("CONSULTANT"). The PEDC engages the CONSULTANT to perform professional services for a project known and described as Industrial Drive Reconstruction Engineering and Design ("PROJECT"). SECTION I - SERVICES OF THE CONSULTANT The CONSULTANT shall perform the following professional services to PEDC standards and in accordance with the degree of care and skill that a professional in Texas would exercise under the same or similar circumstances: A. The CONSULTANT shall provide engineering and design services, additional services, and construction phase services for the Industrial Drive Reconstruction project west of SH 35. See Exhibit A, attached, for a detailed SCOPE OF WORK and PROJECT schedule. The PROJECT schedule shall be submitted in digital and hard copy form in the Microsoft Project for Windows format. B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost of the PROJECT. C. The CONSULTANT acknowledges that the PEDC (through its City of Pearland employee handbook) considers the following to be misconduct that is grounds for termination of a PEDC or City employee: Any fraud, forgery, misappropriation of funds, receiving payment for services not performed or for hours not worked, mishandling or untruthful reporting of money transactions, destruction of assets, embezzlement, accepting materials of value from vendors, or consultants, and/or collecting reimbursement of expenses made for the benefit of the PEDC. The CONSULTANT agrees that it will not, directly or indirectly; encourage a PEDC employee to engage in such misconduct. D. The CONSULTANT shall submit all final construction documents in both hard copy and electronic format. Plans shall be AutoCAD compatible and all other documents shall be Microsoft Office compatible. The software version used shall be compatible to current PEDC standards. Other support documents, for example, structural calculations, drainage reports and geotechnical reports, shall be submitted in hard copy only. All Record Drawings electronic files shall be submitted to the PEDC in TIF format. E. The CONSULTANT recognizes that all drawings, special provisions, field survey notes, reports, estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT shall be delivered to the PEDC upon request, shall become subject to the Open Records Laws of this State. Design 1 of 6 D1. Revised 2018 F. The CONSULTANT shall procure and maintain for the duration of this Agreement, insurance against claims for injuries to persons, damages to property, or any errors and omissions relating to the performance of any work by the CONSULTANT, its agents, employees or subcontractors under this Agreement, as follows: (1) (2) Professional Liability Insurance in an amount not less than $1,000,000 in the aggregate. (3) Workers' Compensation as required by law. Comprehensive General Liability and Property Damage Insurance with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for each occurrence of damage to or destruction of property. (4) Comprehensive Automobile and Truck Liability Insurance covering owned, hired, and non -owned vehicles, with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for property damage. The CONSULTANT shall include the PEDC as an additional insured under the policies, with the exception of the Professional Liability Insurance and Workers' Compensation. Certificates of Insurance and endorsements shall be furnished to the PEDC before work commences. Each insurance policy shall be endorsed to state that coverage shall not be suspended, voided, canceled, and/or reduced in coverage or in limits ("Change in Coverage") except with prior written consent of the PEDC and only after the PEDC has been provided with written notice of such Change in Coverage, such notice to be sent to the PEDC either by hand delivery to the PEDC President or by certified mail, return receipt requested, and received by the PEDC no fewer than thirty (30) days prior to the effective date of such Change in Coverage. Prior to commencing services under this CONTRACT, CONSULTANT shall furnish PEDC with Certificates of Insurance, or formal endorsements as required by this CONTRACT, issued by CONSULTANT'S insurer(s), as evidence that policies providing the required coverage, conditions, and limits required by this CONTRACT are in full force and effect. G. The CONSULTANT shall indemnify and hold the PEDC, its officers, agents, and employees, harmless from any claim, loss, damage, suit, and liability of every kind for which CONSULTANT is legally liable, including all expenses of litigation, court costs, and attorney's fees, for injury to or death of any person, for damage to any property, or errors in design, any of which are caused by the negligent act or omission of the CONSULTANT, his officers, employees, agents, or subcontractors under this CONTRACT. H. All parties intend that the CONSULTANT, in performing services pursuant to this CONTRACT, shall act as an independent contractor and shall have control of its Design 2 of 6 D1. Revised 2018 own work and the manner in which it is performed. The CONSULTANT is not to be considered an agent or employee of the PEDC. SECTION II - PERIOD OF SERVICE This CONTRACT will be binding upon execution and end upon successful completion of approved deliverables as outlined on the attached SCOPE OF WORK and PROJECT schedule. SECTION III - CONSULTANT'S COMPENSATION A. The total compensation for the services performed shall not exceed the total noted in Section B. B. The PEDC shall pay the CONSULTANT in installments based upon monthly progress reports and detailed invoices submitted by the CONSULTANT based upon the following: 1. Basic Services (Lump Sum) $360,717 2. Additional Services: Survey, ROW Mapping, Geotechnical Services, Environmental Services, (Lump Sum): $104,607 3. Bid Phase Services (Hourly Not to Exceed) $8,508 4. Construction Phase Services (Hourly Not to Exceed) $65,007 5. Reimbursable Expenses (Not to Exceed) $3,000 6. Total: $541,839.00 C. The PEDC shall make payments to the CONSULTANT within thirty (30) days after receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly basis. SECTION IV - THE PEDC'S RESPONSIBILITIES A. The PEDC shall designate a project manager during the term of this CONTRACT who may be a staff member of the City of Pearland. The project manager has the authority to administer this CONTRACT and shall monitor compliance with all terms and conditions stated herein. All requests for information from or a decision by the PEDC on any aspect of the work shall be directed to the project manager. B. The PEDC shall review submittals by the CONSULTANT and provide prompt response to questions and rendering of decisions pertaining thereto, to minimize Design 3 of 6 D1. Revised 2018 delay in the progress of the CONSULTANT'S work. The PEDC will keep the CONSULTANT advised concerning the progress of the PEDC'S review of the work. The CONSULTANT agrees that the PEDC'S inspection, review, acceptance or approval of CONSULTANT'S work shall not relieve CONSULTANT'S responsibility for errors or omissions of the CONSULTANT or its sub- consultant(s) or in any way affect the CONSULTANT'S status as an independent contractor of the PEDC. SECTION V - TERMINATION A. The PEDC, at its sole discretion, may terminate this CONTRACT for any reason - - with or without cause -- by delivering written notice to CONSULTANT personally or by certified mail at 1920 Country Place Parkway, Suite 400, Pearland, TX 77584. Immediately after receiving such written notice, the CONSULTANT shall discontinue providing the services under this CONTRACT. B. If this CONTRACT is terminated, CONSULTANT shall deliver to the PEDC all drawings, special provisions, field survey notes, reports, estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT, entirely or partially completed, together with all unused materials supplied by the PEDC on or before the 15th day following termination of the CONTRACT. C. In the event of such termination, the CONSULTANT shall be paid for services performed prior to receipt of the written notice of termination. The PEDC shall make final payment within sixty (60) days after the CONSULTANT has delivered to the PEDC a detailed invoice for services rendered and the documents or work product generated by the CONSULTANT under the CONTRACT. D. If the remuneration scheduled under this contract is based upon a fixed fee or definitely ascertainable sum, the portion of such sum payable shall be proportionate to the percentage of services completed by the CONSULTANT based upon the scope of work. E. In the event this CONTRACT is terminated, the PEDC shall have the option of completing the work, or entering into a CONTRACT with another party for the completion of the work. Design 4 of 6 D1. Revised 2018 F. If the PEDC terminates this CONTRACT for cause and/or if the CONSULTANT breaches any provision of this CONTRACT, then the PEDC shall have all rights and remedies in law and/or equity against CONSULTANT. Venue for any action or dispute arising out of or relating to this CONTRACT shall be in Brazoria County, Texas. The laws of the State of Texas shall govern the terms of this CONTRACT. The prevailing party in the action shall be entitled to recover its actual damages with interest, attorney's fees, costs and expenses incurred in connection with the dispute and/or action. CONSULTANT and PEDC desire an expeditious means to resolve any disputes that may arise between under this CONTRACT. To accomplish this, the parties agree to mediation as follows: If a dispute arises out of or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be settled through negotiation, then the parties agree first to try in good faith, and before pursuing any legal remedies, to settle the dispute by mediation of a third party who will be selected by agreement of the parties. SECTION VI — ENTIRE AGREEMENT This CONTRACT represents the entire agreement between the PEDC and the CONSULTANT and supersedes all prior negotiations, representations, or contracts, either written or oral. This CONTRACT may be amended only by written instrument signed by both parties. SECTION VII — COVENANT AGAINST CONTINGENT FEES The CONSULTANT affirms that he has not employed or retained any company or person, other than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT, and that he has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making of the CONTRACT. For breach or violation of this clause, the PEDC may terminate this CONTRACT without liability, and in its discretion, may deduct from the CONTRACT price or consideration, or otherwise recover, the full amount of such fee, commission, percentage brokerage fee, gift, or contingent fee that has been paid. Proposal for Professional Engineering Services Industrial Drive Improvements PROJECT DESCRIPTION AND LIMITS Roadway: Industrial Drive Limits: From State Highway 35 west to N/S Drainage Channel In December 2021, CobbFendley began work on a conceptual layout of Industrial Drive. As shown in Exhibit A — Industrial Drive Improvements, the improvements will replace 2,900 feet of an existing 2-lane open ditch asphalt roadway with a 2-lane undivided concrete curb and gutter roadway. Industrial Drive improvements will also include approximately 2,300 LF of 12" water line, storm sewer, and detention mitigation. Street lighting as well as approximately 1,500 feet of 6' sidewalk along the south side of Industrial Drive from the existing sidewalk at 8720 Industrial Drive to the end of the cul-de-sac will be included with this scope of services. CobbFendley, as part of this proposal, will prepare final engineering construction documents, to be used in bidding the project for construction. Additional right-of-way (ROW) will be necessary to accommodate the detention mitigation required for the increased runoff. The client will be responsible for the acquisition of land parcels needed as part of this project. CobbFendley will prepare the ROW metes and bounds and exhibits. Engineering services include, surveying, right-of-way mapping, roadway design, hydrologic and hydraulic analysis, traffic control plans, storm water pollution prevention plans, geotechnical investigation, environmental investigation, and utility coordination. Exhibit A — Industrial Drive Improvements Exhibit B — Opinion of Probable Construction Cost SUBCONSULTANTS CobbFendley shall subcontract the environmental and geotechnical services. Below is a list of the consultants that we anticipate on using for this project: - Geotechnical Services — Geotest Engineering, Inc. - Environmental Services — Compass Environmental Solutions, LLC Proposals for each service are attached to this document. Ms. Valerie Marvin June 7, 2023 Page 3 of 17 GENERAL REQUIREMENTS CobbFendley shall prepare all work in accordance with the latest version of applicable City of Pearland's (City) procedures, specifications, manuals, guidelines, standard drawings, and standard specifications or previously approved special provisions and special specifications. When design criteria are not identified in City manuals, CobbFendley shall notify the City and refer to State approved manuals, which include: Roadway Design Manual, Hydraulic Design Manual, the Texas Manual on Uniform Traffic Control Devices (TMUTCD), Standard Specifications for Construction and Maintenance of Highways, Streets and Bridges (latest Edition), and other State approved manuals. CobbFendley shall notify the client and secure permission to enter private property to perform any surveying, environmental, engineering or geotechnical activities needed outside of current right-of-way. CobbFendley shall contact each property owner prior to any entry onto the owner's property and shall request concurrence from the client prior to each entry. The Engineer shall coordinate with Pearland EDC throughout the PS&E development and with any local entity having jurisdiction or interest in the project (e.g. City, County, TxDOT, Brazoria Drainage District No. 4, etc.). The Engineer shall invoice according to Descriptions shown in Attachment A. The Engineer shall submit each invoice in a format acceptable to Pearland EDC. ROADWAY DESIGN CobbFendley will prepare the final roadway design based on the conceptual layout, previously approved by the Client. a. Typical Sections - CobbFendley will provide typical sections sheets for the existing and proposed roadway. Typical section information will include: 1. Station Limits 2. Profile Grade Line Location 3. Centerline and Baseline Locations 4. Widths of travel lanes and shoulders 5. Pavement Section 6. Pavement Cross Slopes 7. Curbs 8. Sidewalks 9. Green Space (Mow Strips) 10. Typical Ditch Side Slopes 11. Street Lights b. Roadway Plan and Profiles - CobbFendley will provide roadway plan and profile drawings using CADD standards as required by the City of Pearland. The drawings will consist of a plan and profile view of existing features and proposed improvements. The roadway base map will contain line work that depicts existing surface features and surface utilities obtained from survey, existing visible subsurface utilities, and existing and proposed right-of-way lines. Plan and Profile sheets will be prepared on 22"x34" format sheets. Plan view will include: 1. Roadway centerlines and baselines 2. Pavement curb edges for all improvements 3. Visible existing utilities and proposed utilities and structures Note: Storm Sewer Plan and Profiles and Roadway Plan and Profiles will be included on the same Sheet. c. Cut and Fill Quantities - The Engineer shall develop an earthwork analysis to determine cut and fill quantities and provide design cross sections at 100 feet intervals. d. Pavement Design - CobbFendley shall incorporate the pavement design as recommended by Geotechnical Study and per minimum City standard details. e. Intersection - CobbFendley will coordinate with TxDOT regarding improvements at the intersection of SH 35 and Industrial Drive. II. DRAINAGE 1. Data collection, including "as -built plans", existing schematics, right- of-way maps, flood plain information, existing channel and drainage easement data, special specifications, and standard drawings. 2. Design criteria applicable for all design and analysis shall be in accordance with the most current stormwater design criteria (Atlas 14) of the City of Pearland Engineering Design Criteria Manual and Brazoria Drainage District No. 4. Variances to BDD4 Criteria and Standards are not included in this proposal. Should a variance(s) be necessary to complete the design, additional services will be required. 3. Sheet flow patterns and quantified runoff flow rates for existing and proposed (pre and post project) conditions. 4. Drainage area map delineation for contributing runoff to the existing outfalls and determine hydrologic parameters for existing and proposed conditions. 5. Compute existing and proposed condition hydrographs and determine the required storage volume to mitigate the increase in runoff volume. 6. Determine outfall channel routes/detention size and evaluate potential mitigation sites. Mitigation measures shall be recommended within the Ms. Valerie Marvin June 7, 2023 Page 6 of 17 proposed right-of-way wherever possible or as an adjacent parcel basin or channel. 7. Prepare a report summarizing findings and recommendations 8. Storm sewer plan and profile sheets showing inlets, laterals, trunk line(s), outfall(s) and hydraulic grade lines. Note: (Storm Sewer Plan and Profiles and Roadway Plan and Profiles will be included on the same sheet.) 9. Hydraulic computations for the 5 year and 100 year storm events including proposed water surface elevations 10. Drainage detail sheet(s) III. TRAFFIC CONTROL PLAN CobbFendley will prepare Traffic Control Plan (TCP) sheets in accordance with the Texas Manual on Uniform Traffic Control Devices (TMUTCD) for Streets and Highways (latest edition). Plans sheets will include the following: 1. Written narrative of the construction sequencing and work activities per phase 2. Existing and proposed traffic control devices (regulatory signs, warning signs, guide signs, route markers, construction pavement markings, barricades, flag personnel, temporary traffic signals, etc.) to be used to handle traffic during each construction sequence 3. Typical sections for each phase 4. Proposed traffic control devices at grade intersections during each construction phase (stop signs, flag person, signals, etc.) 5. Temporary roadways, structures and detours required to maintain lane continuity throughout the construction phasing 6. Continuous, safe access to each adjacent property during all phases of construction and to preserve existing access 7. Temporary drainage to replace existing drainage disturbed by construction activities or to drain detour pavement 8. Interim signing for every phase of construction. Interim signing must include regulatory, warning, construction, route, and guide signs 9. Maintain continuous access to abutting properties during all phases of the TCP Ms. Valerie Marvin June 7, 2023 Page 7 of 17 IV. PERMANENT SIGNING AND PAVEMENT MARKING PLAN a. Signing - CobbFendley will prepare drawings identifying and locating the signs within the project limits. Proposed signs will be illustrated and numbered on plan sheets. b. Pavement Markings - CobbFendley will prepare plan sheets showing pavement markings and channelization devices. CobbFendley will select pavement markings from the latest City of Pearland standards. The following information will be provided on the sign and pavement marking layouts: 1. Roadway layout 2. Center line with station numbering 3. Culverts and other structures that present a hazard to traffic 4. Location of utilities 5. Existing signs to remain or to be relocated 6. Proposed signs (illustrated, numbered and size) 7. Proposed markings (illustrated and quantified) which include pavement markings, object markings and delineation 8. Proposed delineators, object markers, and mailboxes 9. The location of roadways, intersections, and pedestrian crossings 10. The number of lanes in each section of proposed roadway 11. Right-of-way limits 12. Direction of traffic flow on all roadways V. STORMWATER POLLUTION PREVENTION PLAN (SW3P) CobbFendley will prepare SW3P sheets and details based on the latest NPDES, and City of Pearland Stormwater Quality Standards to minimize the potential impact to receiving waterways. The SW3P sheets will include: 1. Erosion control measures to be used 2. Locations of erosion control devices 3. Phasing of erosion control measures 4. UTILITY COORDINATION CobbFendley will perform the utility and investigation work involving the research and identification of private and public utilities within the project limits. This will include: 1. Researching the existence of public utilities such as sanitary, storm sewer, and waterlines within the project limits 2. Request any additional information from private (CenterPoint Energy, AT&T and Others within the project corridor) and pipeline utilities, regarding locations of facilities within the proposed project limits 3. Update conflict list to identify potential conflicts between the existing utilities and the proposed project improvements 4. Communicate with utility companies on plans for relocations and provide updated project design information VII. UTILITY LAYOUT CobbFendley will incorporate plan and profiles showing the proposed water line along the project limits on the roadway plan and profile sheets. Sanitary sewer main improvements are not included. Drawings will include the following: 1. Proposed water line alignments as they relate to the project centerline, approx. 2,300 ft of relocated water line 2. Starting and ending locations as well as the connection to the existing water main 3. Proposed water valve, services lines and fire hydrant locations VIII. STREET LIGHTING 1. Prepare a street lighting plan to provide lighting along the proposed roadway alignment based on current lighting standards and requirements 2. Street light poles will be provided by the Client, however electrical conduit and lighting foundation locations will be shown on the plans. 3. The Client will coordinate with CenterPoint for approval of the placement of lighting foundations and conduit. CenterPoint will install the foundations, ground boxes, poles, and light fixtures. PROJECT MANUAL, SPECIFICATIONS AND GENERAL NOTES CobbFendley will prepare a Project Manual including the City of Pearland's standard front-end documents, standard specifications, special specifications, special provisions and the general note items for inclusion in the plans and bidding documents. XII. PROJECT MANAGEMENT This task is to provide the overall management of the contract which includes: 1. Project scheduling 2. Project invoicing 3. Monthly progress reports 4. SURVEY CobbFendley surveyor will provide surveying services necessary to produce topographical maps, locate and tie existing utilities to the project baseline, locate existing right-of-way, and tie to the soil boring locations. Coordinate geometry will be tied to State Plane surface coordinate system. CobbFendley shall assist the Client in obtaining rights of entry (ROE) authorizations for properties where access is required for necessary data collection, in which properties are privately owned. a. Establish Project Control — CobbFendley surveyor will verify benchmark coordinates and establish additional horizontal and vertical control necessary for the project. 1. Establish horizontal and vertical control points within the project limits 2. Surveyor shall use the City of Pearland survey monuments for survey datum 3. Re-establish project control prior to Construction b. Topographic Survey 1. Obtain or collect data to create cross -sections and digital terrain models for the limits provided below: A. Industrial Drive ROW — Industrial Drive from the cul-de-sac on the west end to the intersection of State Highway 35. Cross sections will be provided at 50-ft intervals plus 20' outside of the ROW. B. Intersection of Industrial Drive at State Highway 35 — The entire intersection of Industrial Drive and State Highway 35, including 50-ft from the North and South PC's. Cross sections will be provided at 50-ft intervals plus 20-ft outside of the ROW. C. Proposed Detention Pond — From the drainage channel to Cowart's Creek to the cul-de-sac at Industrial Drive as shown on Exhibit A — Industrial Drive Improvements (Approx. 600 LF). Cross sections will be provided at 50-ft intervals, 102-ft wide, plus 10-ft outside of the boundary for the undeveloped area upon right of entry. 2. Upon obtaining right of entry, provide additional topographic survey of features within the proposed right-of-way. 3. Provide engineer with AutoCAD file with all survey and point file data. Survey Control Sheet — CobbFendley surveyor shall also prepare a Survey Control Sheet(s), signed, sealed and dated by the professional engineer in direct responsible charge of the surveying and the responsible RPLS for insertion into the plan set. The Survey Control Index Sheet shows an overall view of the project control and the relationship or primary monumentation and control used in the preparation of the project. The following information shall be shown on the Survey Control Sheet: 1. Overall view of the project and primary control monuments set for control of the project. 2. Identification of the control points 3. Baseline and/or centerline 4. Graphic (Bar) Scale 5. North Arrow 6. Three point recovery sketches for each Primary Control Point. 7. Station and Offset from baseline or centerline. 8. Provide 11x17 sheet(s) of Survey Control Data, signed, sealed and dated by the professional surveyor. II. RIGHT-OF-WAY MAPPING All survey work will be in accordance with Board Rule 663.15, as promulgated by the Texas Board of Professional Land Surveyors. CobbFendley will locate the existing boundary within the project limits and prepare a layout map for the project. ROW Mapping includes the performance of on the ground surveys and preparation of parcel maps and legal descriptions (metes and bounds descriptions). The purpose of right-of-way mapping is to prepare documents suitable for the acquisition of real property interests and the probable issuance of a title policy. NOTE: CLIENT WILL CONDUCT LAND ACQUISTION OF PARCELS. a. Right -of -Way Map The Engineer's Surveyor shall field locate items such as: property corners, existing right-of-way markers, improvements, and visible utilities. The Engineer's Surveyor shall prepare a right-of-way map for the proposed right-of-way project. Plan sheets must include the following items of information: 1. Proposed right-of-way lines delineated with appropriate bearings, distances, and curve data Ms. Valerie Marvin June 7, 2023 Page 13 of 17 2. Existing right-of-way lines delineated with appropriate bearings, distances, and curve data to the extent necessary to describe the individual parcels of land to be acquired 3. The proposed project baseline alignment delineated with appropriate bearings, distances, and curve data 4. Proposed paving lines combined with relevant existing paving lines must be shown to the extent necessary to compile a complete picture of proposed traffic movements 5. Property lines must be delineated with appropriate bearings, distances, and curve data as needed 6. A north arrow must be shown on each sheet, and, if possible, located in the upper right corner of the sheet 7. Intersecting and adjoining public right-of-ways must be shown and identified by name, right-of-way width, and recording data 8. Easements and fee strips must be shown and identified by width, owner, and recording data 9. Building lines or set -back lines must be shown and identified 10. Visible improvements located within the proposed right-of-way corridor or within 20 feet of a proposed right-of-way line 11. Visible utilities located within the proposed right-of-way corridor or within 20 feet of a proposed right-of-way line The following deliverables will be provided as part of this task: - Final Right -of -Way Map b. Parcel Descriptions CobbFendley will prepare a Parcel Description for each parcel or tract consisting of two parts: (1) a metes and bounds description of the property and (2) a parcel plat. Each part of a Parcel Description must be signed and sealed by a RPLS. Following will be provided to the Client for land acquisition services: 1. Metes and bounds description will be prepared for each parcel of land to be acquired. Proposal is based on the need for 1 Parcel Description) 2. A parcel plat will be prepared for each parcel of land to be acquired. Parcel plats will include each and every item of information shown on the right-of-way map which concerns the individual parcel. GEOTECHNICAL SERVICES The geotechnical investigation will be performed by Geotest Engineering, Inc. in accordance with the attached proposal. IV. ENVIRONMENTAL SERVICES The environmental investigation will be performed by Compass Environmental Solutions, LLC in accordance with the attached proposal. Provide the Client with signed and sealed construction plans and specifications bid documents. 2. Attend Pre -Bid meeting and attend the Bid Opening. 3. Respond in writing to questions from Bidders and prepare Addenda as necessary. 4. Prepare Engineer's Recommendation of Award Letter that includes the following required content: a. Check for math errors and reconcile any mathematical discrepancies b. Review for unbalanced bid items and determine responsiveness and responsibility of low bidders. c. Certify Bid Tabulation including Engineer's estimate d. Review of Bidder's financial standing and references provided e. Explanation of discrepancies between the Engineer's estimate and bids f. Recommendation to award 5. Produce and transmit for execution with the Notice of Intent to Award (NOI). Note: The Client will advertise the bid, disseminate bid sets, prepare the contract for award, route for signature and will issue the representative notices. CONSTRUCTION ADMINSTRATION CobbFendley shall provide Construction Administration services. These services shall include: 1. Attend pre -construction meeting 2. Prepare and submit monthly progress reports for monthly meetings, as required 3. Attend field meetings and make visits to site a. Construction — 12 months b. Senior PM - 2 Visits per month, with one of those being the Progress Meeting c. Project Engineer - 2 Visits per month, with one of those being the Progress Meeting d. Estimated 4 hours per visit 4. The project includes approximately 3,000 LF of Industrial Drive roadway reconstruction of the existing 2-lane asphalt roadway with a 2-lane concrete road with underground storm sewer from east end of Industrial Drive to SH 35 in Pearland, Texas. The project will also include two in -line detention near east end of project alignment with 3(H):1(V) slope. Based on the information provided, the proposed in -line detention will be less than 10 feet deep. Purpose and Scope The purpose of this investigation is to evaluate the soil and water level conditions and to develop geotechnical recommendations for proposed paving and utilities along Industrial Drive. The scope of services is based on the information provided to us on April 14, 2023, and consists of the following: • Coordinating with utility locators to get areas for the proposed borings cleared. • Drilling and sampling: • seven (7) 10-foot soil borings along Industrial Drive for the roadway and utilities reconstruction. • two (2) 15-foot soil borings for the proposed in -line detention. The Proposed Boring/Piezometer Program is shown on Attachment No. 1, and also shown in Figure 1. • Grouting all boreholes except the piezometer borings using non -shrink cement bentonite grout after completion of drilling and water level measurements. • Perform laboratory tests including consolidated undrained (CU) triaxial tests, double hydrometer and crumb tests on representative soil samples per HCFCD criteria to evaluate the engineering properties of the soils. • Perform engineering analyses to develop geotechnical recommendations for the proposed improvements. The minimum geotechnical recommendations will include the following: • Excavation Stability, bedding backfill and ground water control for the proposed storm sewers. Ms. Kimberly Waddell, P.E. Proposal No. 1140616399 Page 2 April 20, 2023 • Pavement recommendations including subgrade stabilization, and construction considerations. • Perform slope analyses and evaluate dispersive characteristics of soil for the proposed detention pond in accordance with HCFCD criteria after completion of PER phase. • Submit a geotechnical report containing a plan showing the locations of the borings and recommendations as outlined above. Schedule and Fee We should be able to start fieldwork within one (1) week after receiving your written authorization. The field work will be completed in about one (1) week, barring bad weather. The laboratory tests will be completed in about four (4) weeks. The complete geotechnical report, which will include field and laboratory data and design recommendations, will be submitted in about ten (10) weeks after receiving the written authorization. Based on the scope of work outlined above, the cost of the field investigation, laboratory testing, engineering analyses, and a final report will be a lump sum cost of $19,813.00. The cost breakdown given in Attachment No. 2 is for additional information only. This cost is based on the assumption that no site clearance will be required. (Cobb-Fendley) with a cost estimate for the following environmental services: ordinary high water mark delineation and no-PCN NWP 33 for erosion protection, Phase I Environmental Site Assessment, and desktop archeological site file. The proposed road improvements are located along the western side of Industrial Drive in Pearland, Brazoria County, Texas. The area of investigation is shown below as a yellow boundary. This proposal outlines each of these environmental services as tasks below. PROJECT SITE EXHIBIT April 20, 2023 Ms. Kimberly Waddell Cobb, Fendley, & Associates, Inc. Industrial Drive Improvements Scope of Work Task 1- Wetland and Ordinary High Water Mark Investigation and Review COMPASS scientists will review available historical topographic maps, National Wetland Inventory maps, soil data maps, color and infra -red aerial photography, and current floodplain maps to estimate the extent of any potential waters of the U.S. which may exist on the subject property. Scientists will then visit the subject property and conduct a "limited" waters of the U.S. delineation focusing on the potential outfall location into drainage channel that existing along the boundary. The purpose of the study is to determine the approximate sizes and locations of any areas that may potentially be classified as waters of the United States, which includes, but is not limited to, wetlands. Task 2 - No Prior Construction Notification (No-PCN) Nationwide Permit 12 COMPASS will prepare a No-PCN Nationwide Permit (NWP) 33 self -certification letter for the temporary coffer dam construction associated with the proposed placement of a storm -water outfall. This self -certifying permit does not require direct coordination with the United States Army Corps of Engineers, but does require the applicant (Pearland Economic Development Corporation) to adhere to all of the applicable guidelines set forth in the Nationwide Permit language and Clean Water Act. Included in this package will be a reduced project plan and map set. Task 3 - Archeological Desktop Site File Review A "desktop" level of investigation will be completed in order to determine the potential for intact, buried resources to be found in the project's construction footprint/archaeological APE. Site file research will be conducted by consulting online research archives maintained by the THC. Research objectives will be to identify all previously recorded cultural resources that may be located within the project APE and within 1.6 kilometers (1 mile) of the proposed project's APE. A review of the Texas Historic Sites Atlas, the National Register of Historic Places (NRHP) database, the list of State Archaeological Landmarks, and the list of Recorded Texas Historic Landmarks, will be reviewed. In addition, soils maps, topographic maps, and aerial photographs will be inspected in order to determine the potential for previously unrecorded archaeological sites to be present within the project footprint. The TX DOT Potential Archeological Liability Map (PALM) will be reviewed as part of the assessment. The results of this assessment will be presented in a coordination letter. This letter report will contain a brief culture history, methods, the results of research, an assessment of the potential for intact, buried cultural resources to be found within the project APE, and recommendations for further work, if necessary. Task 4 — Phase I Environmental Site Assessment Our scope of work includes: (1) a review of readily available historical topographic maps, fire insurance maps, soil maps, and aerial photographs, (2) interviews with the property owner or occupant and agency officials from the local health and fire departments, (3) searches of state and federal records databases, (4) a site inspection, and (5) completion of a report. In addition to the noted scope of work, COMPASS requests that any of the following helpful documents or reports (if they exist and are available to you) be submitted to our office to expedite the environmental assessment: (a) site assessment reports; (b) environmental audit reports; (c) environmental permits for disposal, discharge, etc.; (d) tank registration; (e) material safety data sheets (MSDS); (f) community right to know plans; (g) health and safety plans, spill prevention plans, etc.; (h) hydrogeologic reports; (I) government violations or notices; (j) hazardous waste generator notices or reports; (k) any geotechnical studies, (j) site or plat maps; (k) appraisal information (not including property value), and (I) title reports April 20, 2023 Ms. Kimberly Waddell Cobb, Fendley, & Associates, Inc. The work will be conducted according to the protocols for conducting Phase 1 assessments described in the American Society for Testing and Materials (ASTM) E 1527-21 document. Investigatory work will not include: asbestos, building materials, waste sampling, threatened and endangered species, wetlands, or archaeology. **Reporting and Deliverables Environmental Overview Reporting Following on -site investigations, an environmental overview report (EOR) will be prepared for the project. This report will include documentation required by the USACE, including, but not limited to: project introduction, background research, methodology, results, findings, COMPASS 's professional recommendation on the jurisdictionality of all on -site aquatic features, site maps, a waters of the U.S., including wetlands delineation map, and project site photographs documenting site conditions. No coordination with the USACE is proposed as part of this scope. All findings presented in this letter report would be preliminary and based on COMPASS's professional experience with similar projects under similar circumstances. Only the USACE and EPA can make the final jurisdictional determination. A separate and standalone report will be generated for the Phase I ESA. Mapping and GIS All geographic information data (USACE Routine Data points for waters of the U.S. and uplands, position lines, photo -points, ordinary high water mark points, etc.) from the delineation will be compiled by field crews, downloaded, and corrected via Pathfinder into ArcGIS. Data will be recorded in accordance with the USACE Galveston District's Standard GPS Protocol. COMPASS's GIS analysts will input this data into a master map file for CobbFendley. Section 404 Permitting It is COMPASS's understanding that this project will be able to be processed under a no-PCN Nationwide Permit 13 for bank stabilization (erosion protection for outfalls). This reporting task includes a summarization of data collected during field efforts, COMPASS's professional findings and judgements regarding the project, and applicability of the NWP program. Project plans will be reviewed for accuracy and compliance with the nationwide permit. A short letter report will be prepared outlining the above. Estimated Costs The cost associated with this investigation is noted below. This project will be conducted on a lump sum basis.
