1981-10-22 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 22, 1981, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVE., PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman/Mayor Pro Tem Councilman Councilman Councilman City Manager City Attorney City Secretary Councilman Carlton McComb absent from meeting. INVOCATION AND PLEDGE OF ALLEGIANCE: Tom Reid Al Lentz Charles Mack Harry Farley Terry Gray Ronald J. Wicker Bobby J. Williams Dorothy L. Cook The invocation was given by Mayor Tom Reid. The Pledge of Allegiance was led by Councilman Charles Mack. APPROVAL OF MINUTES: It was moved by Councilman Lentz, seconded by Councilman Gray that the minutes of the regular meeting held on October 12, 1981, be approved as submitted. Motion passed 4 to 0. MAYOR'S ACTIVITY REPORT: Mayor Reid read a proclamation, proclaiming October 31, 1981 as "Greet and Treat" day f in the City of Pearland. Texas. COUNCIL ACTIVITY REPORTS: Councilman Mack reported that the Zoning Ordinance Committee has been meeting once a month in hopes of having the revisions approved some time in the month of February or March; however, he stated that it appears that it will be June before the Zoning Ordinance will be revised and approved due to all the various hearings that have to be held. He also stated that a new member, Jim DeShazer, has been added to the Committee to assist in the revisions. ORDINANCE NO. 434, AN ORDINANCE PROVIDING FOR CERTAIN COLLECTION EXPENSES IN CONNECTION WITH DELINQUENT TAXES OWED TO THE CITY OF PEARLAND. Ordinance No. 434 read in caption by Mayor Reid. (Second Reading) It was moved by Councilman Mack, seconded by Councilman Lentz that Ordinance No. 434 be passed and approved on second and final reading. ORDINANCE NO. 181-1, AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES RE- LATING TO THE USE OF GARBAGE BAGS FOR RESIDENTIAL GARBAGE. Ordinance No. 181-1 read in caption by Mayor Reid. (Second Reading) It was moved by Councilman Farley, seconded by Councilman Mack that Ordinance No. 181-1 be passed and approved on second and final reading. Said Ordinance No. 181-1 reads in caption as follows: ORDINANCE NO. 181-1 AN ORDINANCE AMENDING CHAPTER 121 OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, TEXAS, BY ADDING AND DELETING SPECIFIC SECTIONS CONTAINED THEREIN; PROVIDING FOR AN EFFEC- TIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. Voting "Aye": Councilman Farley, Councilman Mack, Councilman Lentz, and Councilman Gray. Voting "No": None Motion passed 4 to 0. City Manager Wicker reported that the garbage bags should be in around November 1st. NEW BUSINESS: RESOLUTION NO. R81-34, A RESOLUTION AUTHORIZING MAYOR TO EXECUTE RECIPROCAL AGREEMENT BETWEEN THE CITY OF PEARLAND AND THE CITY OF FRIENDSWOOD FOR WATER AND SEWER SERVICES. Resolution No. R81-34 read in full by Councilman Lentz. It was moved by Councilman Lentz, seconded by Councilman Gray that Resolution No. R81-34 be passed and approved on first and only reading. Said Resolution No. R81-34 reads in caption as follows: RESOLUTION NO. R81-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT AND AGREEMENT BY AND BETWEEN THE CITY OF PEARLAND AND THE CITY OF FRIENDSWOOD. Voting "Aye":; Councilman Gray, Councilman Lentz, Councilman Mack, and Councilman Farley. Voting "No": None Motion passed 4 to 0. ENGINEERING ESTIMATES: City Manager Wicker reported that Invoice on Layne -Texas Company for Liberty Drive Water Well is just a payment for some work completed since the last payment. Galin Corporation, Item #B, is the final estimate on their project with approved Change Order. City Engineer Qualtrough and his staff have measured the quantities within the last few days. City Manager Wicker stated that everything is in order on the Estimate with one exception. It is customary for the City of Pearland to with- hold a loo retainer for 30 days. He requested that the amount due of $81,646.64 be ._... reduced by $45,205.06 and that the payment approved tonight be in the amount of $36,441.58. It was moved by Councilman Lentz, seconded by Councilman Mack that Layne -Texas Company estimate for Water Well on Liberty Drive, in the amount of $1,800.00, and Galin Corporation estimate on the Old Alvin Road extension project, in the amount of $36,441.58, be approved and payment be made out of the appropriate funds. Motion passed 4 to 0. OTHER BUSINESS: Meeting recessed at 7:45 P. M. for EXECUTIVE SESSION, TEXAS OPEN MEETING'S LAW, SECTION II, SUBSECTION (e) LEGAL. Meeting reconvened at 8:45 P. M.
