may not be exceeded by more than three percent by the governing body of the CITY OF
PEARLAND without holding a public hearing as required by the code. The rate is as

It was moved by Councilman Lentz, seconded by Councilman Bost that the Certification
of Appraisal Roll, as certified to by J. R. Gayle, Chief Appraiser for the Brazoria
County Appraisal District, and the Notice of Calculation of Effective Tax Rate and
Publication of Estimated Unencumbered Fund Balances, as submitted by Barbara J. Lenamon,
Tax Collector, be received into the records of the City.

ORDINANCE NO. 445, AN APPROPRIATION ORDINANCE ADOPTING A BUDGET FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 1982, AND ENDING SEPTEMBER 30, 1983:

It was moved by Councilman Mack, seconded by Councilman Frauenberger that Ordinance No.
445 be passed and approved on first and only reading under the Emergency Provisions of
Section 3.10 of the Home Rule Charter. Said Ordinance No. 445 reads in caption as
follows:

GOVERNMENT OF THE CITY OF PEARLAND:

It was moved by Councilman Bost, seconded by Councilman Lentz that Ordinance No. 446
be passed and approved on first and only reading under the Emergency Provisions of

PURPOSE; CONTAINING AN EFFECTIVE DATE; AND CONTAINING OTHER
PROVISIONS RELATING TO THE SUBJECT.
Voting "Aye": Councilman Bost, Councilman Frauenberger, Councilman Gray, Councilman
Mack, and Councilman Lentz.

Motion passed 5 to 0.
AUTHORIZATION FOR CITY MANAGER TO CONTACT CONSULTING ENGINEERS AND REQUEST STUDY OF
FLOODWAY ON MARY'S CREEK AS SHOWN BY FEMA:
City Manager Wicker advised the City Council that we do have most of the information
from previous studies made by Bernard Johnson, Coenco, Inc., and the engineers that did
the work for FEMA. We have the expertise in our consulting engineers, R. Wayne Smith,
and Mr. Wicker advised that he felt we would be better to use this firm and on an hourly
basis, let this firm make an evaluation for us. Mayor Pro Tem Gray stated that he felt
that the cost of this evaluation should not exceed $2,000.
City Attorney Bobby Williams stated that R. Wayne Smith's contract would need to be
amended to include this additional work. The only thing that R. Wayne Smith is to do
at this time is to use the data that has been compiled to see if there is enough infor-
mation there for a full blown analysis of the channel.
It was moved by Councilman Bost, seconded by Councilman Lentz that the City Attorney be
authorized to draw up the proper paper work for attachment to the contract of R. Wayne
Smith, Inc., for an amount of approximately $2,000.00 for evaluation of existing data.
