Pearland, TX 77581 RE: Barry Rose WRF Expansion and Longwood Water Reclamation Facility Decommissioning Projects It WW1502 and WW1906 Change Order #1 for Preconstruction Phase Services for Construction Manager At Risk Mr. Appel, McCarthy was awarded the contract to provide Preconstruction Services for the above referenced projects in September 2020. To date, McCarthy has provided CMAR Preconstruction Services totaling $743,282_DO as approved by the City through various changes to project partners and scope. This is inclusive of services including but not limited to Constructability, Market Analysis, Budget Confirmation Reviews, an Opinion of Probable Cost and Preliminary Estimates based upon the 30% design documents provided by Stantec Inc., the City's original designer through January 2021. Around February of 2021, the City of Pearland and Stantec mutually parted ways in progressing the project design, as the City contemplated alternate solutions and treatment processes for the Barry Rose project. The City engaged Freese and Nichols to perform a Consolidation Study where McCarthy continued to provide preconstruction services from October 2021 through May 2022 and during the selection phase for a new Designer from July 2022 through November 2022. To date, these additional services have been captured against Schedule of Value items from the original Preconstruction Services contract through Progress Invoice #03_ In order to capture the additional value of these changes and prepare for CMAR Preconstruction Services that entail a new 30% estimate from any newly selected Design Engineer, these SOV items represent deliverables that will be recreated upon the selection of said new designer and development of a new 30% design (and subsequent cost estimate). McCarthy to furnish all necessary labor, supervision, materials and equipment to Install Critical Repairs scope as identified in the attached Critical Repairs Matrix. 2. McCarthy is providing construction services and "like for like" replacement of existing components only; no engineering evaluation of components has been performed nor is the performance of any component guaranteed or implied beyond those provided by individual equipment manufacturers. 3. This proposal is based on completing all work in one mobilization and in a continuous manner. 4. Acceptance of this proposal assumes acceptance of the quoted equipment models & manufacturers; procurement of equipment will commence upon notice to proceed for this change order. 5. New Equipment including valves, pumps and instrumentation will be warranted by Manufacturer's standard Warranty for duration shown in same; McCarthy warrants all other material furnished with the Critical Repairs scope will be new and to the best standards commonly used in the industry; the work shall be free of defects in material or workmanship, and shall be safe and suitable for the particular purpose for which it is to be used. This warranty shall remain in effect for twelve (12) months from the date of installation. 6. Prices presented in the attached matrix are cost -reimbursable and McCarthy's best estimate of maximum cost per item following visual inspection of existing conditions. Upon discovery of un- seen conditions that would cause an increase in repair cost McCarthy will notify the City of Pearland in writing and request further direction before proceeding with any additional repairs that would increase the cost above those presented in the pricing matrix. 7. Small size sump pumps for Barry Rose items B-102 and B-901 will be furnished by the City of Pearland and installed by McCarthy Specific Exclusions 8. All costs for permitting are excluded. 9. Sales tax on permanently incorporated materials — a sales tax exempt certificate will be provided. Owner is Tax Exempt. 10. Dust control and the installation, maintenance and/or removal of any SW3P plans or devices is excluded. 11. Cleaning/solids removal from lift stations and treatment structures (Clarifiers, Digesters, etc.) and disposal of accumulated solids. This work will be provided by City of Pearland resources. 12. Supply of pumps/equipment necessary to reduce influent lift station flow levels to allow access for pump repair. 13. Preparation of submittals or approval packages for equipment or any other component of this work; pricing on equipment offered is valid for 30 days of this proposal, the incorporation of a review cycle that results in delayed ordering may incur price escalation.
