CITY COUNCIL REGULAR MEETING MINUTES
APRIL 24, 2023
The City Council of Pearland, Texas convened in a meeting on Monday, April 24, 2023, at
the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland Texas. The
following represents the actions taken by City Council in the order they occurred during
the meeting. All motions are made by Council in consecutive order, as determined by the
Mayor.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:30 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Councilmember Cade gave the Invocation and Councilmember Kamkar led the Pledge
of Allegiance to the United States of America Flag and the Texas Flag.
III. ROLL CALL AND CERTIFICATION OF QUORUM

IV. CITIZEN COMMENTS
Dr. Gene A. Smith, 2508 Green Tee Dr., discussed the claim he filed with the city.
V. PUBLIC HEARING NO. 1
1. Public Hearing: A request by CIVE Inc., represented by Steve Williams,
applicant, on behalf of Maher Ismail, owner, for approval of a Conditional
Use Permit (CUP) to allow a Self-Service Auto Wash, within the Shadow
Creek Planned Development (PD) District, on approximately 1.386 acres of
land, to wit:

Legal Description: Lot 2, Block 1 of the Kingsley Corner at Shadow Creek,
a subdivision of 7.709 acres located in the S.G. Haynie Survey, Abstract
No. 212, in the City of Pearland, Brazoria County, Texas, recorded in
County Clerks’ File No. 2020004517 in the Plat Records of Brazoria County,
Texas.
General Location: 12700 Shadow Creek Parkway, Pearland, TX.
Mayor Cole opened the Public Hearing.
Presentation was provided by Martin Griggs, Assistant Director of Community
Development.
Marher Ismail, owner, was present to answer questions from the Council.
Mayor Cole closed the Public Hearing.
VI. NEW BUSINESS
1. Consideration and Possible Action - Resolution R2023-CUP 23-08 - A
Resolution of the City Council of the City of Pearland, Texas, approving a
Conditional Use Permit (CUP) for Self-Service Auto Wash use within the
Shadow Creek Planned Development (PD) District, on approximately 1.386
acres of land, being described as Lot 2, Block 1 of the Kingsley Corner at
Shadow Creek, a subdivision of 7.709 acres located in the S.G. Haynie
Survey, Abstract No. 212, in the City of Pearland, Brazoria County, Texas,
recorded in County Clerks’ File No. 2020004517 in the Plat Records of
Brazoria County, Texas (located at 12700 Shadow Creek Parkway,
Pearland, TX). Conditional Use Permit Application No CUP23-08, for Self-
Service Auto Wash use within the Shadow Creek Planned Development
(PD) District, at the request of CIVE Inc., represented by Steve Williams,
applicant, on behalf of Maher Ismail, owner, containing a savings clause,
a severability clause, and an effective date and other provisions related to
the subject.
Councilmember Koza made the motion, seconded by Councilmember Barry to
approve Resolution R2023-CUP 23-08 with the following four conditions:
1. The proposed use should be developed in substantial conformance with
the site plan and renderings as presented with the CUP application.
2. A minimum of 30-foot landscape buffer shall be provided along Shadow
Creek Parkway to meet Corridor Overlay District front landscape buffer
requirements.
3. A minimum 25-foot landscape strip containing large shade trees with a
minimum two-inch (2”) caliper shall be provided, at least one inch (1”) for
each ten feet (10’) of lot depth, shall be provided along the southern
property boundary to provide additional noise buffering from vacuuming
and detailing activities.

4. The proposed carwash use shall utilize a centralized vacuum system to
reduce noise.
AYES: Carbone, Koza, Kamkar, Cade, Barry, and Owens.
NAYS: Hernandez.

XV. CONSENT AGENDA
A. Consideration and Possible Action - Approval of minutes for the City
Council Regular Meeting held on April 10, 2023.
B. Consideration and Possible Action - Resolution No. R2023-98 - A
Resolution of the City Council of the City of Pearland, Texas, reappointing
directors to the Board of Directors of the Lower Kirby Pearland
Management District.
C. Consideration and Possible Action - Resolution No. R2023-99 - A
Resolution of the City Council of the City of Pearland, Texas reappointing
directors to the Board of Directors of the Pearland Municipal Management
District No. 2.
D. Pulled for discussion.
E. Consideration and Possible Action - Resolution No. R2023-91 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
unit supply contract for fittings, couplings and valves to Coburn’s Supply,
in the estimated amount of $60,000.00, for the period of April 25, 2023,
through April 24, 2024.
F. Consideration and Possible Action - Resolution No. R2023-92 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
unit supply contract for fittings, couplings and valves to Core and Main
LP, in the estimated amount of $164,000.00, for the period of April 25, 2023,
through April 24, 2024.
G. Consideration and Possible Action - Resolution No. R2023-93 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
unit supply contract for fittings, couplings and valves to Ferguson
Waterworks, Inc., in the estimated amount of $60,000.00, for the period of
April 25, 2023, through April 24, 2024.
H. Consideration and Possible Action - Resolution No. R2023-96 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Buyboard purchasing cooperative for
the replacement of the Southgate Park Playground equipment, in the
estimated amount of $54,609.90, from Lone Star Recreation of Texas, LLC.
I. Consideration and Possible Action - Resolution No. R2023-89 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Department of Information Resources

(DIR), for the purchase of Panasonic Toughbooks, in the estimated amount
of $95,851.44. Councilmember Kamkar made the motion, seconded by Mayor Pro Tem
Carbone to adopt the Consent Agenda items A-I, with the exception of D.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
XVI. NEW BUSINESS CONTINUED
2. Consideration and Possible Action - Resolution No. R2023-90 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Department of Information Resources
(DIR) for the purchase of a Cisco Enterprise Agreement from Sequel Data
Systems, in the estimated amount of $620,564.51 annually, for fiscal year
2023 through fiscal year 2025.
Mayor Pro Tem Carbone made the motion, seconded by Councilmember Cade
to approve Resolution R2023-90.
Trent Epperson, Interim City Manager, and Dan McGhinnis, Chief Information
Officer, were present to answer questions from the Council.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
XVII. MATTERS REMOVED FROM CONSENT AGENDA
D. Consideration and Possible Action - Resolution No. R2023-72 - A Resolution of
the City Council of the City of Pearland, Texas, awarding a unit cost contract to
Lone Star Pavement Services, LLC., for road striping services, in the estimated
amount of $300,000.00, for the period of April 25, 2023, through April 24, 2024.
Councilmember Hernandez pulled this item for discussion.
Councilmember Hernandez made the motion, seconded by Councilmember Cade to
approve Resolution R2023-72.
Rodney and Joann Otto, of Lone Star Pavement Services, LLC., were present to answer
questions.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
