1983-04-04 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 4, 1983, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Councilman/Mayor Pro Tem Terry Gray Councilman James E. Bost Councilman Al Lentz Councilman Dennis Frauenberger Councilman Charles R. Mack City Manager Ronald J. Wicker City Attorney Bobby Williams City Secretary Dorothy L. Cook PURPOSE OF THE MEETING: CANVASS OF ELECTION HELD ON APRIL 2, 1983, CITY OFFICERS' ELECTION AND SPECIAL ELECTION: Mayor Reid read into the record the following information: JACK FARMER, ELECTION JUDGE BALLOT REGISTER TOTAL BALLOTS RECEIVED: 2,700 NUMBERED 00301 THROUGH 03000 DEFECTIVE BALLOTS: 0 MUTILATED BALLOTS: 2 VOTED BALLOTS: 751 UNUSED BALLOTS: 1947 DOROTHY COOK, ABSENTEE CLERK/JACK FARMER, SPECIAL CANVASSING BOARD ABSENTEE BALLOT REGISTER TOTAL BALLOTS RECEIVED: 300 NUMBERED 00001 THROUGH 00300 DEFECTIVE BALLOTS: 0 MUTILATED BALLOTS 0 UNUSED BALLOTS: 262 BALLOTS MAILED OUT: 0 BALLOTS RETURNED BY MAIL: 0 BALLOTS MAILED OUT -NOT RETURNED: 0 REJECTED BALLOTS: 0 BALLOTS CAST: 38 Mayor Reid appointed Councilman Frauenberger, as Chairman, and Councilman Bost, as member, to verify unused election supplies. Councilman Gray read Resolution No. R83-9 in its entirety. It was moved by Councilman Gray, seconded by Councilman Mack that Resolution No. R83-9 be passed and approved on first and only reading. Said Resolution No. R83-9 reads as follows: RESOLUTION NO. R83-9 A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE MUNICIPAL ELECTIONS HELD IN THE CITY OF PEARLAND, TEXAS, ON APRIL 2, 1983. WHEREAS, there were submitted to a vote of the duly qualified resident electors of said City of Pearland on April 2, 1983, a Regular City Officers' Election for the purpose of filling the offices of Member of the Council, Position No. 1 and Member of the Council Position No. 5, and a Special Election on one Proposition. 1)? (moi U� WHEREAS, at this Special Meeting of the City Council of the City of Pearland, Texas, on April 4, 1983, after date of said elections being the first meeting of the City Council to be held since said elections at which returns of said elections could be considered and final results declared. NOW THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. That the elections described were duly called and notice thereof given in accordance with law; that said elections were held in the manner required by law; that due returns of said elections have been made by the proper officers; and it appearing from said re- turns, duly and legally made, that there were cast at such elections 789 valid and legal votes; and that said elections resulted in the following vote totals: FOR MEMBER OF THE COUNCIL POSITION NUMBER ONE NAME OF CANDIDATE AL LENTZ MORRIS WILSON (WRITE-IN) TERRY GRAY TOTAL NUMBER OF VOTES RECEIVED 536 1 FOR MEMBER OF THE COUNCIL POSITION NUMBER FIVE 567 PROPOSITION NO. 1 A CHANGE IN THE COMPENSATION OF THE MAYOR FROM $100.00 TO $300.00 PER MONTH, AND THE CITY COUNCIL FROM $75.00 TO $250.00 PER MONTH. FOR 416 AGAINST 358 Section II. That the City Council of the City of Pearland, Texas, hereby officially and affir- matively declares that the results as shown above are the real and true results of the elections held on April 2, 1983, within the City of Pearland, Texas, that the candidate elected for Member of the Council Position Number One is declared to be Al Lentz, and that the candidate elected for Member of the Council Position Number Five is declared to be Terry Gray, and said above parties are hereby declared duly elected to said respective offices, subject to taking of their oaths and filing bond as provided by the laws of the State of Texas. Section III. The City Council of the City of Pearland, affirmatively declares that Proposition No. 1 is approved; and the compensation of the Mayor shall be $300.00 per month, and the compensation of members of the City Council shall be $250.00 per month, effective immediately. Section IV. . It is further found and determined that in accordance with the Order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located in the City Hall, a place convenient to the public, and said notice having been so posted and remaining posted continuously for at least 72 hours preceding the date of this meeting. A copy of the return of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. • PASSED, APPROVED and ADOPTED this the 4th day of April, A. Voting "No": None Motion passed 5 to 0. Councilman Lentz and Councilman Gray were presented the Certificate of Election. Mayor Reid administered the Oath of Office to Councilman Lentz and Councilman Gray. RESOLUTION NO. R83-10, A RESOLUTION URGING THE CONGRESS OF THE UNITED STATES TO APPROVE AN APPROPRIATION FOR FURTHER ENGINEERING ON CLEAR CREEK AND APPROPRIATE MONEY FOR COMMENCEMENT OF WORK ON THE PROJECT: Resolution No. R83-10 read in full by Mayor Reid. It was moved by Councilman Lentz, seconded by Councilman Bost that Resolution No. R83-10 be passed and approved on first and only reading. Said Resolution No. R83-10 reads in caption as follows: RESOLUTION NO. R83-10 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, URGING THE CONGRESS OF THE UNITED STATES TO APPRO- PRIATE FUNDS FOR THE CLEAR CREEK WATERSHED PROJECT. Voting "Aye": Councilman Lentz, Councilman Mack, Councilman Gray, Councilman Bost, and Councilman Frauenberger. Voting "No": None Motion passed 5 to 0. ADJOURN: Meeting adjourned at 7:50 P. M.
