Notice is hereby given that on
the 12th day of April, 1999, at
6:30 p.m., the City Council
and the Planning and Zoning

APPLICATION. City of
Pearland, 3519 Liberty Drive,
Pearland, Texas 77588, has
applied to the Texas Natural
Resource Conservation
Commission (TNRCC) for a
new permit, proposed Texas
Pollutant Discharge Elimina-
tion System (TPDES) Permit
No. 10134.007, to authorize
the discharge of treated
domestic wastewater at an
annual average flow not to
exceed 2,000,000 gallons per
day.
The plant site is located
approximately 0.25 mile east
and 1 mile north of the inter-
section of County Road 101
(Bailey Road) and County
Road 103 (Harkey Road) in
the City of Pearland in
Brazoria County, Texas. The
treated effluent is discharged
to Marys Creek; thence to
Clear Creek Above Tidal In
Segment No. 1102 of the San
Jacinto -Brazos Coastal Basin.
The unclassified receiving
'water uses are no significant
aquatic life uses for Marys
Creek. The designated uses
for Segment No. 1102 are
contact recreation and high
aquatic life uses. No signifi-
cant degradation of high quali-
ty receiving waters is antici-
pated.
The Executive Director of the
TNRCC has prepared a draft
permit which, if approved, will
authorize the conditions under
which the facility must oper-

ments and requests for a pub-
lic meeting may be submitted
to the Office of the Chief
Clerk, at the address provided

below, within 30 days of the
issued date of this notice. A
public meeting is intended for
the taking of public comment,
and is not a contested case
hearing. A public meeting will
be held if the Executive
Director determines that there
is a significant degree of pub-
lic interest in the application.
