2023-07-10 CITY COUNCIL REGULAR MEETING MINUTES Pearland City Council Minutes July 10, 2023 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES JULY 10, 2023 The City Council of Pearland, Texas convened in a meeting on Monday, July 10, 2023, at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Pro-Tem Koza gave the Invocation and Councilmember Hernandez led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Consideration and Possible Action - Second and Final Reading of Ordinance No. 2000T -39 - An Ordinance of the City Council of the City of Pearland, Texas, for the purpose of amending to the Unified Development Code of the City of Pearland, Texas, Ordinance No. 2000T, Chapter 1, Section 1.1.3.3 (a)(2), Advisory Capacity of the Planning and Zoning Commission to the City Council to review, prepare reports upon and make recommendations concerning approval, conditional approval, or denial of Conditional Use Permit (CUP) petitions; and Chapter 2, Section 2.2.3.3 (b), Role of the Planning and Zoning Commission to review and comment on Conditional Use Permit (CUP) petitions; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. F. Consideration and Possible Action – Second and Final Reading of Ordinance No. 1626 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of City of Pearland, Texas, permanent improvement bonds in one or more series; setting certain parameters for the bonds; authorizing a pricing officer to approve the amount, the interest rate, price, and terms thereof and certain other procedures and provisions relating thereto. G. Consideration and Possible Action - Resolution No. R2023-169 - A Resolution of the City Council of the City of Pearland, Texas, declaring intention to reimburse project expenditures from proceeds of future tax- exempt obligations. H. Consideration and Possible Action - Resolution No. R2023-167 - A Resolution of the City Council of the City of Pearland, authorizing the use of Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) funds for the buyout acquisition of real property located at 3422 Lethbridge, PID No. 258197 (“Property”), to be demolished, owned, and maintained as greenspace in perpetuity by the City of Pearland. I. Consideration and Possible Action - Resolution No. R2023-160 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into a Reimbursement Agreement between the City and the Pearland Economic Development Corporation and authorizing a Letter Finance Agreement with the Lower Kirby Pearland Management District associated with the Fruge Road East Improvements Land Acquisition. J. Consideration and Possible Action - Resolution No. R2023-163 - A Resolution of the City Council of the City of Pearland, Texas, authorizing conveyance of certain real property to the Lower Kirby Pearland Management District (LKPMD) for the construction and maintenance of regional drainage detention facilities. K. L. Consideration and Possible Action - Resolution No. R2023-158 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an expenditure of the Pearland Economic Development Corporation (PEDC) for the renewal of landscaping and maintenance services (commercial corridors and entryways), with Landscape Art, Inc., in the estimated amount of $236,662.30 for the period beginning September 1, 2023 through September 30, 2024. Consideration and Possible Action - Resolution No. R2023-157 - A Resolution of the City Council of the City of Pearland, Texas, awarding a labor and material contract for HVAC Replacement Services (Fire Administration) to TDIndustries, in the estimated amount of $190,895.00. P. Consideration and Possible Action - Resolution No. R2023-165 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a professional service contract with Cobb, Fendley & Associates, for engineering services associated with Fiber Backbone Project (Magnolia from Cullen Parkway to Business Center Drive), in the estimated amount of $53,346.00. Q. Pulled for discussion. Councilmember Carbone made the motion, seconded by Mayor Pro-Tem Koza, to approve A-Q, except for B, C, D, M, N, and Q. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. VI. NEW BUSINESS 1. Consideration and Possible Action – Second and Final Reading of Ordinance No. 1619-2 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 1619-1, the 2022-2023 Annual Budget Ordinance, to facilitate the changes identified herein; providing a savings clause, a severa-bility clause, a repealer clause, and an effective date. Councilmember Kamkar made the motion, seconded by Councilmember Cade, to approve Ordinance No. 1619-2. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. Mayor Pro-Tem Koza made the motion, seconded by Councilmember Cade, to approve Resolution No. R2023-161. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. 3. Consideration and Possible Action - Resolution No. R2023-94 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a construction management and construction inspection services contract with Aguirre & Fields, LP, in the estimated amount of $1,660,201.90, for the Bailey Road Expansion Project (Veterans Drive to SH 35). Councilmember Hernandez made the motion, seconded by Mayor Pro-Tem Koza, to approve Resolution No. 2023-94. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. VII. MATTERS REMOVED FROM CONSENT AGENDA B. Consideration and Possible Action - Excuse the absence of Councilmember Hernandez from the June 26, 2023 City Council Regular Meeting. Councilmember Cade made the motion, seconded by Councilmember Barry, to excuse the absence of Councilmember Hernandez from the June 26, 2023 Regular Meeting. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. C. Consideration and Possible Action - Excuse the absence of Councilmember Kamkar from the June 26, 2023 City Council Regular Meeting. Councilmember Barry made the motion, seconded by Councilmember Cade, to excuse the absence of Councilmember Kamkar from the June 26, 2023 Regular Meeting. Councilmember Carbone made the motion, seconded by Councilmember Barry, to approve Resolution No. R2023-115. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. M. Consideration and Possible Action - Resolution No. R2023-159 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an expenditure of the Pearland Economic Development Corporation (PEDC) for renewal of landscaping and maintenance services (commercial corridors and entryways) with Silversand Services, in the estimated amount of $342,451.41, for the period beginning September 1, 2023 through September 30, 2024. Councilmember Kamkar made the motion, seconded by Mayor Pro-Tem Koza, to approve Resolution No. R2023-159. AYES: Koza, Carbone, Kamkar, Hernandez, and Barry. NAYS: Cade. The motion carried. N. Consideration and Possible Action - Resolution No. R2023-162 - A Resolution of the City Council of the City of Pearland, Texas, authorizing Pearland Economic Development Corporation (PEDC) expenditures to enter into a construction services contract with DC Contracting Services for the Argovitz Detention Expansion Project, in the amount of $319,640.00. Mayor Pro-Tem Koza made the motion, seconded by Councilmember Barry, to approve Resolution No. R2023-162. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried. Councilmember Hernandez made the motion, seconded by Councilmember Cade, to approve Resolution No R2023-151. AYES: Koza, Carbone, Kamkar, Hernandez, Cade, and Barry. NAYS: None. The motion carried.
