A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire fee title to certain for property drainage
improvements; being a 4.3899 acre tract of land, being out of that called 15.301-acre tract
of land described in Deed recorded under File No. H174596 Deed Records of Harris County,
Texas, situated in the S.G. Haynie Survey, Abstract No. 362, Harris County, Texas for the
construction and maintenance of public drainage improvements on certain
real property described herein; authorizing the city attorney, or his designee,
and other city officials to take such actions as are necessary to acquire said
property, located within the city, by donation, purchase, or by the exercise of
the power of eminent domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of drainage improvements on certain real
property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public’s best
interest to acquire road right-of-way on certain property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of drainage improvements on certain real property located in
Harris County, Texas.
Section 2. The public convenience and necessity requires the acquisition of fee title by
donation, purchase, condemnation, or otherwise, of certain real property located within the City and
situated in Harris County, more particularly described in Exhibit “A”, attached hereto and
incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibit “A”, either by donation, purchase or the exercise of the power
of eminent domain.

the S.G. Haynie Survey,Abstract No.362,Harris County, Texas; said 4.3899 acres being D
more particularly described by metes and bounds as follows (Bearings based on Deed
recorded under Clerk's File No. H174596 D.R.H.C.T.):
COMMENCING at the intersection of the north line of the said S.G. Haynie Survey and
the east right-of-way line of Almeda School Road (60.00' right-of-way), also being the
northwest corner of said called 15.301-acre tract and the current Minor Plat of Junipstart
as recorded under Film Code No. 627231 M.R.H.C.T.;
Thence, East,with the north line of said S.G. Haynie Survey, a distance of 282.15 feet to a
'/z inch capped iron rod found for the most northerly northwest corner and PLACE OF
BEGINNING of the herein described tract;
Thence, East, continuing with the north line of said S.G. Haynie Survey, a distance of
1005.45 feet to a 'A inch iron rod set for the northeast corner of said S.G. Haynie Survey
and the said called 15.301-acre tract for the northeast corner of the herein described tract;
rThence, South,with the east line of said S.G. Haynie Survey and the called 15.301-acre
tract, a distance of 182.34 feet to a %2 inch iron rod set for the southeast corner of the herein
Ct described tract;
Thence, South 89°59'58" West,with the north line of a called 10.00-acre tract of land out of
the said called 15.301-acre tract and described in Deed recorded under Clerk's File No.
20070168102 D.R.H.C.T., passing at a distance of 20.54 feet a 'A inch iron rod found, and
continuing for a total distance of 1287.60 feet to a % inch capped iron rod found in the east
right-of-way line of aforementioned Almeda School Road for the southwest corner of the
herein described tract;
Thence,North, with the east right-of-way line of said Almeda School Road, a distance of
27.96 feet to a l/2 inch capped iron rod found for the most westerly northwest corner of the
herein described tract, also being the southwest corner of aforementioned Minor Plat of
Jumpstart;
Thence,East,with the south line of said Minor flat of Jumpstart, a distance of 282.15 feet
to a '/ inch capped iron rod found for an interior corner of the herein described tract and
the southeast corner of said Minor Plat of Jumpstart;
Thence,North, with the east line of said Minor Plat of Jumpstart, a distance of 154.39 feet
to the PLACE OF BEGINNING and containing within these calls 4.3899 acres or 191,225
square feet of land.
