An Ordinance of the City Council of the City of Pearland, Texas, for the
purpose of amending to the Unified Development Code of the City of
Pearland, Texas, Ordinance No. 2000T, Chapter 1, Section 1.1.3.3 (a)(2),
Advisory Capacity of the Planning and Zoning Commission to the City
Council to review, prepare reports upon and make recommendations
concerning approval, conditional approval, or denial of Conditional Use
Permit (CUP) petitions; and Chapter 2, Section 2.2.3.3 (b), Role of the
Planning and Zoning Commission to review and comment on Conditional
Use Permit (CUP) petitions; and containing a savings clause, a severability
clause, and an effective date and other provisions related to the subject.
WHEREAS, on the 5th day of June 2023, a Public Hearing was held before the
Planning and Zoning Commission of the City of Pearland, Texas, notice being given by
publication in the official newspaper of the City, the affidavit of publication being
attached hereto and made a part hereof for all purposes as Exhibit "A", said call and
notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No.
2000T; and
WHEREAS, on the 5th day of June 2023, the Planning and Zoning Commission
of the City submitted its report and recommendation to the City Council, whereby the
Commission recommended approval of the amendments, said recommendation
attached hereto and made a part hereof for all purposes as Exhibit “B”; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That certain provisions of the Unified Development Code are hereby
amended as shown in Exhibit “C” attached hereto and made a part hereof for all
purposes.
Section 2. Savings. All rights and remedies which have accrued in favor of the

City under this Ordinance and amendments thereto shall be and are preserved for the
benefit of the City.
Section 3. Severability. If any section, subsection, sentence, clause, phrase
or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise
unenforceable by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portions thereof.
Section 4. Repealer. All ordinances and parts of ordinances in conflict herewith
are hereby repealed but only to the extent of such conflict.
Section 5. Codification. It is the intent of the City Council of the City of
Pearland, Texas, that the provisions of this Ordinance shall be codified in the City's
official Unified Development Code as provided hereinabove.
Section 6. Publication and Effective Date. The City Secretary shall cause this
Ordinance, or its caption and penalty, to be published in the official newspaper of the
City of Pearland, upon passage of such Ordinance. The Ordinance shall become
effective immediately upon final passage.

Honorable Mayor and City Council Members:
At their regular meetings on June 5, 2023, the Planning and Zoning Commission
considered the following:
A request by the City of Pearland, applicant, for approval of proposed amendments
to the Unified Development Code (UDC), Ordinance No. 2000T, in accordance with
Section 1.1.4.1 of the Unified Development Code, to include:
i) Amendments to Chapter 1, Section 1.1.3.3 (a)(2), Advisory Capacity of
the Planning and Zoning Commission to the City Council to review,
prepare reports upon and make recommendations concerning approval,
conditional approval, or denial of Conditional Use Permit (CUP)
petitions.
ii) Amendments to Chapter 2, Section 2.2.3.3 (b), Processing of Application
and Decision, regarding the role of the Planning and Zoning Commission
to review and comment on Conditional Use Permit (CUP) petitions.
Staff presented two options for the Commission to discuss and ultimately to make a
recommendation to the City Council. The first option would create a formal vote with a
requirement that the City Council also pass a simple majority vote to enact the permit.
The second option simply clarified the language in the UDC and kept the current voting
status. There was no comment from the public. The Commission generally discussed
the effect of a formal vote, how their comments were recorded and presented to the

Council. After discussion, a motion was made to recommend option 1 and the motion
was approved by a vote of 5-0.

Section 2.2.3.3 Processing of Application and Decision
(a) Meeting and Notification. The Director shall schedule a public meeting and hearing
before the Planning and Zoning Commission and the City Council on the application
for a Conditional Use Permit, shall cause personal notice to be given in accordance
with Section 1.2.2.3, and shall cause notice to be posted on the subject property in
accordance with Section 1.2.2.4.

PPD offering citizens academyPearland Police Department is enrolling for its next Citi-zen Police Academy, set to begin Sept. 7. Designed to familiarize locals with the police officers who serve them and how law enforcement works, the program also allows police the opportunity to meet and hear from citizens. The first program in Pearland was held in 1995, and now has more than 1,100 graduates. Surfside at top of state rankingA research website that analyzes air quality data this week released a reporting ranking Surfside Beach as the “vacation hotspot with the cleanest air in Texas.” San Diego-based MyBioSource.com this month released a report on summer vacation destinations with the cleanest air, based on Air Quality Index that factors in pollutants such as s in particulate matter, nitrogen dioxide, sulfur dioxide, carbon monoxide and lead. On the Air Quality Index scale, a 0 represents clean air and a 500 is the highest concentration of pollutants. The Environmental Protection Agency has as-serted an AQI of between 51 and 100 is “acceptable.” Nationwide, vacation destinations in Hawaii and Alaska ranked topped the U.S. list with average AQI ratings under 10. In Texas rankings, South Padre Island at the bottom, scor-ing an average Air quality index of 47. Galveston scored an average 44, and Surfside Beach had the best average rating of 19. The City of Pearland is receiving $466,162 for its Community DevelopmentBlock Grant in Program Year (PY) 2023 (City of Pearland fiscal year 2024) fromthe U.S. Department of Housing and Urban Development. The City will con-duct this public hearing to provide information about the CDBG program.This public hearing will provide citizens and public officials with the 1stpublic hearing about the available funds.The public hearing will take place:

About the CDBG Program
The national objective of the CDBG program is to develop viable urban com-munities by providing decent housing, a suitable living environment andexpanding economic opportunities principally for low and moderate-incomepersons. Not less than 70% of CDBG funds must be used for activities thatbenefit low and moderate-income persons, and CDBG-funded “area-benefit”projects must be located in Pearland Census Block Groups comprised of morethan 45% low-moderate income households. CDBG goals include improvingthe urban environment in low and moderate income areas; eliminating blightinginfluences and the deterioration of property, neighborhoods and public facilitiesin low and moderate-income areas; and ensuring decent, safe, sanitary hous-ing for low and moderate-income residents.
Eligible activities include but are not limited to: public facility construction andimprovements; handicapped accessibility; operational funding for non-profitagencies serving low income persons; rehabilitation of owner-occupied hous-ing; enforcement of City codes; clearance and demolition; and infrastructureimprovement activities. The City has not developed a spending plan at thistime.
Public Comment Period
The CDBG Public Comment Period for the PY 2023 CDBG program is antici-pated to begin on June 26, 2023. Further notice is pending.
Program Amendment
A minor amendment to a prior year Action Plan for Pearland may also be dis-cussed, as it relates to the reallocation of funds to cover the cost of improve-ments to the Melvin Knapp Senior Center.
Fair Housing Issues
The Public Hearing will also be a forum to discuss fair housing and relatedissues. Residents with suggestions and/or concerns will be provided opportu-nity to voice those issues during the public hearing.
