MINUTES OF A CITY COUNCIL MEETING OF THE CITY OF PEARLAND, TEXAS,
HELD ON OCTOBER 24, 2022 AT 6:30 PM, IN PEARLAND CITY HALL COUNCIL
CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:33 PM.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Councilmember Cade gave the Invocation and Councilmember Hernandez led the
Pledge of Allegiance to the United States of America Flag and the Texas Flag.

V. PUBLIC HEARING NO. 1
1. Public Hearing: A request by Shiran Perera, applicant, on behalf of
TechPro Estates, LLC, owner, for approval of a zone change for
approximately 15.80 acres of land from the Garden/O’Day-Mixed Use (G/O-
MU) District and Single-Family Residential-1 (R-1) District to Single-Family
Residential-3 (R-3) District, to wit:
Legal Description: A 15.80-acre (687,895 square feet) tract of land, being
known as Lot 22 and the called East 6 acres of Lot 9, of the Allison-Richey
Gulf Coast Homes Company Subdivision of Section 7, H.T. & B. R. R.
Survey, Abstract No. 219, Brazoria County, Texas, according to the
recorded map or plat thereof in Volume 2, Page 23 of the Plat Records,

Presentation was provided by Mohamed Bireima, Senior Planner.
Yoshi Vargas, representing St. Mary's Catholic Church, stated his concerns
about the zone change and wanted clarification from staff.
Shiran Perera, the applicant, was present to answer questions from the staff.

VI. NEW BUSINESS
1. Consideration and Possible Action - First Reading of Ordinance No.
2000M-238 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being a 15.80-acre (687,895 square feet) tract of land, being
known as Lot 22 and the called East 6 acres of Lot 9, of the Allison-Richey
Gulf Coast Homes Company Subdivision of Section 7, H.T. & B. R. R.
Survey, Abstract No. 219, Brazoria County, Texas, according to the
recorded map or plat thereof in Volume 2, Page 23 of the Plat Records,
Brazoria County, Texas (located at the Northwest Quadrant of O’Day Road
and the new McHard Road). Zone Change Application No. ZONE 22-23, a
request by request by Shiran Perera, applicant, on behalf of TechPro
Estates, LLC, owner, for approval of a zone change from Garden/O’Day-
Mixed Use (G/O-MU) District and Single-Family Residential-1 (R-1) District

Councilmember Owens made the motion, seconded by Councilmember Barry,
to approve the first reading of Ordinance No 2000M-238.

Presentation was provided by Mohamed Bireima, Senior Planner.
Chris Mosely's public comment was read into the record, he stated his support
of the proposed project.
Carl Gehring, 2401 Smith Ranch Rd., spoke in favor of the proposed project.
Alan Mueller, the applicant, gave a presentation and was present to answer
questions from the staff.

Councilmember Barry made the motion, seconded by Councilmember Owens,
to approve the first reading of Ordinance No 2000M-239.
Councilmember Kamkar made the motion, seconded by Councilmember
Owens, to amend Table 5 Deviations, specifically the "Detention Amenitization
& Location" topic and "PD Standard" to change from a dry bottom basin to a wet
bottom basin.
AYES: Kamkar.
NAYS: Carbone, Hernandez, Cade, Barry, and Owens.
The motion failed to amend.

First Amended Housing Guidelines in accordance with the requirements
set forth by the Texas General Land Office – Community Development
Block Grant – Disaster Recovery (CDBG-DR) Program.

Resolution of the City Council of the City of Pearland, Texas, amending a
supply contract for fire apparatus preventative maintenance and repair
service with Siddons-Martin Emergency Group in the additional amount of
$106,250.00 (total contract amount of $531,250.00).
J. Consideration and Possible Action - Resolution No. R2022-251- A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a contract with Perdue,

X. NEW BUSINESS CONTINUED
1. Consideration and Possible Action - Second & Final Reading of Ordinance
No. UDC 2000-T-38 - An Ordinance of the City Council of the City of
Pearland, Texas, for the purpose of amending to the Unified Development
Code of the City of Pearland, Texas, Ordinance No. 2000T, Chapter 2,
Section 2.2.5.5 and Section 2.5.3.2 (c) and Chapter 5, Section 5.1.1.1(a) to
update use tables and definitions for Outside/Outdoor Uses (Display,
Storage, and Sales); Section 2.5.3.2 (c) to include Regulations to allow a
permitted by right option for Outdoor Storage in the GB and GC Districts;
Chapter 2, Section 2.4.5.1 (i) (4) to allow alternative subdivision fence
materials along Corridor Overlay District Roads; Chapter 2, Section 2.2.5.5
to remove Furniture/Appliances - Open Storage & Retail Sale and Amend
Land Use Matrix; and Chapter 4, Section 4.2.1.2(a), to update parking

2. Consideration and Possible Action - Resolution No. R2022-233 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Buyboard for the purchase and
installation of Synthetic Turf and Shock Pad Components, in the estimated
amount of $1,308,627.00, from Paragon Sports Constructors, LLC.
(Shadow Creek Ranch Sports Complex Baseball In-Fields Project); and
appropriating $250,000.00 from Fund 340, Park Development Fund for the
project.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Barry
to approve Resolution No. R2022-233.

3. Consideration and Possible Action - R2022-248 - A Resolution of the City
Council of the City of Pearland, awarding a grant-funded contract of
American Rescue Plan Act (ARPA) funds, through an interlocal pricing
agreement with the Texas Buy Board, for the purchase of one (1) fire
pumper/engine and one (1) fire ladder truck from Siddons-Martin
Emergency Group, in the total amount of $2,849,211.
Councilmember Kamkar made the motion, seconded by Councilmember Barry
to approve Resolution No. R2022-248.
Joel Hardy, Grants/Special Projects Administrator was present to answer
questions from the Council.
J. Taylor, Fire Chief was present to answer questions from the Council.

4. Consideration and Possible Action - Resolution No. R2022-241 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a Flood Mitigation Assistance Program contract for home elevation
services to Arkitektura Development, Inc., funded by the Texas Water
Development Board, in an amount not to exceed $955,040.00.
Councilmember Owens made the motion, seconded by Councilmember Cade to
approve Resolution No. R2022-241.
Joel Hardy, Grants/Special Projects Administrator was present to answer
questions from the Council.

5. Consideration and Possible Action - Resolution No. R2022-191 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a Subrecipient Agreement,
in the amount of $550,000.00, with Counseling Connections for Change for
the acquisition of real property located at 2549 Roy Road in Pearland
Texas, Property Identification Number 175675.
Councilmember Barry made the motion, seconded by Councilmember
Hernandez to approve Resolution No. R2022-191.

held on October 10, 2022.

approve the minutes for the City Council and PEDC Joint Workshop and the City

H. Consideration and Possible Action - Resolution No. R2022-245 - A
Resolution of the City Council of the City of Pearland, Texas, amending the
City’s Comprehensive Financial Management Policy Statement to enhance
the City’s long-term goal of maintaining fiscal health and stability.
Councilmember Kamkar requested for this item to be pulled for discussion.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade
to approve Resolution No. R2022-245.
Councilmember Kamkar made the motion, seconded by Councilmember
Hernandez, to amend Exhibit "A", to exclude the following:
Natatorium Air Handling Replacement 4,893,000
Recreation Center Boiler Replacement 608,000
Natatorium Recapitalization Project 2,070,000

Direction given by Mayor Cole to bring back this item and discuss in Executive
Session at the November 7th City Council meeting.
K. Consideration and Possible Action - Resolution No. R2022-252 - A
Resolution of the City Council of the City of Pearland, Texas, declaring
intention to reimburse project expenditures from proceeds of future tax-
exempt obligations.
Councilmember Kamkar requested for this item to be pulled for discussion.
Councilmember Hernandez made the motion, seconded by Mayor Pro-Tem
Carbone to approve Resolution No. R2022-252.
Finance staff was present to answer questions from the Council.
Councilmember Kamkar made the motion to amend the language in Item J to
read “For accuracy in planning and to minimize potential for errors, budget
amendments shall be limited to two per fiscal year, (this includes changes to
sources of uses of cash) one for carryovers and one for midyear, except in the
case of emergency. Motion failed due to a lack of a second.
AYES: Carbone, Hernandez, Cade, Barry, and Owens.
NAYS: Kamkar.

evaluation of Municipal Court Judge.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade,
to adjust the compensation for the Municipal Court Judge as discussed in
Executive Session.
AYES: Carbone, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
