1980-05-27 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING.OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 27, 1980, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEAR - LAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Councilman Al Lentz Councilman Charles R. Mack Councilwoman Fran Coppinger Councilman Carlton McComb Councilman Terry Gray City Manager William E. Wolff City Attorney Bobby J. Williams City Secretary Dorothy L. Cook INVOCATION AND PLEDGE OF ALLEGIANCE: The invocation was given by Jim Bost. The Pledge of Allegiance was led by Harold Sanders. APPROVAL OF THE MINUTES: It was moved by Councilwoman Coppinger, seconded by Councilman McComb that the minutes of the regular meeting held on May 12, 1980, be approved as submitted. Motion passed 3 to 0. Councilman Lentz and Councilman Gray abstained. It was moved by Councilman Mack, seconded by Councilwoman Coppinger that the minutes of a special meeting held on May 15, 1980, be approved as submitted. Motion passed 5 to 0. It was moved by Councilman Lentz, seconded by Councilman Gray that the minutes of a special meeting held on May 20, 1980, be approved as submitted. Motion passed 5 to 0. MAYOR'S ACTIVITY REPORT: Mayor Reid issued the following Proclamation: "SAFE BOATING WEEK" in Pearland, June 1st, 1980 through June 7th, 1980. Proclamation accepted by Harold W. Sanders. Spotlight: Parks, Recreation, and Beautification Board Mr. Leroy Savoie, Chairman of the Board furnished members of the Council with booklets "Summer 1980 - Activity Schedule" prepared by the Board, along with a chart showing assignments to members of the Board, a list of the proposed park improvements, and data showing Pearland Parks Capital Improvement Development from 1977 - 1980. Mr. Savoie explained the purpose and goals of the Board, and introduced the follow- ing members present at the meeting: Bobby Pond, Frank Ravet and Inez Farmer. Mr. Savoie invited members of the Council to attend a meeting of the Board on Saturday, May 31, 1980. Pearland Housing Finance Corporation - Mayor Reid announced that representatives were unable to be present at the meeting and that this item would be on the next regular agenda. Call of Proposed Use Hearing —Adjustments to the Revenue Sharing Budgets: Mayor Reid called this hearing for 6:30 P. M., June 9, 1980. Mayor Reid thanked Garner Cleaners for dry cleaning, without charge, the flags in the Council room. 30 COUNCIL ACTIVITY REPORTS: Councilman McComb reported that the Fire Lane Ordinance Committee was ready for the City Attorney to prepare an ordinance for review by the Committee and City Council at a workshop meeting. Councilman McComb stated that he felt that some recognition should be made to local athletes such as Rick Churchman and Mike Massey, who have been drafted by the pro football teams. Councilman McComb requested that the Mayor pro- claim a "Rick Churchman - Mike Massey Day" in Pearland. Mayor Reid advised that he would do this, and requested Councilman McComb to find out when they would be in Pearland so the Proclamation could be presented. Councilwoman Coppinger advised that a Beautify Texas Meeting will be held in Kerrville, Texas, in June and she and Inez Farmer plan ta3_- Attend.: Councilman Mack reported that the proposed Subdivision Ordinance needed further workshops before it would be ready for Council consideration. Mayor Reid called for a workshop meeting on June 16, 1980, to discuss this proposed ordinance and other items pending. DEPARTMENTAL REPORTS: City Manager Wolff advised that we have received information from the State Department of Highways and Transportation, and they are ready to proceed with traffic lighting signals at Magnolia, John Lizer and Highway 35 South as soon as a decision has been made by the City Council on the improvement of this intersection. Mayor and City Manager to check to see how long State funds will be held for this project and will advise the City Council. Councilwoman Coppinger is negotiating for additional right of way at this location. CITIZENS: None UNFINISHED BUSINESS: ARBITRATION SETTLEMENT ON CONTRACT WITH INTERURBAN PIPELINES, INC.: A letter dated May 2, 1980, from David C. Rieniets, Jr., P. E. was read into the records of the City. This letter was a report from the arbiters wherein they recommended $5,500.00 should be paid to Interurban Pipelines, Inc. over and above the total contracted price. After discussion by the City Council, it was decided that this item would be placed on the next agenda. City Secretary to furnish the City Council with all prior correspondence regarding this claim by Interurban Pipelines, Inc. MEETING RECESSED AT 8:35 P. M. - RECONVENED AT 8:50.P...M.... _..... NEW BUSINESS: ELECTION OF MAYOR PRO TEM: It was moved by Councilman Gray, seconded by Councilman McComb that Council- man Charles R. Mack be elected as Mayor Pro Tem for the next year. Motion passed 5 to 0. COUNCIL RULES FOR EXECUTIVE SESSIONS: A discussion was held regarding the confidentiality of executive sessions and the possible adoption of Council rules regarding such discussions. M Mayor Reid asked that the members of the City Council requesting the item be placed on this agenda, Councilman Mack and Councilman McComb, draft such a pro- posal and submit it to the City Council for consideration at the next regular meeting. RELEASE OF BUILDING PERMITS ON ONE ACRE TRACT LOCATED ON YOST ROAD: Mr. Roger D. Hendricks representing the owner, Thomas Offenberger, was advised r..., that this 1.0 acre track of land was never platted, therefore, he would need to go through the process of platting through the Planning & Zoning Commission. REVISION OF BUILDING CODE REGARDING HOME REPAIR PERMITS: On April 28, 1980, Mr. John M. Pietsch appeared before the City Council protest- ing the portion of the Building Code requiring the homeowner to obtain a build- ing permit for repairs to his home. He requested that the word "repair" be re- moved from Paragraph 105.1 of the Standard Building Code adopted by the City of Pearland. After a discussion by the City Council regarding the protection offered to the homeowner under our present Building Code by requiring inspections on repairs to a home the following motion was made: It was moved by Councilman McComb, seconded by Councilman Lentz that no action be taken on this request. Motion passed 5 to 0. REVIEW OF BIDS RECEIVED - B80-4, STREET IMPROVEMENTS ON OLD ALVIN ROAD FROM ORANGE TO KNAPP AND INCLUDING A PORTION OF KNAPP ROAD AND AWARD OF BID: Bids opened at 12:00 noon on May 23, 1980, as follows: BIDDERS NAME BASE BID AMOUNT WORKING DAYS BID Able Services, Inc. $497,988.50 90 Brown & Root, Inc. $442,799.20 120 Galin Corporation $386,466.90 120 Great Western Contracting, Inc. $483,009.00 120 Harry W. Johnson & Associates $395,227.00 75 Ike Hall, Inc. $459,511.18 90 Hubco, Inc. $399,453.10 100 It was moved by Councilman McComb, seconded by Councilman Gray that the Galin Corporation be awarded Bid No. B80-4, Street Improvements on Old Alvin Road from Orange to Knapp and including a portion of Knapp Road from Glenda to Union Valley for an amount of $386,466.90, working days to be 120, and these funds be taken from the appropriate bond funds, and the Mayor be authorized to execute the contract.
