1982-08-24 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL (EMERGENCY) MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON AUGUST 24, 1982, AT 8:00 P.M. IN THE CITY HALL, 2335 N. TEXAS AVE., PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman/Mayor Pro Tem Councilman Councilman Councilman Councilman City Manager City Attorney City Secretary PURPOSE OF THE MEETING: Tom Reid Terry Gray Al Lentz Charles R. Mack Dennis Frauenberger James E. Bost Ronald J. Wicker Bobby J. Williams Dorothy L. Cook 1. Reconvene Public Hearing recessed on July 12, 1982 on Houston Lighting & Power Company's request for rate increase. 2. Ordinance No. 447, an Ordinance relating to rates to be charged by Houston Lighting & Power Company. (First and only reading - An emergency pursuant to Section 3.10 of the Charter of the City of Pearland.) City Manager Wicker advised the City Council that the Ordinance before the City Council was the recommendation of the coalition of cities that the Pearland City Council set the proposed rate according to this ordinance form, based on primarily a report supplied by the coalition of cities group. Mayor Reid stated that Mr. Ed Grisham, District Manager of the Houston Lighting & Power Company, was notified of the meeting. Mr. Grisham was advised of the subject of the meeting and he stated that he would be unable to attend. RECONVENE PUBLIC HEARING: Mayor Reid reconvened the Public Hearing recessed on July 12, 1982, on the Houston Lighting & Power Company's request for a rate increase. Mayor Reid asked if any member of the Council or audience had any further comment to be made a part of this Hearing. Hearing none, the Mayor adjourned the Public Hearing at 8:05 P. M. ORDINANCE NO. 447 - AN ORDINANCE RELATING TO THE RATES TO BE CHARGED BY HOSUTON LIGHTING & POWER COMPANY: City Attorney Bobby Williams stated that he had prepared this Ordinance and explained the purpose of passage on an emergency basis. He explained that the figures contained in this Ordinance were a result of an extensive rate study by the coalition of cities. The Ordinance, after passage, was due to be in the hands of the Houston Lighting & Power Company on or before the 26th of August, 1982. Ordinance No. 447 read in full by Councilman Lentz, Councilman Gray, Councilman Frauenberger, and Councilman Bost. (First and only reading under Section 3.10 of the Home Rule Charger - Emergency Basis). It was moved by Councilman Lentz, seconded by Councilman Frauenberger that Ordinance No. 447 be passed and approved on first and only reading. Said Ordinance No. 447 reads in caption as follows: ORDINANCE NO. 447 AN ORDINANCE RELATING TO RATES TO BE CHARGED BY HOUSTON LIGHTING & POWER COMPANY FOR ELECTRIC UTILITY SERVICE WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND, TEXAS; CONTAINING FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING FOR A REPEALER AND FOR SEVERABIL- ITY; AND DECLARING AN EMERGENCY PURSUANT TO SECTION 3.10 OF THE CHARTER OF THE CITY OF PEARLAND,. TEXAS. Voting "Aye": Councilman Lentz, Councilman Mack, Councilman Gray, Councilman Frauen- berger, and Councilman Bost. Voting "No": None Motion passed 5 to 0. City Secretary directed to have certified copy delivered to Mr. Ed Grisham of H.L.&P. and to the Coalition of Cities. ADJOURN: Meeting adjourned at 8:25 P. M.
