HomeMy WebLinkAbout1998-09-14 P&Z Minutes (in Agenda Packet)MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, SEPTEMBER 14,1998, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING, HELD IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The Planning and Zoning Commission Meeting was called to order at 7:20 p.m. with the following present: Chairman Vice -Chairman Commissioner Commissioner Commissioner Director, Planning & Community Development Planning & Zoning Secretary Planning & Zoning Secretary Mary Starr Tommy Scott Jack Mathis Emil Beltz Nghiem Doan Dennis Smith Mona Ann Phipps Nelda Ruth Patterson Commissioner Pat Lopez was absent. II. APPROVAL OF MINUTES The minutes for the previous meetings of August 24, 1998 were presented for review and approval. Vice -Chairman Tommy Scott made a motioned, seconded by Commissioner Nghiem Doan, to approve the minutes with corrections made to page 3. Motion passed 5 to 0. III. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 315 Request of Keith Sanders, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Light Industrial District (M-1) on the following described property, to wit: Being 0.505 ac. out of a 10 ac. tract in the S '/ of the NE ''A of the SE 'IA of the G. C. Smith survey, section 16, A-546, of the deed records of Brazoria Co., TX 1 Chairman, Mary Starr read the property description. Director of Planning & Community Development Dennis Smith noted that the Sharondale address is the address of the owner not the property that is being zoned. The business is existing and faces Harkey Road. Discussion included the location of the property and area being predominantly residential. Mary Starr suggested that a Specific Use, Commercial or General Business zoning would be more appropriate for the property. Dennis Smith stated that a septic installation company existed on the property and would probably fit in a Commercial Zone specification. Concerns were noted regarding storage of items outside and whether a building currently exist on the property. Dennis Smith stated that he would obtain additional information and photos of the site. Vice Chairman Tommy Scott made a motion, seconded by Commissioner Emil Beltz, to table Application No. 315 pending the acquisition of additional information. Motion passed 5 to 0. B. CONSIDERATION AND POSSIBLE ACTION - Zoning Applications No. 310 & 313 Request of Dian Norman (Application 310) and Ramon & Leticia Ortiz (Application 313), owners for an amendment to the Land Use and Urban Development Ordinance of Said City form Classification Suburban Development(SD) to Mobile Home District (MH) on the following described properties, to wit: 1. Zone Change Application No. 310 Lot 12, Somersetshire Estates, Vol. 6, pgs. 283-284, Sect. 85, HT & B RR Co. survey, A-304, plat records of Brazoria Co., TX (3403 King Arthur's Court) 2. Zone Change Application No. 313 Being 1.50 ac. of the W 'V2 of a certain 3.00 ac. out of Lot 169, Zychlinski subdivision, sect. 27, HT & B RR Co. survey A-308, according to the plat records of Brazoria Co., TX (8002 Herbert Drive) Chairman Mary Starr read the property description. 2 Director of Planning & Community Development Dennis Smith noted that Darren Koker, City Attorney, is currently revising the Land Use and Urban Development Ordinance to allow for a single mobile home residence. Commissioner Jack Mathis made a motion, seconded by Vice Chairman Tommy Scott, to table Zoning Applications 310 and 313 pending completion of the revision to the Land Use and Urban Development Ordinance. Motion passed 5 to 0. C. Director of Planning and Community Development Dennis Smith noted that Application No. 319 is a subdivision of Lot 5, however, both divided properties retained a legal description of Lot 5. Mr. Smith would like to obtain copies of plat records and request the application be tabled until such time. Vice Chairman Tommy Scott made a motion, seconded by Commissioner Jack Mathis, 4 to table Zoning Application 319. Motion passed 5 to 0. Commissioner Jack Mathis made a motion, seconded by Commissioner Nghiem Doan, to approve Zoning Applications 335, 325, 327, 337, 355, 356, 334, 338, and 350. Motion approved 5 to 0. D. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 364 Request of Amvest Properties, Inc., owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-1, R-2) and Commercial District (C) to Single Family Dwelling District (R-4) on the following described properties to wit. Being a tract of land containing 68.958 acres, more or less, located in the A.C.H. & B RR Company Survey, Section 2, Abstract 507, Brazoria County, Texas, being out of and a part of a called 104.401 acre tract to Charles F. Alexander, of record in Volume 86268. Page 586 of the Official Records of Brazoria County, Texas, and also being a part of lots 3 thru 8, and 13 of the L. W. Murdock Subdivision, of record in Volume 29, Page 174 of the Deed Records of Brazoria County, said 68.958 acres being more particularly described as follows (all bearings referenced to the Texas State Plane Coordinate System, South Central Zone. NAD 1983): BEGINNING at the southwest corner of the herein described tract in the south line of aforesaid 104.401 acre tract, from which the southwest corner of said 104.401 acre tract in the northeast right-of-way line of State Highway 35 (100 foot right- of-way) bears South 86 degrees 38 minutes 00 seconds West, a called distance of 285.41 feet, which corner is also the northwest comer of a tract to the Pearland Independent School District, of record in Volume 88552, Page 385 of the Official Records of Brazoria County, Texas. THENCE North 86 degrees 34 minutes 09 seconds East along the south line of aforesaid 3.933 acre tract a distance of 112.71 feet to the southeast corner of said 3.933 acre tract. 5 THENCE North 03 degrees 19 minutes 19 seconds West, along the east line of aforesaid 3.933 acre tract a distance of 347.58 feet to the northeast corner of said 3.933 acre tract; THENCE South 86 degrees 34 minutes 09 seconds West, along the north line of aforesaid 3.933 acre tract a distance of 304.30 feet to an angle point of the herein described tract; THENCE North 32 degrees 12 minutes 42 seconds West, a distance of 564.22 feet to the corner of the herein described tract; THENCE South 57 degrees 47 minutes 18 seconds West, a distance of 250.00 feet to the northeast right-of-way line of aforesaid State Highway 35; THENCE North 32 degrees 12 minutes 42 seconds West along the northeast right- of-way line of aforesaid State Highway 35 a distance of 100.00 feet to a corner of the herein described tract; THENCE North 57 degrees 47 minutes 18 seconds Past a distance of 250.00 feet to a corner of the herein described tract; THENCE, North 32 degrees 12 minutes 42 seconds West a distance of 544.27 feet to the northwest corner of the herein described tract in the south right-of-way line of John Lizer Road (70 foot right-of-2\way at this point); THENCE North 86 degrees 38 minutes 01 second East, along the south right-of- way line of aforesaid John Lizer Road a distance of 1,914.97 feet to a transitional right-of-way corner; THENCE South 03 degrees 21 minutes 59 seconds East, along aforesaid transitional right-of-way line of John Lizer Road a distance of 10.00 feet to the south right-of-way line of said John Lizer Road; THENCE, North 86 degrees 38 minutes 01 seconds East, along the south right-of- way line of aforesaid John Lizer Road a distance of 299.70 feet to a 5/8 inch iron rod found at the northeast corner of the herein described tract in the west right-of- way line of Pearland Parkway (140 foot right-of-way); THENCE, South 01 degree 47 minutes 04 seconds East, along the west right-of- way line of aforesaid Pearland Parkway a distance of 448.49 feet to a 5/8 inch iron rod found marking the beginning of a curve to the left, THENCE, along the arc of aforesaid curve to the left and the west right-of-way line of Pearland Parkway, through a central angle of 25 degrees 54 minutes 51 seconds, having a radius of 2,070.00 feet, and arc length of 936.24 feet and a long chord bearing South 14 degrees 44 minutes 30 seconds East, a distance of 928.28 feet to the end of said curve in the southeast line of aforesaid 104.401 acre tract and also being in the northwest line of the W.D.C. Hall Survey, Abstract 70; THENCE, South 42 degrees 02 minutes 15 seconds West, along the northwest line of aforesaid W.D.C. Hall Survey and the southeast line of aforesaid 104.401 acre tract a distance of 135.46 feet to the west corner of said Hall Survey; THENCE, South 42 degrees 27 minutes 34 seconds East, along the west line of aforesaid W.D.C. Hall Survey and an east line of aforesaid 104.401 acre tract a distance of 327.38 feet to the southeast corner of said 104.401 acre tract and also being the northeast corner of aforesaid Pearland Independence School District tract; THENCE, South 86 degrees 38 minutes 00 seconds West, along the south line of aforesaid 104.401 acre tract and the north line of aforesaid Pearland Independent School District tract a distance of 1,587.42 feet to the POINT OF BEGINNING and containing 68.958 acres more or less. Mary Starr, referred to the attached document for the property description. It was noted that Ken Caffey presented a preliminary plat prior to this meeting when problems were noted with the side yard. Vice Chairman Tommy Scott added that the property was platted as R-4 and is now being presented• for the zoning change. Mary Starr noted that the area across I 35 is zoned M-2, a service station on the corner, detention ponds on he R-1 corner, and the Highs School on the south. Vice Chairman Tommy Scott made a motion, seconded by Commissioner Emil Beltz, to approve Zoning Application No. 364. Motion passed 5 to 0. E. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 316 Request of Rafael & George Salazar, owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R-3) on the following described properties, to wit: Lot 6, Blk. 1, Buena Vida subdivision, in the HT & B RR Co. survey, A-240, according to the map records of Brazoria Co., TX (6331 Cantu) 7 Chairman Mary Starr read the property description. Director of Planning & Community Development Dennis Smith noted that this is the companion subdivided property to Zoning Application No. 319 tabled due to clarification of the Legal description. Vice Chairman Tommy Scott made a motion, seconded by Commissioner Jack Mathis, to table Zoning Application No. 316 pending clarification of legal description. Motion passed 5 to 0. V.
