Ord. 0136 1967-07-27 /^ _ _ /34 AN ORDINANCE APPOINTING A BOARD OF EQUALIZATION FOR THE YEAR 1967, PRESCRIBING SAID BOARD'S DUTIES, COMPENSATION AND OATH, FIXING THE TIME FOR THE FIRST MEETING, PROVIDING THAT THE ORDINANCE SHALL TAKE EFFECT FROM AND AFTER ITS ADOPTION; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THE STATE OF TEXAS X c 2"/ COUNTY OF BRAZORIA The City Council of the City of Pearland, Texas, convened in __Regular session at the City Hall within said City on the 27th day of July , 1967, with the following members present, to-wit- Mayor - Lloyd C. Hawkins Councilmen; Aubrey G. Ellis Dale Watson E. A. Wasek B. J. Courtright Gene E. Sanders and the following member (s) absent, to-wit- None when the following business was transacted The Mayor introduced an Ordinance which was read in full. Councilman Wat son made a motion that the ordinance be adopted as read. Councilman Wasek seconded the motion for adoption of the ordinance. The motion, carrying with it the adoption of the ordinance, prevailed by the following vote- AYES: 5 NOES: 0 The Mayor thereupon announced that the motion had duly and lawfully carried, and that the ordinance had been duly and lawfully adopted. The ordinance thus adopted follows- AN ORDINANCE APPOINTING A BOARD OF EQUALIZATION FOR THE YEAR 1967; PRESCRIBING SAID BOARD'S DUTIES, COMPENSATION AND OATH, FIXING THE TIME FOR THE FIRST MEETING, PROVIDING THAT THE ORDINANCE SHALL TAKE EFFECT FROM AND AFTER ITS ADOPTION; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, it is necessary that a Board of Equalization for the City of Pearland, Texas, be appointed to examine, correct, equalize, appraise and approve the Assessor's lists and books of rendered and unrendered property within said City: Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1: That Carlton McComb Toby Lytle and, Geo. V. Hastings with D. E. Shannon as alternate, each being a qualifiedc1 voter, a resident and a property owner of the City of Pearland, Texas are hereby appointed as the Board of Equalization for the City of Pearland, Texas for the year 1967, and are to perform the duties of such Board of Equalization for the City of Pearland, Texas, as prescribed by the Constitution and laws of the State, of Texas, and ordinances of the City of Pearland, Texas, said Board shall receive all the assessment lists or books of the Assessor of the City of Pearland, Texas, for examination, correction, equalization, appraisement and approval, and shall do any and all other things necessary to equalize the value of all property in said City; the members of said Board of Equalization shall receive as compensation the sum of $ 10.00 for each and every day they are actively engaged in such work. Section 2: Before said Board shall enter upon its duties, each member thereof shall subscribe to the following oath of office - I, as a member of the Board of Equalization of the City of Pearland, Texas, for the year 1967, hereby solemnly swear. That in the performance of my duties as a member of such Board for said year, I will not vote to allow any taxable property to stand assessed on the tax rolls of said City of Pearland for said year at any sum which I believe to be less than its true 110 market value, or if it has no market value, that its real value; that I will faithfully endeavor and as a member will move to have each item of taxable property which I believe to be assessed for said year at less than its true market value, or real value, raised on the tax rolls to what I believe to be its true cash market value, if it has a market value, and if not, than to its real value; and that I will faithfully endeavor to have the assessed valuation of all pro- perty subject to taxation with said City of Pearland, stand upon the tax rolls of said City, for said year at its true cash market value, or if it has no mar- ket value, then its real value. I solemnly swear that I have read and understand the provisions contained in the Constitution and laws of this State relative to the valuation of taxable property, and that I will faithfully performuall of the duties required of me under the Constitution and laws of this State. So help me God. Section 3: The City Secretary of the City of Pearland shall act as Secretary of the Board of Equalization, and shall attend each meeting of said Board. Section 4: The Board of Equalization shall hold its first meeting on the 15 day of August 1967. Section 5: All ordinances, resolutions or parts of ordinances or resolutions in conflict herewith are hereby expressly repealed insofar as they conflict herewith. Section 6. M. Members present• Carlton McComb, Chairman - Toby Lytle, Vice Chairman, George Hastings and Secretary W. A. McClellan. Appointed member absent• D. A. Shannon, Alternate member Citizens appearing before the Board as follows . Burney J. Boudraux appeared before the Board concerning the valuation of his new home. Valuation as placed by the appraisers accepted. John DeMuri appeared before the Board concerning the valuation of his new home. Valuation as placed by the appraisers accepted. C. M. Chatham appeared before the Board concerning the valuation of his new home. Valuation as placed by the appraisers accepted. A motion was made by by Toby Lytle, seconded by Carlton McComb that the meeting recess until 7.00 P M. August 25, 1967. All voted "aye. " Motion carried. The appointed members of the Board of Equalization of the City of Pearland for the tax year 1967 met on August 15, 1967 at 7 :30 P. M. in the City Hall in accordance with Ordinance No. 136 of the City of Pearland. Appointed members present being as follows . Carlton McComb, George Hastings, Toby Lytle and Secretary W. A. McClellan. Visitors . P. L. Marquess and Frank Jahnik, Appraisers . W. A. McClellan, Secretary and Notary Public administered the oath of office to the appointed members and acting as temporary chairman called for nominations for a permanent chairman and vice chairman. George Hastings nominated Carlton McComb for chairman. A motion was made by Toby Lytle that the nominations cease and that Carlton McComb be elected by acclamation Motion seconded by George Hastings . All voted "aye. " Motion carried. Carlton McComb nominated Toby Lytle for vice chairman. A motion was made by George Hastings that nominations cease and Lytle be elected by acclamation. Motion seconded by Carlton-"McComb . All voted "aye. " Motion carried. A question and answer period was held concerning proper procedure of the Board. A motion was made by Toby Lytle, seconded by Carlton McComb that the meeting recess until August 17, 1967 at 7.00 P. M. All voted "aye. " Motion carried. Meeting recessed at 8 55 P. M.
