COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY;
SEPTEMBER 28,1998, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING,
HELD IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY
DRIVE, PEARLAND, TEXAS.
I. CALL TO ORDER
The Planning and Zoning Commission Meeting was called to order at 7:20 p.m. with the
following present:

II. APPROVAL OF MINUTES

The minutes for the previous meeting of September 14, 1998 were presented for review and
approval.
Commissioner Jack Mathis made a motion, seconded by Vice -Chairman Tommy Scott, to approve
the minutes as amended.
Motion passed 5 to 0.
HI. NEW BUSINESS
A. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 342
Request of James L. & Annie B. Peyton, owners for an amendment to the Land Use and
Urban Development Ordinance of said City from Classification Suburban Development,, (SD)
to Multi -Family Dwelling District (MF) on the following described properties, to wit:
Being 4.00 ac., more or less out of Lot 8 & also Lot 9 of section 14, HT & B RR Co.
survey, A-509, also with said lots 8 & 9 being known as lots 8 & 9 of Richland
Acres, an unrecorded subdivision, Brazoria Co., TX (16119 Aubrell)
Chairman Mary Starr read the property description.

Commissioner Emil Biltz noted that water is not currently available for said property.
Drainage concerns were discussed and will require some on -sight detention.
Vice -Chairman Tommy Scott asked if anything was located on the property.
Director of Planning & Community Development Dennis Smith noted that mobile homeare
located on the property but are not believed to be occupied.
The Witt Storage building is very close to the described property.
Commissioner Pat Lopez stated that the zone change request is not compatible with the : ea.
Commissioner Pat Lopez made a motion, seconded by Commissioner Jack Mathis, to •eny
Zone Change Application No. 342.
Further discussionwas conducted regarding the appropriateness of a Multi -Family Dwelling
in the proposed area.
Vice Chairman Tommy Scott called for a vote.
Motion passed 5 to 0.
B. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 3181
Request of H. Louie & Mary Tashakori, owners for an amendment to the Land Use and
Urban Development Ordinance of said City from Classification Suburban Development (SD)
to General Business (GB) on the following described properties, to wit:
Being 0.6984 ac. tract out of Lot "A" of Westgate Park, a subdivision of 9.575 ac. out
of Lot 40 & 47, Allison Richey Gulf Coast Home Co. subdivision, Sect. 19, HT &
B RR Co. survey, A-243, Vol. 16, Pg. 320, plat records of Brazoria Co., TX (7929
Broadway [FM 518])
The property description was read by Chairman Mary Starr.
Dennis Smith noted that the proposed zone change is compatible to the area with General
Business zoning to the west and M-1 to the north.
Commissioner Emil Biltz made a motion, seconded by Vice Chairman Tommy Scott, to
approve Zone Change Application No. 318.
Motion passed 4 to 0 with one abstention.

Commissioner Pat Lopez made a motion, seconded by Vice Chairman Tommy Scott, to
approve Zone Change Application Numbers 339, 340, 341, 347, 351, 368, and 367.
Motion passed 5 to 0.
V. ADJOURNMENT
Commissioner Jack Mathis made a motion, seconded by Commissioner Emil Beltz, to adjourn the
Planning and Zoning Commission meeting.
Motion passed 5 to 0.
