MINUTES OF A CITY COUNCIL MEETING OF THE CITY OF PEARLAND, TEXAS,
HELD ON JULY 25, 2022 AT 6:30 PM, IN PEARLAND CITY HALL COUNCIL
CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:47 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Cole gave the Invocation and Councilmember Hernandez led the Pledge of
Allegiance to the United States of America Flag and the Texas Flag.

V. PUBLIC HEARING NO. 1
I. Public Hearing – A public hearing regarding the City’s 16th Community
Development Block Grant (CDBG) Program – FY 2023 Annual Action Plan,
as part of its FY 2023 - 2027 CDBG 5-Year Consolidated Plan (HUD Program
Years 2022 - 2026).
Mayor Cole opened the public hearing.
Presentation was provided by Joel Hardy, Grants/Special Projects
Administrator.
Kevin Murphy, 1311 Wilke Road, spoke in favor of CDBG funding for the Adult
Education Center.
Mayor Cole closed the public hearing.

VI. NEW BUSINESS
1. Consideration and Possible Action - Resolution No. R2022 - 171 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the acceptance of $14,800,900 in grant funds allocated through the
Houston-Galveston Area Council (HGAC) as part of the Texas General
Land Office (GLO) regional distribution of Community Development Block
Grant - Mitigation (CDBG-MIT) program.
Councilmember Koza made the motion, seconded by Councilmember Barry to
approve Resolution No. R2022-171.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
VII. CONSENT AGENDA
The following were enacted with one motion.
A. Consideration and Possible Action - Excuse the absence of
Councilmember Kamkar from the July 11, 2022, City Council Special
Meeting and the City Council Regular Meeting.
B. Consideration and Possible Action - Approval of minutes for the City
Council Special Meeting and the City Council Regular Meeting on July 11,
2022.
C. Item C was pulled for discussion.
D. Consideration and Possible Action - Second and Final Reading of
Ordinance No. 2000M-226 - An Ordinance of the City Council of the City of
Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the
City of Pearland, Texas, for the purpose of changing the classification of
certain property; being a tract of land containing 4.8787 acres (212,517
square feet), situated in the H.T.&B. Railroad Company Survey, Abstract
No. 506, Brazoria County, Texas, being the south ½ half of Lot 29 of the
Allison-Richey Gulf COAST Home Company Survey of Section 20, as
recorded in Volume 2, Page 23 of the Plat Records of Brazoria County,
Texas (located at 2700 Block of Hillhouse Road, Pearland, Texas). Zone
Change Application No. ZONE 22-08, a request by Anup Pande, applicant,
on behalf of Hillhouse Holdings, owner, for approval of a zone change for
approximately 4.8787 acres of land from Neighborhood Service (NS)
District to Single-family Residential-4 (R-4) District; providing for an
amendment of the zoning district map; containing a savings clause, a
severability clause, and an effective date and other provisions related to
the subject.

F. Consideration and Possible Action - Resolution No. R2022-160 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
an expenditure of the Pearland Economic Development Corporation for
landscaping and maintenance services (commercial corridors and
entryways) with Silversand Services, in the estimated amount of
$231,060.05, for the period beginning September 1, 2022 through August
31, 2023.
G. Consideration and Possible Action - Resolution No. R2022-161 - A
Resolution of the City Council of the City of Pearland, Texas, ratifying
emergency expenditures for dewatered bio-solids disposable services
with Sprint Waste Services LP, in the amount of $90,000.00.
H. Consideration and Possible Action - Resolution No. R2022-164 -
A Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Department of Information Resources
(DIR), for the renewal of hardware and software maintenance services from
Sequel Data Systems, in the estimated amount of $364,589.24.

J. Consideration and Possible Action - Resolution No. R2022-166 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
construction services contract for driveway improvements associated
with the Independence Park Project (Phase 1), to Lucas Construction
Company, Inc., in the amount of $126,000.00.
K. Consideration and Possible Action - Resolution No. R2022-167 -
A Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement through Choice Partners for the purchase of
construction services from Construction Masters of Houston, in the
amount of $198,902.95, for the Centennial Park Restroom/Concession
Renovation Project.
L. Item L was pulled for discussion.
Councilmember Kamkar made the motion, seconded by Mayor Pro-Tem
Carbone to adopt the Consent Agenda, with the exception of C, E, I, and L.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
VIII. NEW BUSINESS CONTINUED
2. Consideration and Possible Action - Resolution No. R2022-155 - A
Resolution of the City Council of the City of Pearland, Texas, adopting a
Five-Year Capital Improvement Program (2023-2027).

Director of Engineering & Public Works.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade
to approve Resolution No. R2022-155.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
3. Consideration and Possible Action - Resolution No. R2022-158 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in a cooperative purchase
agreement using The Interlocal Purchasing System (TIPS) for the purchase
of fourteen (14) fleet vehicles, in the amount of $859,514.49, from Silsbee
Fleet Group.
Councilmember Hernandez made the motion, seconded by Mayor Pro-Tem
Carbone to approve Resolution No. R2022-158.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
4. Consideration and Possible Action - Resolution No. R2022-163 - A
Resolution of the City Council of the City of Pearland, Texas, consenting
to the exclusion of certain land from the boundaries of Pearland Municipal
Management District No. 2
Rush Patel, 12213 Rosemont Lane, spoke in opposition of the resolution.
Councilmember Cade made the motion, seconded by Councilmember Barry to
approve Resolution No. R2022-163.
AYES: None.
NAYS: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
The motion failed.
IX. MATTERS REMOVED FROM CONSENT AGENDA
C. Surface Water Treatment Plant - Update

E.Consideration and Possible Action - Resolution No. R2022-144 - A
Resolution of the City Council of the City of Pearland, Texas, amending a
unit supply contract for landscape maintenance services (combined
medians, right of way and facilities) with Brightview Landscape Services,
in the additional amount of $84,542.80 (total contract amount of
$1,391,946.78), for the period of November 29, 2021 through November 28,
2022.
Councilmember Cade made the motion, seconded by Councilmember Barry to
approve Resolution No. R2022-144.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
I.Consideration and Possible Action - Resolution No. R2022-165 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Texas Department of Information Resources
(DIR), for the purchase of NICE Recording Software from Voice Product,
Inc., in the estimated amount of $71,363.00.
Councilmember Barry made the motion, seconded by Councilmember Owens to
approve Resolution No. R2022-165.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
L.Consideration and Possible Action - Resolution No. R2022-170 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
an expenditure of the Pearland Economic Development Corporation for
landscaping and maintenance services (commercial corridors and
entryways), with Landscape Art, Inc., in the estimated amount of
$218,457.49, for the period beginning September 1, 2022 through August
31, 2023.
Councilmember Owens made the motion, seconded by Councilmember Cade to
approve Resolution No. R2022-163.
AYES: Carbone, Koza, Kamkar, Hernandez, Cade, Barry, and Owens.
NAYS: None.
The motion carried.
