A request of Eustavo Reyes, the applicant, on behalf of Robert Ronald Perales, owners, for
approval of a Variance Permitted in Section 2.6.1.1 (b) (1) of the Unified Development Code,

Planner Hustead presented the staff report with exhibits. Planner Hustead informed the
commission that this plat variance does not conforms to the requirements of the UDC and the
code conformance standards and could put the public's safety at risk per Section 2.2.5.2 (b) 4 of
the UDC.
Commissioner Dansby commented about the flood plain on the property and nearby areas. Vice
Chairperson Fuertes stated that the property looks like it is in the flood way and properties located
in the flood way are difficult to do anything with because you must apply for a letter of map revision.
Vice Chairperson Fuertes stated that even if the commission approved the variance the applicant
would run into problems later, so he suggested they table this item to give the applicant time.
Deputy City Attorney Provins stated that the variance is meant to subdivide the lot to create
another development like what is on the existing lot, which would be more unsafe for the flood
plain in the area. Deputy City Attorney Provins suggested that if the commission tables this item
to do it for a specific purpose or period. Commissioner Boswell asked what the purpose of tabling
this item and how long this item would be tabled. Commissioner Isenberg stated that the
applicants didn't attend this meeting to be available for questions. Deputy City Attorney Provins
stated that the applicants can apply again, but that means they would have to pay the fee for the
variance application again. Chairperson Cade stated that she is not against tabling this item.
Commissioner Boswell agreed. Commissioner Dansby asked why the commission would table
this item. Vice Chairperson Fuertes stated that the property is in the flood way, so the commission
could grant the applicant time to get a map revision or a conditional map revision, so FEMA could
adjust the map, so the parcel is no longer in the flood way. He informed the commission that this
process usually takes a six-month minimum and suggested that the commission tables the item
for at least nine months. Vice Chairperson Fuertes stated that this case may be like the variance
previously discussed by the commission on Green Tee drive heard several months ago, where
the commission tabled the item and the applicant may not come back, but they may resolve this
issue before they decide to no longer continue with this process. Planning Manager Griggs added
that the Green Tee case was tabled to give the applicant time to conduct further studies and they
are still working with those entities. Planner Hustead stated that the applicant can apply for this
variance again. Assistant Director of Engineering Shrestha informed the commission that the map
in the presentation is the new floodway map that became available on December 30, 2020 and
the ordinances were also updated to reflect the map. Assistant Director of Engineering Shrestha
also stated that in the ordinance, Section F is about floodway and what Vice Chairperson Fuertes
has described, for a new construction to change the floodway they would have to be approved
through FEMA. The process would take longer than six months and the City of Pearland
Engineering Department would be a reviewer of the application.

Planner Hustead presented the staff report with exhibits. Planner Hustead stated that this a
variance for an extension of an existing flag lot and that this plat variance conforms to the
requirements for a plat variance in the UDC.
Vice Chairperson Fuertes asked staff if the commission was considering the previous lot. Planning
Manager Griggs answered that the commission would only be reviewing the variance. Vice
Chairperson Fuertes asked if this parcel is in the city limits. Planning Manager Griggs answered
that it is zoned and in the city limits. Vice Chairperson informed that a previous commission dealt
with this property when it was a hotel and received negative feedback from the community, so the
commission created an ordinance to alleviate having commercial buildings too close to residential
areas.

Planner Hustead presented the staff report with exhibits. Planner Hustead informed the
commission that this residential replat does not conform to the requirements of the UDC. Planner
Hustead stated that the applicant did not reference the original plat and the revisions requested
by staff were not submitted in time for the presentation to the commission. The revisions that were
requested by staff were, the plat name `Cavazos Estates' needed to be corrected to the original
plat name, missing a statement in the residential replat statement, building lines were shown on
the plat, the outside lines on the plat need to be solid lines, engineering markups and comments
have not been addressed, the driveway access statement was missing, the utility district number
was missing from the plat. Planner Hustead provided the application timeline to the commission.
Planner Hustead stated that staff is not opposed to this replat, but the corrections were not
addressed in a timely manner.
Planning Manager Griggs informed the commission the timeline presented by Planner Hustead
is the timeline that is presented to all platting applicants. Planning Manager Griggs also stated
that the applicant resubmitted December 30 and corrected some of those issues, but
unfortunately it was not enough time for all the necessary staff to review.
Commissioner Earles asked Planning Manager Griggs if staff still recommends to not move
forward with this item. Planning Manager Griggs answered suggesting that the commission take
the six issues with the replat into mind, but if all six issues were resolved that staff would be able
to recommend approval.
Deputy City Attorney Provins stated that if the commission approves the replat with conditions,
that the applicant has 30 days to make those corrections, if they choose not to the plat will still be
approved because the commission never denied the item. Deputy City Attorney Provins legal
advice to the commission is to not approve the replat but does suggest tabling the item for a later
date. Deputy City Attorney Provins stated that extension would need to be in writing for the
purpose of the record.
Chairperson Cade asked Deputy City Attorney Provins if the commission could table this item.
Deputy City Attorney Provins answered that the commission wouldn't be able to table this item
due to time limit.
Commissioner Boswell asked if the replat was denied, how would the application process look for
the applicant. Planner Hustead replied that there is a plat filing deadline tomorrow, January 5 for
the February meeting. Planning Manager Griggs confirmed and stated that the applicant would
have to pay the platting fees again. Commissioner Boswell asked staff how much the platting fees
are, to be considerate of the applicants' finances and asked if the commission and staff would
need additional time to review the plat application. Planning Manager Griggs if they were to
resubmit tomorrow January 5, they would receive another round of staff's comments on January
15 and then have four days to resubmit their application on January 19. Commissioner Boswell
commented on the applicant was 7 days late in this last application period. Commissioner Dansby
stated that he wants to make sure the application process is not too difficult but also that
commission is being lawful, but also assist citizens to the best of the commissions ability to be
able to development in Pearland. Assistant City Engineer Pourazizian shared the engineering
departments concerns, the main concern being the right of way dedication will change with this
replat and the existing fence on the property is now in the right of way on O'Day Road.
Virginia Ramirez and Billy Jack Talton, the architects on behalf of the owners Cavazos Jorge &
Ruth Garcia De were present. Mr. Talton stated that Mr. Cavazos was ill for two weeks, so Ms.
Ramirez and Mr. Talton had to complete what they could. Mr. Talton asked staff about the right
of way being moved into the property 10 feet on O'Day Road. Assistant City Engineer Pourazizian
answered that engineering does not determine the existing right of way, but that the surveyor will
look at an existing parcel and plat determine the right of way dedication. Assistant City Engineer
Pourazizian did state that he believes it should be no more that 20 feet for this property. Mr. Talton
stated that he was there when the surveyor was there, he asked when this dedication would
happen. Assistant City Engineer Pourazizian answered during the platting process. Mr. Talton
stated that he corrected revision requested by staff except for engineering's right of way concern.
Mr. Talton asked for an extension.
Deputy City Attorney Provins asked Planning Manager Griggs that if the applicant withdrew their
application would they be refunded their application fees. Planning Manager Griggs stated the
filing fee would only be refunded if the applicant withdrew before the meeting agenda was
published, but the processing fee would be kept, and the filing fee would be refunded since they
are separate fees.
Chairperson Cade asked'to clarify with Deputy City Attorney Provins that a conditional approval
would not be suggested. Deputy City Attorney Provins replied correct because the commission
cannot confirm that those conditions will be met by the applicant. Commissioner Boswell asked if
the applicant was presented with the option to withdraw their submittal and receive a refund and
asked if there is any other resolution. Vice Chairperson Fuertes asked if the commission can table
this item until next weeks meeting to allow both parties to work together. Planner Hustead stated
that staff would have to re-advertise this residential replat in the newspaper and send out another
set of public notices to property owners within 200 feet. Deputy City Attorney Provins replied that
the legal timeline would not allow for that option. Planner Hustead did inform the owner and
applicant of the withdrawal option for their application due to staff recommending denial.
Commissioner Boswell asked Planner Hustead if he had suggested withdrawal before this
meeting's agenda was published. Planning Manager Griggs explained that the staff report had
already been completed, and the agenda was being worked on when the new site plan was
submitted on January 30, so the agenda may have already been posted when the suggestion of
withdrawal was being discussed. Chairperson Cade clarified that would have been to late to
withdraw and receive a refund. Planning Manager Griggs confirmed and informed the commission
that the new plat submitted on January 30 would have address all of staff's requested revisions.
Commissioner Dansby asked if the Planning and Zoning Commission could take any action about
the fees. Deputy City Attorney Provins replied no. Commissioner Boswell asked if there is a way
to approve this item. Planner Hustead did confirm that the 30-day application period would be
until Friday, January 8. Deputy City Attorney Provins stated that because it is a residential replat
there is not enough time to notify the public and we cannot host a public meeting on a Friday.
Commissioner Boswell stated that the option is to deny this application for residential replat
because the criteria has not been met for approval. Deputy City Attorney Provins replied that is
correct. Ms. Ramirez asked if they could be granted a conditional approval. Commissioner
Dansby asked who would be able to wave fees. Deputy City Attorney Provins answered the
Director of Community Development John McDonald and City Manager Clay Person would have
some authority. Commissioner Isenberg asked if the commission could suggest to either of them
to wave the fees for this applicant. Deputy City Attorney Provins replied that the commission could
deny the item and recommend in the vote for the fees to be waved for the resubmittal if the
resubmittal complies to the criteria of a residential replat and then the Director of Community
Development McDonald and City Manager Person will make that decision. Mr. Talton stated that
he would be able to revise the plat by Friday and would apricate the fees being waved.
Commission Boswell clarified to Mr. Talton that what is being proposed is the fees being waved
for resubmittal, but that does not mean it will be granted. Ms. Ramirez asked again if this
application could be approved with conditions. Deputy City Attorney Provins replied that the
commission does not do conditional approvals for plats.

DISCUSSION ITEMS
1. Staff City Council Meeting Report— Presented by Planning Manager Martin Griggs.
2. Commissioners Activity Report—Commissioner Isenberg asked when in-person meetings
will reconvene. Planning Manager Griggs replied that staff is still monitoring the pandemic,
first responders have received their first vaccination and if something new happens he will
be updating the commission. Deputy City Attorney Provins informed the commission that
on January 11, City Council will be having a meeting and will be discussing public meeting
protocols. Planning Manager Griggs informed the commission that the January 11 meeting
will only be a Joint Special Meeting and there will likely not be a Planning and Zoning
Meeting.
