A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING AN AMENDMENT TO THE ENGINEERING
CONTRACT WITH S & B INFRASTRUCTURE, LTD., FOR ENGINEERING
SERVICES ASSOCIATED WITH THE SH 35 WATER AND SANITARY
SEWER PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract amendment by and between the City of Pearland
and S & B Infrastructure, LTD., a copy of which is attached hereto as Exhibit "A" and made
a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a contract amendment with S & B Infrastructure, LTD., for
engineering services associated with the SH 35 Water and Sanitary Sewer Project.

This Amendment (hereinafter "Amendment") is made between the City of
Pearland, Texas (hereinafter "City"), and S&B Infrastructure. (hereinafter "Consultant")
to amend that consultant services contract (the "Contract") between the City and the
Consultant executed on June 9, 2002 for Engineering Services associated with State
Hwy 35 water & sanitary.

2. Contract to Remain in Force. Other than the provisions of the Contract expressly
amended herein, the Contract shall remain in full force and its enforceability shall be
unaffected by this Amendment.

Dear Ms. Jennifer Phan:
S&B Infrastructure, Ltd. (SBI) respectfully requests funding for the design of the referenced utilities. The total amount
requested to complete the design of the water, and wastewater utilities is $366,703.00 that will be accomplished by
recommitting the remaining unspent funds in the existing contract of $188,009.00 and requiring supplemental funding
in the amount of $178,694.00.
The reason for the additional funding is to prepare three project deliverables instead of the one deliverable that was part
of the original contract. The reason for this was that the City felt that the utility work located within the SH 35 corridor
would double the impact on the neighboring businesses and residence along SH35 if it were let as a separate project.
TxDOT would then perform the roadway construction immediately after the utility construction potentially doubling the
impact on the businesses and residence. The City asked S&B to inquire about the possibility of including the utility
work along the SH35 corridor into the TxDOT Plans. S&B asked TxDOT if they would have any objections with this
and TxDOT's reply was favorable. TxDOT has agreed to include the utility work into their plans as long as TxDOT
specifications are used for the waterline and sanitary sewer lines and all improvements occur within TxDOT right-of-
way (ROW). Because of this, the plans will require additional design to improve the constructability of the work to
coincide with the Phased construction of the roadway and a separate design package will be prepared for the work
located outside the TxDOT ROW, with the exception of the abandonment of the Rice Dryer Lift Station that will be
done by the City of Pearland personnel.
The following summary addresses the revisions needed:
Water Line - The original contract shows the proposed water line along the east side of SH35. It is recommended that
we move the waterline to the west side of the roadway for the following reasons. Several of the businesses along the
east side of the roadway are built on the existing ROW line and the border width in this area (distance from the curb to
the ROW line) is only seven feet. Moving the waterline to the west side will minimize the potential for any impacts
associated with the businesses because the businesses along the west side are newer and meet the current City code for
the set back from the ROW line. It is S&B recommendation to construct the water main down the west side of the
roadway so that it can be constructed during one phase of construction. The existing design will be modified to
accommodate the new location by adjusting valves and fire hydrants so they will not conflict with the driveways and
street intersections on the west side of the roadway.
Sanitary Sewer - The original design had the proposed sanitary sewer improvements located along the west side of the
SH35 corridor to co-inside with the waterline placement on the east. S&B remodeled the sanitary sewer system to
improve what was originally designed to eliminate force mains and lift stations along the west side of SH35 and install

gravity lines along the east side of the roadway maximizing the clearance to the proposed waterline. A detailed
description of the work is presented as follows:
Flea Market Lift Station Abandonment:
The original design had proposed to replace the existing Flea market Lift Station on the west side of SH35 with a new
lift station. An 8" gravity line was proposed to flow from Scooters (corner of Knapp and SH35) to the proposed lift
station and then a 6" force main would replace the existing 4" force main from the proposed lift station to the existing
6" force main flowing east along Knapp Road. The proposed system was located on the west side of the roadway.
The sanitary sewer was redesigned to build a new lift station on Knapp (East of SH35), abandon the existing Flea
Market Lift Station and construct a 12" gravity line along the east side of SH 35 from the Flea Market to a proposed
new lift station located on Knapp Road. An 8" Gravity line will be constructed along the east side of SH35 from the
Funeral Home area to Knapp Road connecting to the proposed new 12" gravity line (at the intersection of Knapp and
SH35). The proposed design also includes a 12" line stub out to the west corner of Scooters property. The force main
from the proposed lift station will be replaced and tie to the existing gravity line approximately 600 to 1000 feet east of
SH35 on Knapp Road. This new system will service a larger area.
The new lift station, the force main from the new lift station and the design of the 12" line from the new lift station to
SH 35 will be a part of the COP PS&E package (designed by S&B).
The proposed 12" gravity sewer (from Flea Market to Knapp) and the proposed 8" gravity line (from funeral home
area to Knapp) will be a part of the TxDOT PS&E package (designed by S&B).
6" Force Main from Scott-Mykawa Lift Station:
An existing 6" force main (from Scott-Mykawa Lift Station) located between Knapp Road and Hickory Slough along
the west side will be removed. This force main is in conflict with the proposed waterline. A new 12" forcemain will
be constructed from Hickory Slough to Mc Hard Road to tie into the existing 24" gravity line along Mc Hard Road.
This will divert the flow from Scott-Mykawa Lift Station directly to the gravity sewer system leading to Barry rose
WWTP, thus avoiding the double pumping that existed before.
The 12" force main will be a part of the TxDOT PS&E Package (designed by S&B).
Funeral Home and Storage Facility:
The Funeral Home and the Storage Facility are currently served by Grinder pumps, the 2" force mains from these
pumps tie to the existing 6" force main that flows along SH35 from Hickory Slough to Knapp. Since this entire portion
of the 6" force main will be removed, the 2" force mains from the grinder pumps will be extended along SH35 to tie
into the proposed new 8" gravity sewer (the flows from funeral home area to Knapp Road along the east side of SH35).
The 2" force mains will be a part of the TxDOT PS&E Package (designed by S&B).
Rice Dryer Lift Station:
The existing Rice Dryer Lift Station will be abandoned by constructing an 18"sanitary sewer from the lift station to
SH35 along Rice Dryer and then from Rice Dryer to McHard Road along the east side of SH35. The existing capacity
of the Rice Dryer Lift Station is exceeded, causing the line to surcharge and overflow in the system upstream of the lift
station, the proposed system will eliminate these problems. An existing 8" gravity line along Halik will also tie into the
proposed 18" line.
The proposed 18" line along SH 35 from Rice Dryer to Mc Hard Road will be a part of the TxDOT PS&E Package
(designed by S&B).
The construction of 18" line along Rice Dryer from the Rice Dryer Lift Station to SH35 will be part of the City of
Pearl and PS&E package and the abandonment of the Rice Dryer Lift Station will be handled by the City internally.
Blockbuster Property:
The Blockbuster Property (located north of Orange on SH35) will be serviced through a pump station designed to
accommodate the future wastewater flow from the property, assuming that the property will be a commercial
development. The property is currently undeveloped with the exception of one building which is currently serviced by
a gravity line. This gravity line is in conflict with the bridge design and will be removed.
The proposed pump station will be a part of the COP PS&E package (designed by S&B).
The revised design eliminates surcharging and overflowing problems in several areas and minimizes the operation and
maintenance costs by eliminating lift stations and force mains through the installation of gravity sewers.
We have revised the fee based on our previous meeting with Joe Wertz & Cecil Bowery on September 14, 2005 to
remove the lighting, power distribution and reduce the hours for the work being performed as part of the TxDOT
project. This proposed project will have two review submittals instead of four.
As the project progressed, meetings with Jennifer Pham & Cecil Bowery on June 29, 2006, and Cecil Bowery on July
24, 2006, resulted in S&B scope and fee revisions. In addition, survey work requested by the COP & S&B resulted in
a revised scope and fee for CL Davis.
Attached is the S&B fee proposal for the design of the utilities and CL Davis's detailed survey fee proposal. Close
coordination with TxDOT is underway to provide the City of Pearland with a cost saving alternative of getting a new
State Highway 35 roadway and public utilities.
