscellaneous Provisions, Article IV, Minors, of the City Code of Ordinances; containing an effective date and other provisions related to the subject; and containing emergency, savings and severability clauses. WHEREAS, Pursuant to Texas Local Government Code, Chapter 370, the City Council, previously adopted Ordinance No. 1012 establishing a curfew for persons under the age of 17; and WHEREAS, the 88th Texas Legislature adopted H.B. 1819, amending Chapter 370, prohibiting political subdivisions from adopting or enforcing ordinances that impose a curfew to regulate the movements or actions of minors; and WHEREAS, to comply with H.B.1819, the City Council finds and determines that the repeal of Ordinance No. 1012 and its amendments is necessary; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Chapter 20, Offenses and Miscellaneous Provisions, Article IV, Minors, of the City Code of Ordinances, is hereby repealed in its entirety. Section 2. Savings. All rights and remedies which have accrued in favor of the City under this Ordinance shall be and are preserved for the benefit of the City. Section 3. Severability. If any section or part of this Ordinance be held unconstitutional, illegal or invalid, or the application thereof ineffective or inapplicable as to any territory, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portions, the same shall be and remain in full force and effect. The Council finds and determines that compliance with Texas Local Government Code Chapter 370 inures to the public and, therefore, bears directly upon the health, safety, and welfare of the citizenry; and that this ordinance shall be adopted as an emergency measure, and that the rule requiring this ordinance to be read on two (2) separate occasions be, and the same is hereby waived. Section 5. Effective Date. This ordinance shall be effective immediately upon its first and only reading.
