A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire a fee title interest in certain property for
road right-of-way; being 0.0872 acres (3,800 square feet) parcel of land situated
in the H.T & B.R.R Co. Survey, Abstract 304, Brazoria County, Texas; being out
of and a portion of that certain called 0.3444 acres tract of land as conveyed to
Southwestern Bell Telephone Company by Deed executed September 10, 1982
as recorded in Volume 1692, Page 678 in the Deed Records of Brazoria County,
Texas, in the Official Records of Brazoria County, Texas for the construction and
maintenance of public road improvements on certain real property described
herein; authorizing the city attorney, or his designee, and other city officials to
take such actions as are necessary to acquire said property, located within the
city, by donation, purchase, or by the exercise of the power of eminent
domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of road right-of-way on certain real property
described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public’s best
interest to acquire road right-of-way on certain property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of public road improvements on certain real property located in
Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of fee title by
donation, purchase, condemnation, or otherwise, of certain real property located within the City and
situated in Brazoria County, more particularly described in Exhibit “A”, attached hereto and
incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibit “A”, either by donation, purchase or the exercise of the power
of eminent domain.

Being 0.0872 acres (3,800 square feet) parcel of land situated in the 11,T &B. R.R. Co. Survey,
Abstract 304,Brazoria County,'Texas;being out of and a portion of that certain called 0,3444 acres
tract of land as conveyed to Southwestern Bell Telephone Company by Deed executed September
10, 1982 as recorded in Volume 1692,Page 678 in the Deed Records ❑f 13razoria County, Texas;
said 0.0872 acre parcel of land being more particularly described by metes and hounds as follows;
COMMENCING at a found 5/8-inch iron rod for the Southeast corner of that certain tract of land
conveyed to Richard Lee&Tessy A. Atcheson by Deed executed September 30, 1994 as recorded
in Clerk's File Number 94-037405 in the Official Records of Brazoria County, Texas and being
the Northeast corner of that certain called 5.00 acre tract as conveyed to John H. Gehring by Deed
executed July 22, 1980 as recorded in Volume 1522, Page 879 in the Deed Records of Brazoria
County, Texas;
THENCE, South 86° 36' 15"West with the South line of said Atcheson tract, and the North line
of said Gehring tract, at 711.10 feet passing the Southeast corner of said Southwestern Bell tract,
a total distance of 823.10 feet to a set 5/8-inch iron rod with.TxDOT aluminum cap for corner in
the Proposed East right-of-way line of Smith Ranch Road for the POINT ❑F BEGINNING and
the Southeast corner of the herein described tract; at proposed baseline station 52+33.84, 58.00-
feet right; having coordinates of N= 13,773,542.96 and B=3,.118,025.30;
(1) 'THENCE, South 86° 36' 15" West with the South line of said Southwestern Bell tract,
and the North line of said Gehring tract, at 37.03 feet passing a found 5/8-inch iron rod
with cap stamped "Wilson Survey Group", a total distance of 38,00 feet to a point for
corner in the West line of said Southwestern Bell tract and being in the Existing East right-
of-way line of Smith Ranch Road (right-of-way varies)as recorded in Volume 2,Page 107
in the Public Records of Brazoria County, 'Texas;
(2) THENCE, North 03° 14' 38" West with said West line and Existing East right-of-way
line, 100.00 feet to a point for corner in the North line of said Southwestern Bell tract and
a South line of the said Atcheson tract;
