Councilmember Owens made the motion, seconded by Councilmember Kyle, to
approve Ordinance No. 2000CUP-24 on its first and only reading.
Mayor Reid read into the record the Planning & Zoning Commission's recommendation
to forward to Council for approval of Conditional Use Permit Application No. CUP2000-
24.
City Manager Bill Eisen stated this item is a request to allow an assisted living facility to
be located at the intersection .of John Lizer and Pearland Parkway. Joint Public
Hearings were held regarding this request with Council and the Planning and Zoning
Commission. The Planning and Zoning Commission has made the recommendation to
approve the request with a set of conditions specified.
Renee McGuire, 7918 West Broadway, addressed Council and stated she bought a
piece of property several years ago that was zoned Multi-Family, but was down zoned
to R-4. Because of the zone change, she was required to submit a Planned Unit
Development and was restricted to a one-story building. During the design phase of the
project the Planning and Zoning Commission allowed the adjacent property owner to
have a wooden fence while she was required to have a more expensive masonry fence.
She was also told later she could not build a storage facility because the market had
been over-built. Ms. McGuire stated she is confused by the Planning and Zoning
process and wanted to bring it to the attention of Council.
Bonnie Chrisman, 2801 John Lizer, addressed Council and stated she lives on the
property adjacent to the property in the Ordinance. The property she owns seems to
get rezoned each time the property in this Ordinance obtains a zone change. She is
concerned that the Planning and Zoning Commission is allowing this land to be
arbitrarily rezoned and will continue to do so until the property has some type of
commercial zoning.
Melynda Steed, 1916 Crooked Creek, addressed Council and stated she has spoken in
opposition to this proposed zone change and continues to oppose the project. She
feels the applicants misrepresented the project as an assisted living facility to the
surrounding property owners. A project of this size will have a negative impact on the
storm runoff from Mary's Creek.
Emry Clark, 2615 Foxden Drive, addressed Council and stated he is the Executive
Director of Trinity Oaks of Pearland, which is an assisted living community. He is
concerned about the proposed assisted living facility in this project. The developers of
this project have stated the residents will be approximately seventy years of age. The
proposed building is three-stories and residents of this age group will not be able to
safety evacuate the building in the event of an emergency such as a fire. The proposed
building also does not appear to have adequate plans for fire protection for the building.

Cathy Ruff, 3117 Maryfield Lane, addressed Council and stated she is opposed to this
Conditional Use Permit application. Her family has been in Pearland for sixty years and
she has watched the City grow. She does not feel this proposed facility is in the best
interest of the City.
Bob Burgess, 6520 Broadway, Apt. No. 527, addressed Council and stated in 1999
there was a residential retirement center proposing to use this property and over two-
hundred and fifty citizens came to voice their opinion to Council. The City needs to look
at its history and see what is going on but also work with the land owner. He feels the
City is capable of working with the applicant and developing a plan for a facility that will
not be a burden on the community or a safety risk and therefore he supports this
application.
John W. Gilmore, 3812 Canyon Lake Drive, addressed Council and stated when
Pearland Parkway was built, it was designed with very restrictive zoning requirements
that even restricted a restaurant from having a blue roof. This item is much more
important than the color of paint and the City needs to consider the operational aspects
of this type of facility. The Applicant has stated they are obtaining a permit as an
assisted living facility, but that it will advertise as an independent living facility. The City
needs to investigate this and make sure the applicant is doing what they say they are
going to do before approving any Conditional Use Permits.
Ron Jackson, 4075 Alana Avenue,:addressed Council and stated he is representing the
development company. The applicant is applying for the permit as an assisted living
facility because that is where they fit according to the City's Ordinances. The facility is
not meant to be a medical facility and they have not tried to mislead anyone regarding
their intent. The safety of the residents is a very important aspect of the project and
they are meeting all the required building codes. The Planning and Zoning Commission
made numerous comments and the developer has agreed with all of the
recommendations.
Councilmember Saboe stated Council was presented with some of the public feedback
by email and the Joint Public Hearing process has been completed. In the past, Council
has historically weighed heavily on,public opinion, but he also prefers to get input from
the Planning and Zoning Commission. He feels voting on this item tonight might be
premature and he would like more information before making a decision. The Planning
and Zoning Commission and Staff have eight concerns regarding this project and he
believes this project might need to be submitted as a Planned Development rather than
a Conditional Use Permit. In fairness to the applicant, they should be given time to
substantiate the facility and its uses prior to Council voting.

Councilmember Cole stated the applicant should have fair opportunity to respond to the
concerns set forth and to, define the purpose of the proposed facility. He would like to
see this item reviewed and possibly resubmitted as a Planned Development.
Councilmember Saboe stated he is concerned about the safety of the individuals in a
multi-story building and he will not vote for this item with that provision.
Councilmember Kyle stated the job of Council is not to dictate what is competitive and
she actually likes the concept of this project. There are legitimate issues with the
project such as drainage that do need to be addressed but it appears the developer is
willing to work with the City to remedy the issues.
Discussion ensued between`Council, Assistant City Man ick Finan, and City
Atto e_y Darrin Coker regarding the Ordinance.

competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining
portions thereof.
Section V. All rights and remedies, which have accrued in the favor of the City
under this Ordinance and its amendments thereto, shall be and are preserved for the
benefit of the City.
Section VI. This Ordinance shall become effective after its passage and
approval on first and only reading.
Section VII. Declaration of Emergency. The Council finds and determines that
the need to regulate land use inures to the benefit of the public and, therefore, bears
directly upon the health, safety, and welfare of the citizenry; and that this Ordinance
shall be adopted as an emergency measure, and that the rule requiring this Ordinance
to be read on two (2) separate occasions be hereby waived.

LETTER OF EXPLANATION
INTRODUCTION — PEARLAND RETIREMENT RESIDENCE
Site Description
The subject parcel is an 18.26 acre parcel on the Northerly line of John Lizer
Road just East of Pearland Parkway. It runs to a point near the Northeasterly
side of Mary's Creek and small portion of the northwesterly corner runs along the
East line of Pearland Parkway. The site is vacant with an abundant amount of -
trees and other vegetation.
Proposed Development
Harvest Development Corp. is requesting a Conditional Use Permit on this site to
allow the development of a 118-suite, 3 story retirement residence along with 13,
one story, duplex retirement cottages (26 units). The entire development is
designed to conform to the Uniform Development Code of an "Assisted Living
Facility (Ch 5, Art 1, Div 1 Ph #29)."A congregate residence facility for four(4) or
more elderly(over 55 years of age)persons, regardless of legal relationship.
Who need limited assistance with daily living activities. A limited number of
support services such as meals, laundry, housekeeping, transportation,
social/recreational activities, hairdressing, etc. my be provided or associated with
the assisted living facility. Units may be attached or detached, single or double
occupancy, and may include limited or full kitchen facilities. Full time medical or
nursing care is not typically provided by the facility, but may be privately arranged
for by the individual residence on a part time or temporary basis (e.g. visiting
nurses, etc.). However this development shall be marketed and operated as.
an Independent Living Facility for residents age 55 and older.
Our concept is designed for residents, age 55 and older who are still
ambulatory, but in need of some support, but not including medical or nursing
care. If medical staff is hired at a later time, this CUP would need to be.
modified. Private rooms afford the advantages of independent living while the
services included provide support, security and friendship. The private suites
include studio, one and two bedroom versions. Each is similar to a conventional
dwelling unit except a kitchen is not included in the suites. Services include three
prepared meals daily, housekeeping, laundering, private bus transportation and
various activities. Staff is "in house" 24 hours a day. The monthly rent payment.
covers the private room, all services and utilities. Typically our resident will be a
single person in their late 70's or 80's. Approximately 10% of the rooms will be
rented by couples making a total building_population. of 150. Fewer than 15% of

the residents will be driving their own cars. Because most of our residents do not
drive, we provide private van transportation for their use. The van is available to
take the residents to places they need to visit, such as banks, medical offices,
shopping areas, etc. Neighborhood compatibility is achieved in the site planning
and building design. The wing ends and building center step down from three to
two and one story. This arrangement provides for privacy and a gentle change of
scale. Care is taken to' minimize the impact to the existing community. The
exterior siding materials will include brick and horizontal siding. The roof will be .
architectural composition shingle. The building interior design has common
areas for a variety of uses. There will be a common dining room and kitchen for
shared meals. There will be a multi-purpose room, beauty shop, crafts room, TV.
room, lounges and an exercise room. The circulation will be organized around a
central atrium. Residents will be able to contact the manager with both
emergency pull cords and voice communications in each room.
Access shall be provided from both John Lizer Road and Pearland
Parkway. The development will be in compliance with the attached
conceptual site plan, elevations and other documents. Minor changes shall
be approved by Planning Director. All requirements of the UDC shall be
met.
II ZONING AND LAND USE
The property is currently zoned NS — Neighborhood Service. The property is
bounded by Pearland Parkway at its Northwest tip and a 4.33 acre parcel zoned
GB and a small parcel zoned NS owned by Pearland ISD both buffer Mary's
Creek to the Northeast, further bounded to the East by Mary's Creek and a 6.21
acre parcel zoned NS with an existing older single-family residence, then to the
South by John Lizer Road. The property on the South side of John Lizer Road is
zoned R-1. Lastly bordered to the West by a 7.72,acre parcel that is zoned GB.
This 7.72 acre parcel also abuts the Easterly line of Pearland Parkway. There is
a significant tree cover on the Northerly and Easterly portions of the site.

II. AMENITIES
The site is to be extensively landscaped. Usable outdoor spaces will include a
large amount of lawn and landscape areas. The landscaping will include raised
beds of varying levels for ornamental, flower and vegetable gardening made
available for use and enjoyment of our residence. Special features of this site
will include a horseshoe court in the southerly cottage common area and a large
unique water feature located amidst the northerly retirement cottages, all adding
to the park like setting. An integrated network of walking paths, 6 feet in width,

will provide our residence with an excellent opportunity for daily exercise. The
walking paths will be complemented with benches and respite areas throughout
as well as connecting to all exits of the building. There will be a large partially
covered patio off of the craft/exercise room. The patio area along with the cabana
and pool come together to create an oasis like atmosphere and serving to extend
and expand the living area to this outside attraction

III. CONCLUSION
In conclusion, we feel that this site is ideally suited for our use and would be a
nice addition to the John Lizer Road / Pearland Parkway area and the existing
and future development for the area.

1. Clarify that the CUP is for 118 suites/apartments and 13 duplex cottages (26
units), a total of 144 units.
2. Meet all requirements of common open space under Multi Family (MF) zone in
the Unified Development Code (UDC).
3. Provide a minimum of two parking spaces for each of the 26 units in duplexes
(including garage) and one parking space for each suite/apartment unit. Twenty
five percent (25%) of parking spaces can be designated as future parking as per
Section 4.2.1.3 (k) of the UDC.
4. Provide access from John Lizer Road and Pearland Parkway.
5. Provide amenities as stated in the public hearing and include this in the
document.
6. Despite the UDC designation of Assisted Living, the marketing should be for
independent living.
7. If medical staff is later hired, the CUP needs to be modified.
8. Site plan, elevations and other details should conform to the document and
attachments provided. Minor changes shall be approved by the Planning

Honorable Mayor and City Council Members:
At their regular meeting of October 20, 2008, the Planning and Zoning Commission
considered the following:
Request of Harvest Development do Curry Architecture LLC, applicant for Vivian
Naeve, owner, for approval of a Conditional Use Permit to permit Assisted Living
Facility in Neighborhood Service (NS) zone, on the following described property, to wit:
LEGAL DESCRIPTION: 18.26 acres of land, in the T.D. Yocum Survey, A-399
and the A.C.H & B Survey, A-147, Brazoria County,

GENERAL LOCATION: Generally located on the North Side of John Lizer
Road, East of Pearland Parkway
Commission Member Ron Capehart made a motion to recommend approval of the
conditional use permit request, which was seconded by Commission Member Susan
Sherrouse. The motion passed 6-1. P&Z Chairperson Henry Fuertes voted in
opposition as he felt the item should have been tabled. The conditional use permit
request was recommended for approval by the Planning and Zoning Commission with
