A Resolution of the City Council of the City of Pearland, Texas, modifying the
proposed election measure, for submission to the voters at the May 7, 2022
election, seeking authorization to establish a Municipal Drainage Utility
System pursuant to Texas Local Government Code Chapter 552 ("Code").
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the Code authorizes the City Council to establish a Drainage Utility
System and charge a drainage utility fee for the enhancement, improvement and ongoing renewal
of the City's drainage systems.
Section 2. That the City Council has determined that the voters of Pearland should
determine whether a Drainage Utility System should be established.
Section 3. That an election measure for creation of a Drainage Utility System, as shown
on Exhibit "A" attached hereto, shall be presented to the voters at the May 7, 2022 election.

Proposed Ballot Language
Shall the Pearland City Council amend the City's Code of Ordinances to establish a Municipal
Drainage Utility in accordance with Chapter 552, Municipal Utilities, Subchapter C, Municipal
Drainage Utility Systems, of the Texas Local Government Code ("Chapter 552"), to be used for
the enhancement, improvement, and ongoing renewal of Pearland's drainage systems, funded
monthly from drainage utility charges in the amount of $5 per month for all residential properties
and $1.79 per 1,000 square foot of impervious coverage per month for all non-residential
properties, to recover costs of providing drainage services to properties located in the City, subject
to the following Conditions: a) that 85% of all drainage utility charges shall be designated for
capital drainage projects; b) the drainage utility charge shall not be amended more often than
once every 5 years; c) any increase of the drainage utility charge shall be limited to the combined
increases of the Consumer Price Index (CPI) for the Houston-Galveston-Brazoria metropolitan
area for the previous 5 year period; and d) the requirement that any proposed amendment to
modify the referenced Conditions shall be subject to voter approval.

Thank you for the ongoing partnership between the City of Pearland and the Alvin Independent School
District. We greatly value the working relationship that enables each entity to jointly serve the interests
of our citizens and community.
Please receive this letter as a formal expression of concern and opposition regarding the current
consideration to implement a mandatory Stormwater Utility Fee on partnering governmental entities.
We ask that the City of Pearland formally reconsider providing governmental entities, such as Alvin ISD,
with a statutorily allowable exemption. Many municipalities have exempted their partner governmental
entities from these fees, and Alvin ISD requests the same consideration. Although we have numerous
concerns, we urge you to consider the following three specific areas:
1) Shared Governmental Responsibility
2) Incurrence of Duplicate Tax Payer Liability
3) Limited Voice
Shared Governmental Responsibility
Our respective governmental entities are established to maintain specific governmental function for the
benefit of our citizens and tax payers. The currently proposed drainage fee blurs these lines, and works
to fund municipal drainage services by taking dollars from school district state aid and school taxes that
are intended for areas such as teachers, classrooms, and student programs.
[Note: School district operational budgets are significantly different than those of municipalities. School
district revenue is determined largely by the number of students in attendance and the programs they
participate in. This calculated total dollar amount is then received with some funding coming from local
tax collections (local fund assignment), and the rest coming from state aid (foundation school program
and available school fund). Conceptually, when taxable values (TAV) increase, local tax collections
increase; however, the state reduces their state aid proportionally. A school district's operational
funding is not materially increased based on increased values.]
Not only are we concerned that the imposition of this fee will have an adverse impact on our students,
but it erodes a long standing precedent of shared governmental responsibility between our
organizations. Should this precedent become the de facto basis for our relationship, please consider the
city's desire to pay a fee to Alvin ISD for the Alvin ISD Police Department efforts within the city of
Pearland, or fees related to the construction or operation of school facilities in the City of Pearland.
These services of public interest are why we operate as specific governmental entities.
Incurrence of Duplicate Tax Payer Funded Liability
As a governmental entity, our school facilities are constructed through voter approved bond elections.
Alvin ISD has constructed seven school facilities in recent years, and our tax payers have funded the
financial burden of meeting the ever more stringent and increasing flood mitigation and drainage
requirements as mandated by the City of Pearland and other governmental bodies. Many of these same
standards, and therefore costs, were not incurred by other entities, commercial or otherwise, based on
the era in which they were constructed. Alvin ISD tax payers continue to pay sizable debt service for the
costs of meeting these stringent requirements and will for many years to come. Imposing a drainage
fee, paid in -part by our tax payer's M&O taxes, results in Alvin ISD school district residents paying twice
for drainage and mitigation expenses.
Additionally, our current understanding is that none of the planned and identified projects to be funded
are within the Alvin ISD boundaries. We pose, for your consideration, that a significant reason for this is
due to the sizeable drainage and retention expenses incurred by those with large projects (i.e., Alvin ISD)
under recent guidelines. It also seems reasonable that prior infrastructure investments, that were
developed and funded through Alvin ISD's participation in the Shadow Creek Ranch Tax Increment
Reinvestment Zone, assisted with the development of adequate infrastructure.
Limited Voice
Over the past few weeks, Alvin ISD representatives have shared concerns with City of Pearland Officials,
both elected and staff. It was expressed that voters need the opportunity to consider the
appropriateness of this measure and they will have the opportunity to express their interest on the
ballot in May. This measure will have a sizable and lasting impact on Alvin ISD, our campuses, and our
students. As a partnering governmental entity, our organization is not afforded the opportunity to cast
a ballot in the May election.
Alvin ISD greatly values the transparent opportunity for citizens to participate in local government. We
are concerned that a factual, informational campaign regarding the impact this ballot measure would
have on Alvin ISD has the potential to be perceived negatively by the city. We greatly desire to avoid
jeopardizing the longstanding and collaborative working relationship we so greatly value.
Based on these factors, we strongly urge the Pearland City Council to exempt partnering governmental
entities, such as Alvin ISD, from the proposed Stormwater Utility Fee, which has been done by many
municipalities across Texas.

of-way and relocating or adjusting utilities for the FM 518 Broadway
Expansion Project (SH 288 to Cullen Parkway) and authorizing the City
Manager or his designee to enter into a Reimbursement Agreement
between the City and the Pearland Economic Development Corporation
associated with the FM 518 Broadway Expansion Project.
Mayor postponed this item to the December 13, 2021, City Council Meeting.

pricing arrangement with the BuyBoard Purchasing System for the
purchase of one (1) Chevrolet Tahoe vehicle, in the amount of $59,623.00,
from Caldwell Country.
Councilmember Perez made the motion, seconded by Councilmember Carbone,
to adopt Resolution No. R2021-276.
AYES: Carbone, Kamkar, Hernandez, Perez, Owens.
NAYS: None.
The motion carried. Resolution R2021-276 is adopted.

XVII. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION
Councilmember Carbone and Councilmember Kamkar requested to add an Executive
Session item to the next City Council Regular Meeting to discuss a personnel matter.
