A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING AN AMENDMENT TO THE ADVANCED FUNDING
AGREEMENT WITH THE STATE OF TEXAS FOR IMPROVEMENTS TO
THE DIXIE FARM ROAD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain Advance Funding Agreement Amendment by and
between the City of Pearland and the State of Texas, a copy of which is attached hereto as
Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest an Advance Funding Agreement Amendment with the State
of Texas, for improvements to the Dixie Farm Road.

Please find attached two original counterparts of a funding agreement for the subject project.
Article 1, subparagraph B has a typographical error. The agreement states that the Federal share
for the total cost is eight percent. The agreement has changed to reflect that the Federal Share is
eighty percent of the total estimated cost of the Project. Our Contract Services section has
executed the agreement subject to the City of Pearland's (City) approval of the proposed change.
If you are in agreement with the change made to subparagraph B of Article 1, please indicate
approval of the change by having an appropriate City official initial and date the change. Once
the agreement is initialed, we request that you retain one copy of the agreement in your
permanent files and send us one copy of the agreement for our files.

AMENDMENT ONE TO THE AGREEMENT
(HIGH PRIORITY PROJECTS PROGRAM)
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through
the Texas Department of Transportation hereinafter called the "State", and the City of
Pearland, Texas, hereinafter called the "City".
WITNESSETH
WHEREAS, the State and the City executed a contract on the 15th day of November
2000 to improve Dixie Farm Road from Beamer to SH 35 in two phases; and
WHEREAS, on the 25th day of June 2004 the Metropolitan Planning Organization
passed Amendment No. 94 to the 2004-2006 Transportation Improvement Program to
split the Dixie Farm Road project from the Harris County Line to SH 35 in Pearland into
two projects. In addition, Amendment No. 94 transfers a portion of the funding from the
Mykawa Road project from the Harris County Line to 0.2 Miles south of McHard Road
(0912-31-105), hereinafter identified as the Mykawa Road project, to fund the Dixie
Farm Road projects included in the 2004-2006 Transportation Improvement Program.
WHEREAS, the Dixie Farm Road project will now be constructed in three phases. The
section of the project from the Brazoria/Harris County Line to Beamer Road shall be
hereinafter identified as phase 1 of the Project, the section of the project from East of
Mary's CR bypass to the Harris County Line shall be hereinafter identified as phase 2 of
the Project and the section of the project from SH 35 to 1500 feet south of FM 518 shall
be hereinafter identified as phase 3 of the Project; and

WHEREAS, on the 18th day of March 2005 the Metropolitan Planning Organization
passed Amendment No. 132 to the 2004-2006 Transportation Improvement Program to
correct the CSJs for the Dixie Farm Road Project and redistribute funding from Dixie
Farm Road phase 2 and the Mykawa Road projects between phase 1 and phase 3; and
WHEREAS, on the 22nd day of July 2005 the Metropolitan Planning Organization
passed Amendment NO.8 to the 2006-2008 Transportation Improvement Program to
move phase 1 and phase 2 of the Dixie Farm Road project to Chapter 2 of the 2006-
2008 Transportation Improvement Program and to correct the description of both
projects; and
WHEREAS, on the 26th day of August 2005 the Metropolitan Planning Organization
passed Amendment No. 30 to add Category 10 Earmark Section 117 funds to phase 1
and phase 3 of the Dixie Farm Road Project; and
WHEREAS, on the 24th day of March, 2006 the Metropolitan Planning Organization
passed Amendment No. 91 to modify the limits of phase 1; and
WHEREAS, on the 28th day of April, 2006 the Metropolitan Planning Organization
passed Amendment No. 68 to add additional Metro Mobility funds to the project; and
WHEREAS, it has become necessary to amend that contract;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and
agreements of the parties hereto, the State and the City do agree as follows:
AGREEMENT
Article 1. Description of Amended Items
1. Paragraphs A, and B of Section 5 of the Original Agreement shall be voided in
their entirety and replaced with the following:
A. The total estimated costs associated with the construction of the Project,
including construction engineering and testing services, is $29,984,902.00
B. The State will be responsible to secure the Federal share of funding required
for the construction of the Project. The Federal share for the total cost is

participation costs associated with the Project.
2. Exhibit D of the Agreement is voided and replaced with the document attached
to Amendment Number One to the Agreement and labeled "Exhibit D."
3. The 2004-2006 Transportation Improvement Program Amendment No. 94 IS
attached to Amendment One and Labeled "Exhibit E".
4. The 2004-2006 Transportation Improvement Program Amendment No. 132 IS
attached to Amendment One and Labeled "Exhibit F".
5. The 2006-2008 Transportation Improvement Program Amendment No. 8 is
attached to Amendment One and Labeled "Exhibit G".
6. The 2006-2008 Transportation Improvement Program Amendment No. 30 IS
attached to Amendment One and Labeled "Exhibit H".
7. The 2006-2008 Transportation Improvement Program Amendment No. 91 IS
attached to Amendment One and Labeled "Exhibit I".
8. The 2006-2008 Transportation Improvement Program Amendment No. 68 is
attached to Amendment One and Labeled "Exhibit J".
All other provisions of the original contract are unchanged and remain in full force and
effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this
agreement on behalf of the organization they represent.
IN WITNESS WHEREOF, THE STATE AND THE CITY have executed duplicate
counterparts to effectuate this agreement.

The two projects listed above are funded with Category 7 (Surface Transportation Program)
fuilds. They are currently scheduled to let in Fiscal Year 2004. At this time, the City of
Pearland is requesting to split project CSJ 0912-31-108 into two projects. They have requested

Transportation Improvement Program.

MOBILITY
The projects listed above are currently included in the 2004-2006 Transportation Improvement
Program in Fiscal Year 2004. They were also included in TIP Amendment Numbers 67 and 94.
At this time, the Texas Department of Transportation (TxDOT) is requesting to transfer the
funding from Dixie Farm Rd Phase 2 (FM 518 - SH 35) and the low remaining balances of the
Mykawa Rd projects to those Dixie Farm Rd projects ready for implementation during FY 2005.
Due to conformity issues the Dixie Farm Rd Ph 2 and Mykawa Rd projects can not be removed
from the 2004 TIP; however this amendment will remove Mykawa Rd projects from the 2006-
2008 TIP and the Dixie Fann Rd (PH 2) will remain listed in the 2006 TIP Appendix 1.
In summary, the remaining balance of dollars from Mykawa Rd projects and Dixie Farm Rd PH
2 will be distributed between Dixie Farm Rd (pH 1) and Dixie Farm Rd (PH 3). This amendment
will also correct the CSJ numbers for the Dixie Farm Rd projects and update the let dates for
Dixie Farm Rd (PH 3) and Dixie Farm Rd (pH 1).

The U.S. Congress has passed and the President has signed into law H;R 4818, the FY 2005 Omnibus
Appropriations bill, whichinclud~si 'oqthforrnu1a and discretionaryfundingforhighway,. aviation, and .
transit programs. One of the projects designated to receive these funds was the Kirby Drive project
sponsored by the City of Pearland. At theeity' s request, the Kirby Drive project was replaced with
project CSJs 0912-71-744and 09J2~31:"158, both located on Dixie Farm Road. These projects are to
be funded with Category 102005 Eannark Section 117 funds which had been designated to the Kirby
Drive project.

On April 22, 2005, the Transportation Policy Council (TPC) approved the projects shown
in Appendix I of the 2006-2008 Transportation Improvement Program (TIP) for
advancement into the funded ponion of the TIP subject to available funding. These
projects have been scored and ranked using the methodology detailed in Appendix B of
the 2006-2008 TIP.
On August 10,2005 the U.S. Congress passed and the President signed into law H.R. 3,
the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users
(SAFETEA-LU program) and on October 27, 2005, the Texas Transportation
Commission approved the 2006 Statewide MobiliTY Program (SMP). As a result of these
recent actions, additional funding has become available for programming in the 2006-
2008 TIP.
However, this additional funding is still subject to TxDOT's obligation authority
limitations. Each year, TxDOT uses an obligation authority to place a limit on federal-aid
highway and highway safety construction program obligations and act as a ceiling on the
obligation of funds that can be made within a specified time period, using the federal
fiscal year, October 1 through September 30, regardless of the year in which the funds
were apportioned. This limit is imposed by the Federal Highway Administration in order
to control the highway progral'11 spending in response to economic and budgetary
conditions.
At this time, TxDOT is requesting that the projects shown in Appendix I of the 2006-
2008 TIP be advanced into the funded ponion of the TIP; also, to split out CSJs 0976-02-
084 and 3416-01-011 from CSJ 0912-00-954 and add the split out projects to the TIP.

Please find attached two original counterparts of a funding agreement for the subject project.
Article 1, subparagraph B has a typographical error. The agreement states that the Federal share
for the total cost is eight percent. The agreement has changed to reflect that the Federal Share is
eighty percent of the total estimated cost of the Project. Our Contract Services section has
executed the agreement subject to the City of Pearland's (City) approval of the proposed change.
If you are in agreement with the change made to subparagraph B of Article 1, please indicate
approval of the change by having an appropriate City official initial and date the change. Once
the agreement is initialed, we request that you retain one copy of the agreement in your
permanent files and send us one copy of the agreement for our files.
