Ord. 0142 1967-11-16r� a ` ► P/2 ORDINANCE CALLING BOND ELECTION, PROVIDING DETAILS RELATING TO SAID ELECTION, AND CON- TAINING OTHER PROVISIONS RELATING TO SAID ELECTION THE STATE OF TEXAS COUNTY OF BRAZORIA The City Council of the City of Pearland, Texas, convened in special session, open to the public, at the regular meeting place thereof within said City on the l6th day of November, 1967, with the following members present, to -wit Dan R. Courtright Alderman and the following member(s) absent, to -wit (50�,, 0-A_ c_L0-c_f).- , when, among other business, the following was transacted. The Mayor introduced an ordinance which was read in full. Alderman W made a motion that the ordinance be adopted as read. The motion for adoption of the ordinance was seconded by Alderman VL1 A7f� The motion, carrying with it the adoption of the ordinance prevailed by the following vote AYES Mayor Keller and Aldermen-grs, E33-rr:, Wasek, Watson and Courtright NOES: None. The Mayor thereupon announced that the ordinance had been duly and lawfully adopted. The ordinance thus adopted follows: M ORDINANCE CALLING BOND ELECTION; PROVIDING DETAILS RELATING TO SAID ELECTION, AND CON- TAINING OTHER PROVISIONS RELATING TO SAID ELECTION WHEREAS, the City Council of the City of Pearland, Texas, deems it necessary that an election be called and held within said City for the purpose of voting on the proposition of issuing sani- tary sewer system improvement bonds payable from taxation as herein- after set forth, Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1 That an election shall be held in and through- out the City of Pearland, Texas, on the 12th day of December, 1967, at which election the following proposition shall be submitted to the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation, for their action thereupon, to -wit PROPOSITION SHALL THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY IN THE MAXIMUM AMOUNT OF FOUR HUNDRED THOUSAND DOLLARS ($400,000), MATURING SERIALLY WITHIN FORTY (40) YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A RATE NOT TO EXCEED FIVE AND ONE-HALF PER CENT (5-1/2%) PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING IMPROVEMENTS AND EXTENSIONS TO THE SANITARY SEWER SYSTEM OF SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? Section 2 That said election shall be held in accordance with the provisions of the Constitution and laws of the State of Texas, and only duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation shall be qualified to vote. Section 3 That the entire City is hereby established as one election precinct, and the City Hall of the City of Pearland, Texas, within said City, is hereby designated as the polling place for said election. The following named persons are hereby appointed officers to conduct said election Mrs. Josie Heflin Presiding Judge Mrs. Jack Miller Alternate Presiding Judge Section 4 That it is hereby determined that voting at said election shall be by the use of voting machines, and the ballots of said election shall conform to Chapter 6 of the Election Code of the State of Texas, Chapter 492, Acts of the 52nd Legislature of Texas, 1951, as amended, and, in addition to the requirements of said Chapter, shall have printed thereon the following OFFICIAL BALLOT FOR AGAINST THE ISSUANCE OF BONDS Each voter desiring to vote in favor of the proposition shall pull the voting pointer down indicating "For" the proposition, and each voter desiring to vote against the proposition shall pull the voting pointer down indicating "Against" the proposition. Section 5 That as to absentee voting, however, paper ballots shall be used, and absentee voting shall be conducted by a clerk for absentee voting, namely, Mrs. Dorothy Cook, assisted by Mrs. Dorothy Thompson, assistant clerk, and the place at which the absentee voting shall be conducted is the City Hall, within said City, which MO is also the absentee voting clerk's mailing address to which bal- lot applications and ballots voted by mail may, be sent Said clerk shall keep said office open for at least eight (8) hours, that is, from 8 00 a.m. to 5 00 p.m. on each day for absentee voting which is not a Saturday, a Sunday or an official state holiday. The absentee ballots of said election shall conform to the requirements of Chapter 6 of the Election Code of the State of Texas, as amended, and, in addition, shall have printed thereon the following PROPOSITION I 1 FOR ) THE ISSUANCE OF BONDS Ft AGAINST ) The voter shall vote on the proposition by placing an "X" in the square beside the statement indicating the way he wishes to vote on the proposition. Section 6 That notice of said election shall be given by posting a notice containing a substantial copy of this ordinance at the City Hall and at two (2) other public places within said City r not less than fourteen (14) days prior to the date on which said election is to be held, and by publication of said notice on the same day in each of two (2) consecutive weeks in the Tri County Sun Progress, a newspaper published in, and of general circulation within said City of Pearland, the first of said publications to be not later than fourteen (14) days prior to the date set for said election. Section 7 That this ordinance shall take effect and be in full force upon and after its adoption. iy • PASSED AND APPROVE this 16th day of November, 1967.
