DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR
THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN
REAL PROPERTY LOCATION BEING 4.951 ACRES, A-219 OF THE
HT&BRRCOMPANY SURVEY, TRACT 10A, RECORDED IN VOLUME (88)
570, PAGE 393, OF THE OFFICIAL RECORDS OF BRAZORIA COUNTY,

CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO LIGHT
INDUSTRIAL DISTRICT (M-1) AT THE REQUEST OF, THOMAS K.

UNDERGROUND, INC., OWNERS, PROVIDING FOR AN AMENDMENT
OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE,
A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER
PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, Thomas K. Stoneman and Betty Stoneman, agent for Texas
Underground, Inc., Owners, filed on August 2, 2002, an application for amendment
pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development
Ordinance of the City, for approval of a change in the land use as provided for in said
Section 28, said property being legally described in the original applications for amendment
attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and
WHEREAS, on the 9th day of September, 2002, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of Pearland,
Texas, notice being given by publication in the official newspaper of the City, the affidavit
of publication being attached thereto and made a part hereof for all purposes, as Exhibit
"B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4
of Ordinance No. 509; and
WHEREAS, on the 10th day of September, 2002, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council

regarding the proposed amendment application by, Thomas K. Stoneman and Betty
Stoneman, agent for Texas Underground, Inc., Owners, whereby the Commission
recommended to approved a change of classification for the property described in Exhibit
"A" from its existing classification of Suburban Development District (SD) to Light Industrial
District (M-1); and
WHEREAS, upon receipt of the report from the Planning and Zoning Commission,
the City Council considered this application, and concurred with the recommendation of
the Planning and Zoning Commission, at a regular meeting on September 23, 2002, and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case of
the application of Thomas K. Stoneman and Betty Stoneman, agent for Texas
Underground, Inc., Owners, presented which, in the judgment of the City Council, would
justify the approval of said application, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the City
of Pearland, Texas, and presently classified as Suburban Development District (SD) is
hereby for all purposes changed and reclassified as Light Industrial District (M-1); such
property being more particularly described as:

in Volume (88) 570, Page 393, of the Official Records of Brazoria County,
Texas (1617 Garden Road)
II.
The City Council of the City of Pearland finds and determines that the recitations in
the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The City
Council further finds and determines that there has been compliance with the mandates
of law in the posting and presentation of this matter to the Planning and Zoning
Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the amendment
adopted herein promotes the health, safety, and general welfare of the public and is a
proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is
for any reason held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct, and independent provision and such holding
shall not affect the validity of the remaining portions thereof.

V.
All rights and remedies which have accrued in the favor of the City under this
Ordinance and its amendments thereto shall be and are preserved for the benefit of the
City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to the
official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509, and consistent with the approval herein granted for the reclassification
of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan
recommends Low Density Residential uses for the subject property and all of the
surrounding areas. The Comprehensive Plan further indicates that the appropriate zoning
districts for low density residential uses are Estate Lot Single Family Dwelling District (RE)
and Single Family Dwelling Districts R-1 and R-2.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Garden Road, which is a designated as a major collector street that is to be widened in
the future as needed. No other roadways affect the subject property.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: When the subject property and
surrounding areas were annexed, the City Council granted zone changes in order to
accommodate existing commercial and industrial uses within the area. Consequently, Staff
is recommending approval in order to remain consistent with previous zoning requests.
If the subject property were not already developed with industrial buildings, Staff would
recommend disapproval of the zone change.
PUBLIC COMMENTS: Public notice/comment forms were mailed to 16 property owners
within 200 feet of the subject property under consideration. No public comment forms have
been returned.
STAFF RECOMMENDATION: Staff recommends approval of the zone change.

This case has been tabled in order to allow the applicant an opportunity to submit a PUD. Should
the applicant follow through with a PUD submittal, all rezoning fees should be waived. My
recommendation at this time is to give the applicant additional time to prepare the PUD and,
• therefore, leave the case on the table. Also, the land use recommendations within the Comp. Plan
update my change for this area and, therefore, the City's current rezoning recommendation of
denial.

Currently there are three (3) zoning cases pending within the City Secretary's files. My recommendation
for each case is detailed below. Please ensure the applicable action gets taken at your earliest conveience.

This was a City initiated case associated with the 2001 involuntary annexations. The Council
tabled this case in order to allow the owners an opportunity to present an alternative. To date, the
owners have not submitted anything so I don't know what they are planning. Since the property is
zoned SD and the City will be rezoning all SD properties when the new UDC is adopted, I
recommend we simply draft a letter for the file withdrawing the application. The letter needs to be
copied to Young.

SD to GB or commercial
The applicant and I do not agree with the long range plans for this corridor (Comp. Plan) so we
have not been able to negotiate a solution. This case is currently tabled at the applicants request as
he could not attend the scheduled Council meetings. My recommendation is to send the applicant a
letter stating the case has been scheduled for hearing with a recommendation for denial. Once the
letter has been sent, the case should be scheduled accordingly.
