2022-08-15 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES MINUTES OF THE REGULAR MEETING VIA IN-PERSON OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, AUGUST 15, 2022, AT 6:30 P.M., HELD IN THE COUNCIL CHAMBERS, 3519 LIBERTY DR. CALL TO ORDER Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 6:31 P.M. In attendance were: P&Z Vice Chairperson Henry Fuertes P&Z Commissioner Ashlee Boswell P&Z Commissioner Jennifer Henrichs P&Z Commissioner Angela McCathran P&Z Commissioner Derrell Isenberg Also, present were Deputy City Attorney Lawrence Provins, Assistant City Engineer Parviz Pourazizian, Community Development Assistant Director Martin Griggs, Senior Planner Mohamed Bireima, Senior Planner Florence Buaku, Executive Assistant Jennifer Danley and Administrative Assistant Shelby Lowe. Vice Chairperson Fuertes recused himself. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the P&Z Commission. These items will be enacted /approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. CONSIDERATION & POSSIBLE ACTION - EXCUSED ABSENCE Excuse the absence of Commissioner Derrell Isenberg from the August 1, 2022 Meeting. CONSIDERATION AND POSSIBLE ACTION — PLAT 22-61: PRELIMINARY PLAT OF ALEXANDER, SECTION 2 A request of Katy Harris, LJA Engineering, the applicant; on behalf of Danziger Investments Ltd, owner; for approval of the Preliminary Plat of Alexander, Section 2, creating 164 lots, 9 reserves, and 6 blocks on 51.3 acres, located south of Bailey Road and west of Main Street described to wit: Legal Description: A subdivision of 51.3 acres of land out of the H. Commissioner Boswell read into the record the items on the Consent Agenda. Commissioner McCathran made the motion to approve, Commissioner Isenberg seconded the motion. Motion passed 4-0. NEW BUSINESS Vice Chairperson Fuertes read into the record the items on Consideration and Possible Action — PLAT 22-68: Replat of PL2 Building Parking Extension. CONSIDERATION AND POSSIBLE ACTION — PLAT 22-68: REPLAT OF PL2 BUILDING PARKING EXTENSION Public Hearing: A request by Jared Jackson, Context 3 Design LLC, applicant; on behalf of Lonza, Houston LLC, owner; for approval of a replat of PL2 Building Parking Lot, combining Lots 1 and 2, creating 1 Lot on 18.04 acres of land located at the Northeast corner of Fruge Road and Kirby Dr., to wit: Legal Description: A subdivision of 18.0364 Acres of land located in the James Hamilton Survey, A-876 in Harris County, Texas being out of Lots 1 and 2, in Block 1, of PL2 Building Parking Extension Subdivision recorded in Film 689311 of Harris County Map records. General Location: Northeast Corner of Fruge Road and Kirby Drive, Houston TX. Senior Planner Buaku presented the staff report with exhibits. Senior Planner Buaku stated that the replat does conform to the criteria of the UDC. Staff does recommend approval. Applicant, Jared Jackson with Context 3 Design LLC at 9039 Katy Freeway, Suite 333, Houston, Texas 77024, was in attendance in-person in Council Chambers to present to the P&Z Commission. Mr. Jackson stated that replat is for Lonza and their future growth plan. He stated that they are removing the lot line to create more parking space. Vice Chairperson Fuertes called for public input. There were no persons wishing to speak for or against the proposed request. No further discussion from Staff, P&Z Commission or Public input. Vice Chairperson Fuertes read into the record the items on Consideration and Possible Action — VARP 22-07: Variance to Allow the Creation of Two Flag Lots and Irregular Shaped Lots. CONSIDERATION AND POSSIBLE ACTION — VARP 22-07: VARIANCE TO ALLOW THE CREATION OF TWO FLAG LOTS AND IRREGULAR SHAPED LOTS Public Hearing: A request by Amber Whiting of Windrose Land Services, the applicant, on behalf of Pearland Builders II, LLC, owner;for approval of Variance as Permitted in Section 2.6.1.1 (b)(1) of the Unified Development Code, Ordinance No. 2000-T, from the requirements of Section 3.2.14.2 (c) of the UDC to allow approval of the creation of two flag lots and irregular shaped lots described to wit: Legal Description: A Subdivision of 52.906 acres / 2,304,578 square feet situated in the H.T.&B.R.R. Survey, Abstract No. 542 &232 City of Pearland, Brazoria County, Texas. General Location: 1424 Main Street, Pearland, TX. Senior Planner Buaku presented the staff report with exhibits. Senior Planner Buaku stated that the plat variance does conform to the criteria of the UDC. Staff recommends approval. Property Owner, Mark Ring at 1424 North Main Street, Pearland,Texas 77581,was in attendance in-person in Council Chambers to present to the P&Z Commission. Mr. Ring stated that they are looking to open another manufacturing facility and would like to connect the roads. Vice Chairperson Fuertes called for public input. There were no persons wishing to speak for or against the proposed request. Vice Chairperson Fuertes stated that they are in good standing with the city. CONSIDERATION AND POSSIBLE ACTION —ZONE CHANGE APPLICATION: ZONE 22-18 Public Hearing: A request by Sameer Gulamani & Karim Pirani, applicant, on behalf of Fric Inc., owner, for approval of a zone change from General Business (GB) District to Townhome (TH) District on four (4)tracts of land totaling approximately 5.72 acres, to wit: Legal Description: Reserves "A" &"B": Being Reserve "A", Block 1 and Reserve "B", Block 2 of the Westwood Village Subdivision, Section 1, a subdivision in the City of Pearland, Brazoria County, Texas, according to the Final Plat recorded in Volume 17, Page 135-136 in the Official Plat Records of Brazoria County, Texas. Reserves "C" & "D": Being Reserve "C", Block 4 and Reserve "D", Block 3 of the Westwood Village Subdivision, Section 5, a subdivision in the City of Pearland, Brazoria County, Texas, according to the Final Plat recorded in Volume 17, Page 343- 344 in the Official Plat Records of Brazoria County, Texas. General Location: Northeast and Southeast Corners of McLean Road and Springfield Ave. & Northwest& Southwest Corners of Veterans Drive and Springfield Ave. Senior Planner Bireima presented the staff report with exhibits. Senior Planner Bireima stated that the zone change does mostly conform to the criteria of the UDC. Staff recommends approval of the proposed zone district or a less intense zoning district. Applicant, Sameer Gulamani at 1318 Miners Bend Lane, Richmond, Texas 77046, was in attendance in-person in Council Chambers to present to the P&Z Commission. Mr. Gulamani stated that he is looking to rezone 4 tracts of land and that residential zoning would be a better fit in this area than GB. He presented the site plan for the townhomes and provided further details for the project. Mr. Gulamani stated that he would comply with all regulations required by the city. He provided rendering for the townhomes and stated that the garages would be located in the rear of the home. Vice Chairperson Fuertes called for public input. Resident, Thomas Hinds at 4006 East Spring Branch Drive, Pearland, Texas 77584, stated that he is opposed to the proposed zone change. He stated that he is concerned with the space, driveways being directly connected to McLean Road and Veterans Drive and traffic. Mr. Hinds stated that he is concerned that the townhomes will become rental properties and that there will be a high amount of people living in a small space. He stated that he does like the renderings, but it would not match the existing area. Mr. Hinds stated that he is concerned with the townhomes lowering his property values, increase in traffic, safety and not being properly kept up with. Resident, Dr. Jason Perry at 3903 Cedar Wood Drive, Pearland, Texas 77584, stated that he thinks this item should be tabled for a later date. He described the information that he received about this proposed zone change. Dr. Perry stated that residents have complained about drainage and explained the Cabot Cove neighborhood flooding. He stated that he did contact City Council and the Mayor. Dr. Perry stated that he is concerned for the surrounding neighborhoods and the water runoff into these neighborhoods. Resident, Gerald C. Garza at 3912 Elmwood Drive, Pearland, Texas 77584, stated that he is opposed to the proposed zone change. He stated that he is concerned about traffic because McLean Road and Veterans Drive are well traveled, especially with school buses. Mr. Garza stated that he is concerned with the current conditions of both roads. He stated that he liked the project,just not the location. Resident, Dee Eaton at 1912 Lazy Creek Lane, Pearland, Texas 77581, stated that she is in favor of the proposed zone change. She stated that this meeting is not about drainage, and she thinks that residential zoning would be better than the GB zoning district. Ms. Eaton stated that she would like to see different housing options within the city. Resident, Daniel Tunstall at 4207 West Cedar Trail Court, Pearland, Texas 77581, stated that he is opposed to the proposed zone change. He discussed commercial verses residential detention requirements and Veterans Drive being widen in the future. Mr. Tunstall stated that he is opposed to the development due the quality of the development, yard size and that it will be a multi-family development. He stated his opinion that the city should buy the land and use it as a detention area. Resident, Rochelle Parks at 4803 Lakefront Terrace Drive, Pearland, Texas 77584, stated that she is in favor of the proposed zone change. She stated that she is a resident of Cabot Cove and asked the P&Z Commission what uses are allowed by right in the GB zoning district. Resident, Pat Wiley at 3914 Elmwood Drive, Pearland, Texas 77584, stated that she is opposed to the proposed zone change. Ms. Wiley presented a slideshow with images that showed the surrounding neighborhood and the proposed site. She discussed the runoff water that may cause flooding and the current land elevation. Ms. Wiley discussed the additional traffic per town home and asked about additional parking. She stated her concern for traffic and how that may affect the Springfield subdivision. Resident,Jack Manley at 3913 Elmwood Drive, Pearland,Texas 77584, stated that he is opposed to the proposed zone change. He stated that he is concerned about flooding, future road expansions on Veterans Drive and McLean Road, subdivision access, fire hydrant relocation, easement rights and the ability to have adequate parking spaces. Resident, Susan Millard at 4915 Fernwood Drive, Pearland, Texas 77584, stated that she is opposed to the proposed zone change. She described the flooding she experienced during Hurricane Harvey. Ms. Millard stated that she would be opposed to any development on this land and suggested that the land is used as a ditch. Resident, Greg Hawkins at 3910 Ivywood Drive, Pearland, Texas 77584, stated that he is in favor of the proposed zone change. He stated that he would not want GB zoning on that tract of land, he would prefer residential zoning. Mr. Hawkins stated that he does agreed with the flooding concerns. Resident, Charles Hugo at 3915 Ashwood Drive, Pearland,Texas 77584, stated that he is in favor of single-family homes being built on this tract of land. He stated that this area does flood and that businesses should not be developed on this tract of land. Mr. Hugo stated that he would rather see homeowners near the neighborhood compared to renters. Resident, Emily Hugo at 3915 Ashwood Drive, Pearland, Texas 77584, stated that she is in favor of single-family homes being built on this tract of land. She described the flooding in the neighborhood. Ms. Hugo stated that she prefers residential homes with yards compared to GB zoning. Resident, Jennifer Oradiejwa at 3914 Dogwood Drive, Pearland, Texas 77584, stated that she has questions regarding the proposed zone change. She asked about flooding, crowding, potential traffic issues and what business are allowed by right in a GB zoning district. Ms. Oradiejwa asked what options the citizens of Pearland have access to help prevent flooding in this area. Resident, Thomas Seiler at 3902 Fernwood Drive, Pearland, Texas 77584, stated that he is opposed to the proposed zone change. He stated that he serves on the Board of Directors for the Westwood Village Subdivision and spoke about a piece of land that the neighborhood owns that next to the tracts of land. Mr. Seiler stated that is either of the roads are widened that the landowner would have less room on the land for the townhomes. Resident, Nonye Oradiejwa at 3914 Dogwood Drive, Pearland, Texas 77584, stated that she is opposed to the proposed zone change. She stated that she is concerned with flooding, crime, traffic, aesthetics of the proposed townhomes, and the size of the lots. Ms. Oradiejwa stated that this land would be better for office buildings, or the city or county could purchase the land for a community garden, park, a mission for women or just a flood catch area. She asked that nothing be built here, because even a small building would affect the flooding in the area. Resident, Mercedes Martinez at 3910 Greenwood Drive, Pearland, Texas 77584, stated that she is in favor of the proposed zone change. She stated that she is an optimistic resident, but she is concerned with flooding, traffic and her daughter walking home from school. Ms. Martinez stated that she would prefer a residential development over a commercial development. She stated that this zone change could improve the value of the surrounding homes with new sidewalks and landscaping. Ms. Martinez would like to see the City of Pearland work with the developer. She described Pearland as a growing city and that the neighborhood could benefit from this proposed development. Ms. Martinez stated that the townhomes would be owned by homeowners and not rented. Commissioner Henrichs and Senior Planner Bireima discussed what uses are allowed by right in the GB zoning district. Commissioner Henrichs discussed the current drainage requirements and GB zoning compared to TH zoning. She stated that the residents have great ideas for the land, but ultimately it is up to the landowner. Commissioner Henrichs stated that she personally doesn't see how townhomes would work on this tract of land, but she is in favor of rezoning it for residential use. Commissioner Boswell stated that she appreciates all the residents' comments and agrees with Commissioner Henrichs comments. She stated that townhomes bring diversity to Pearland's housing market and does not think that renters decrease the value of property, but that there is a want in townhome housing. Commissioner Boswell stated that townhomes would match the character of the area and that she would be in favor of this proposed zone change. Corn missioner McCathran stated that she agrees with her fellow P&Z Commissioners and would not want to keep these parcels zoned GB. She stated that the proposed zone change met the criteria for approval and the developers could work with the surrounding HOA's. Commissioner McCathran compared the traffic from a residential development compared to a commercial development and stated that she is torn in her decision.Commissioner Isenberg stated that he agrees with his fellow P&Z Commissioners and that the flooding problems will occur either way. He stated that he is not sold on townhomes, but he does like the idea of residential. Commissioner Isenberg discussed drainage, flooding, right of way mitigation and the current zoning regarding the parcels. He stated that he is torn with his decision. Vice Chairperson Fuertes stated that he agrees with his fellow P&Z Commissioners comments. Vice Chairperson Fuertes, Assistant Director Griggs and Assistant City Engineer Pourazizian discussed what the process to develop that land would look like after the proposed zone change is approved, the drainage criteria for this property and traffic impact. Vice Chairperson Fuertes, Assistant Director Griggs and Deputy City Attorney Provins the upcoming comprehensive plan regarding detached townhomes or patio homes for this area. Assistant Director Griggs stated that without a PD that would not be an option now. Deputy City Attorney Provins stated that the R-4 zoning district would allow patio homes. Vice Chairperson Fuertes said that he was also torn with his decision and asked about the notice sign. Senior Planner Biriema stated that staff did confirm that the signs were posted in time by the applicant. No further discussion from Staff, P&Z Commission or Public input. Vice Chairperson Fuertes read into the record the items on Consideration and Possible Action — Zone Change Application: ZONE 22-18. Commissioner Isenberg made the motion to approve, Commissioner McCathran seconded the motion. Motion passed 4-1. The P&Z Commission adjourn for a brief intermission at 8:23 P.M. The P&Z Commission reconvened the P&Z Regular Meeting at 8:31 P.M. Vice Chairperson Fuertes read into the record the items on Consideration and Possible Action — Zone Change Application: ZONE 22-19. CONSIDERATION AND POSSIBLE ACTION —ZONE CHANGE APPLICATION: ZONE 22-19 Public Hearing: A request by Anthony Spriggins, applicant, and owner, for approval of a zone change for approximately 5.3499 acres of land from General Business (GB) District to Single Family Residential-4 (R-4) District, to wit: Legal Description: A 5.3499-acre tract of land out of a 37.948-acre tract out of the southeast one-quarter of Section 13, HT. & B.R.R. Co. Survey, Abstract 240, Brazoria County, being the same land described in a deed recorded in Volume 1261, Page 725 of the Deed Records of Brazoria County, Texas. General Location: East Side of Hatfield Road, South of Fite Road. Senior Planner Bireima presented the staff report with exhibits. Senior Planner Bireima stated that the zone change mostly conforms to the criteria of the UDC, and that the property is not platted. Staff recommends approval or a less intense zoning designation. Applicant, Anthony Spriggins at 3605 Parkside Drive, Pearland, Texas 77584, was in attendance in-person in Council Chambers to present to the P&Z Commission. He stated that this land was originally zoned for residential, and then it was rezoned GB. Mr. Spriggins stated that him and his wife would like to rezone it back to residential and put a couple of homes on the property. Vice Chairperson Fuertes called for public input. There were no persons wishing to speak for or against the proposed request. Commissioner Henrichs stated that this parcel makes sense as residential. Commissioner Boswell stated that this zone change works and she is in support. Commissioner McCathran agreed with her fellow P&Z Commissioners.Vice Chairperson Fuertes stated that the surrounding parcels are zoned R-4.
