RESOLUTION NO. R2023-32
A Resolution of the City Council of the City of Pearland, Texas, second
amended a contract for solid waste collection services with Frontier K2, LLC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That a contract for solid waste collection services was previously awarded to
Frontier K2, LLC.
Section 2. The City Manager or his designee is hereby authorized to execute an
amended contract for solid waste collection services.
PASSED, APPROVED and ADOPTED this the 20th day of February, A.D., 2023.

SECOND AMENDMENT OF SOLID WASTE CONTRACT
This First Amendment of Solid Waste Contract (this "Amendment") is made and ent red into on
this the day of , 2023, by and between the City of Peariand ("City") and rontier K2,
LLC, a Texas limited liability company ("Contractor").
RECITALS
WHEREAS, City and Contractor, on October 23, 2020, entered a Solid Waste Contr4et attached
hereto as Exhibit A attached hereto ("Contract"); and
FFEI EAS, City and Contractor, on September 13, 2021, entered the First Amend rent of the
Contract and now desire to enter a Second Amendment of the Contract; and
WHEREAS, the Parties now desire to amend certain terms of the Contract upon th terms and
conditions hereinafter expressed.
NOW THEREFORE, for and in consideration of the mutual covenants and agreem nts herein
contained, and other good and valuable consideration, the receipt and adequacy of which are hereby
expressly acknowledged, City and Contractor hereby amend the amend the Contract as follows
1. Recitals. The Recitals are hereby incorporated herein by reference. Capitalized terms used
herein shall have the meanings given to them in the Contract unless otherw se defined
herein.
2. Definitions. The definition of "Authorized Disposal Site(s)" is hereby atnendei to read as
follows:
"Authorized Disposal Sites)", Shall be the Waste Management Coastal Pla s Landfill,
located at 2100 East Highway 6, Alvin, Texas which operates under Texas Pe it #1721A:
the Lone Star Transfer Station located at 4107 W Sam Houston Pkwy S, Hou ton, Texas
77053; or the Blue Ridge Landfill LP, located at 2200 FM 521, Fresno, Texas 7 545 which
operates under Texas Permit #f 1505A."
3. Balance of Terms. Except as set forth in the First Amendment and t is Second
Amendment, the terms and conditions of the Contract are hereby ratified and a trued and
remain unchanged and in full force and effect
4. Counterparts. This Amendment may be executed in counterparts, each of ich when
taken together shall be deemed an original, but all of which shall be deemed for l purposes
one and the same instrument. Counterpart signatures may be transmitted by fa simile and
such tax signatures will be of full force and effect as if such signatures were of finals.
IN WITNESS WHEREOF, the parties have executed this Amendment as of the day a year set
forth above.
