RESOLUTION NO. R2022-116
A Resolution of the City Council of the City of Pearland, Texas, approving
Wind, Hail and Wind Driven Rain Insurance through McGriff Insurance
Services, in the amount of $899,010.00, for the period of May 26, 2022 to May
25, 2023.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. Pursuant to Chapter 252 of the Local Government Code the City obtained
Windstorm Insurance pricing to cover City facilities.
Section 2. That, pursuant to Section 252.022 of the Texas Local Government Code, the
purchase of Windstorm Insurance is necessary to protect and preserve the public safety of the City's
residents.
Section 3. That the City Council hereby awards a contract, for Wind, Hail and Wind
Driven Rain Insurance, to McGriff Insurance Services in the amount of $899,010.00.
Section 4. The City Manager or his designee is hereby authorized to execute a contract
for the purchase of Wind, Hail and Wind Driven Rain Insurance.

Service Agreement
Wind & Hail Insurance
THIS SERVICE AGREEMENT (this "Agreement") is between MCGRIFF INSURANCE SERVICES, INC.
("MIS") and THE CITY OF PEARLAND, TEXAS (the "Client").
The Client and MIS agree as follows:
1. Client appoints MIS as the Client's insurance broker of record in order to solicit, negotiate and service
insurance policies for the Client (Insurance Placement) as listed on Exhibit A, which is attached and
made a part of this Agreement. Client also desires for MIS to provide the risk management services
(Risk Management Services) listed on Exhibit B, which is attached to and made a part of this Agreement.
MIS is an approved vendor (#09-08) with the NCPA purchasing cooperative.
2. This Agreement and the respective rights and obligations of the parties hereto shall be construed in
accordance with and governed by the laws of the state of TEXAS. To obtain information on how to file
a complaint regarding fees, Contact the Texas Department of Insurance at 1-800-252-3439.
3. The Client will provide MIS with all information necessary to enable MIS to provide Insurance
Placement and Risk Management Services.
4. MIS agrees to perform the services described in this Agreement in a professional and timely manner.
MIS shall receive a fee of $42,100 fully earned and payable by the Client within 45 days of the coverage
effective date for insurance placement and risk management services.
5. The parties agree and understand the Client is not under any legal or other obligation to purchase any
insurance product through MIS in its capacity as either a producer or consultant, and that the purchase
of any insurance product or risk management services is purely voluntary by the Client.
6. This Agreement commences on May 1, 2022 and ends on May 1, 2023 and will renew annually unless
cancelled by either party. Either party may terminate this Agreement upon 60 days advance written
notice to the other party.
7. MIS reserves the right to engage its related affiliates and subsidiaries in connection with the execution
of Brokerage Services Agreements. Use of these business partners and service providers could result in
the accrual of additional income to MIS -related subsidiaries and affiliates.
8. With respect to Insurance Placements and/or Risk Management Services undertaken on behalf of the
Client that are not contemplated by this Agreement, MIS may be compensated pursuant to a separate
Broker Service Agreement or by the insurance companies and/or intermediaries utilized in such
Insurance Placements. MIS will make information regarding such Agreements and compensation
available to the Client upon request.

EXHIBIT B
MIS will provide the following Risk Management Services for the Client:
A. Keep the Client informed of significant changes and trends in the insurance marketplace;
B. Provide the Client with an annual forecast of market conditions;
C. Attend meetings with the Client to discuss risk strategy and open items;
D. Provide general consulting on construction insurance;
E. Periodically review Client's Loss Prevention programs;
F. Confirmation of evidence of insurance (binders, cover notes) or the status of a placement
will be provided to Client;
G. Issuance of certificates of insurance;
H. Claims Management Services;
I. Provision of claim status reports upon reasonable request;
J. Provision of loss runs upon reasonable request; and
