HomeMy WebLinkAbout1998-10-12 P&Z Minutes (in Agenda Packet)MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, OCTOBER 12, 1998, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING, HELD IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The Planning and Zoning Commission Meeting was called to order at 7:25 p.m. with the following present: Chairman Mary Starr Vice -Chairman Tommy Scott Commissioner Jack Mathis Commissioner Emil Beltz Commissioner Nghiem Doan Director, Planning & Community Development Dennis Smith Planning & Zoning Secretary Nelda Patterson Commissioner Pat Lopez was absent. II. APPROVAL OF MINUTES The minutes for the previous meeting of September 28, 1998 were presented for review and approval. Vice Chairman Tommy Scott made a motion, seconded by Commissioner Emil Beltz, to approve the minutes as corrected. Motion passed 5 to 0. II. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 390 Request of Cherotech, Inc, owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Light Industrial District (M-1) on the following described property, to wit: Legal Description: Lot 28, being 9.924 acres out of the Allison Richey Gulf Coast Home Co. subdivision, Sect. 9, HT & B RR Co. survey, A-234, plat records of Brazoria Co., Vol. 2, pgs. 23 & 24. Brazoria Co., TX (14435 Max Road) Owner: Cherotech Inc. 14435 Max Road Pearland. Texas 77581 1 Planning And Zoning Commission October 12, 1998 Page 2 of 6 Agent: Charlie Eason 2405 S. Grand Pearland, Texas 77584 Chairman Mary Starr read the property description. Director of Planning & Community Development, Dennis Smith stated that the staff recommends approval:. TNRCC has stricter regulations than the city when obtaining clearance. Commissioner Emil Beltz made a motion, seconded by Commissioner Jack Mathis, to approve zone change application number 390 as requested. Motion passed 5 to 0. B. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 363 Request of owner for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R-3) on the following described property, to wit: Legal Description: Owner: Agent: A 117.6207 ac. parcel being all of lots 23 through 28, and a portion of lots 21, & 31 through 36, Suburban Gardens subdivision, Sect. 85, HT & B RR Co. survey, A-304, as recorded in Vol. 2, pg. 107- 108, Plat Records of Brazoria Co. TX (Corner of CR 93 & CR 403) The Ritson Morrison Corporation 2621 Joanel Street Houston, Texas 77027 John N. Taylor 702 Omar Street Houston, Texas 77009 The property description was read by Chairman Mary Starr. Dennis Smith noted that drainage plans would be required and approved at the time of platting. Mr. Smith also noted that the city plans to enter into and over -sizing agreement for water and sewer requirements and that a package plant will provide sewer needs until such time. 2 Planning and Zoning Commission October 12, 1998 Page 3 of 6 Mr. Smith noted that concerns regarding the Cherry Concrete facility are appreciated. Mr. Taylor is aware of the existence of the concrete facility and knows that certain screening will need to be included in the development of aforedescribed property. The staff recommends approval. Commissioner Emil Beltz inquired about the volume of dust resulting from the concrete recycling facility. Leonard Cherry noted that the facility is permitted by the TNRCC and is monitored and tested periodically. He stated that water misters are located at various levels to alleviate some of the dust however, the facility does emit a certain amount of dust as well as noise level may also be of concern. The normal hours of operation for the facility are Monday through Friday from 6:30 a.m. to 6:30 p.m. and on Saturday 6:30 a.m. through 2:00 p.m. These hours vary dependent upon the project. Dennis Smith noted that this project would be a similar situation to Maryfield on John Lizer and Highway 35 where a pipe -racking company exist and the developer will consider screening developing plans. Commissioner Emil Beltz made a motion, seconded by Commissioner Nghiem Doan, to approve Zone Change Application No. 363. Motion passed 5 to 0. C. CONSIDERATION AND POSSIBLE ACTION - Zoning Application No. 478 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single -Family Dwelling District (R-2) on the following described property, to wit: Legal Description: Lots 1 & 2, Blk. 1, Wagon Wheel Addition, HT & B RR Co. survey, Sect 14, A-509, according to the map recorded in Vol. 8, pg. 79, plat records of Brazoria Co., TX (6106 Patridge) Owner: Frank J. Miller P.O. Box 2234 Pearland, Texas 77588-2234 The property description for Zone Change Application No. 478 was read by Chairman Mary Starr. Director of Planning and Community Development, Dennis Smith noted that the request for 3 Planning and Zoning Commission October 12, 1998 Page 4 of 6 R-2 is because the two lots are smaller(approximately ''A ac. each) and there is no evidence of erasing the lot line. The property currently has a home located on it. Commissioner Nghiem Doan made a motion, seconded by Vice Chairman Tommy Scott, to approve Zone Change Application Number 478. Motion passed 5 to 0. D. CONSIDERATION AND POSSIBLE ACTION - Zoning Applications No. 365, 344 & 366 Vice -Chairman Tommy Scott made a motion, seconded by Commissioner Jack Mathis, to combine consideration of Zone Change Application Numbers 365, 344, and 366. Motion passed 5 to 0. Zoning Application No. 344 Legal Description: Lots 9 & 10, Blk. 4, Hickory Creek Place subdivisions , HT & B RR Co. survey, Sect. 7, A-219, according to the plat recorded in Vol. 11, pg 1, plat records of Brazoria Co.,TX (1411 Michael Lane) Owner: Robert B. & Mary Louise Fariley 1411 Michael Lane Pearland, Texas 77581 4 Planning and Zoning Commission October 12, 1998 Page 5 of 6 3. Zoning Application No. 366 Legal Description: Owner: Part of Lots 45 & 55, being 13.28 ac., in the Allison Richey Gulf Coast Home Co. survey, Sect. 85, A-304, recorded in Vol. 2, pg. 107, plat records of Brazoria Co., TX Karen & George Ritchey 1855 CR 93 Pearland, Texas 77584 The description of the properties was read by Chairman Mary Starr. Director of Planning and Community Development, Dennis Smith noted that water and sewer would be such as preposed subdivision off Miller Ranch Road utilizing an over -sizing agreement. Existing ponds would be utilized for drainage. Mr. Smith also noted that he will ask Code Enforcement Officer Bob Bratz to contact Mrs. Treadway to help get the area cleaned up. Mr. Treadway inquired of Application request 366 as to top soil being lower than normal. Mr. Smith stated that all plans are required by state law to abate excess water and will comply with the Flood Plan which could require additional dirt be hauled in. Concerns were voiced as to the water being discharged into Hickory Slough and causing problems with drainage and flooding. Mr. Smith stated that the City Engineer monitors drainage and if determined to be at capacity, developers are required to provide additional methods of drainage. Vice -Chairman, Tommy Scott made a motion, seconded by Commissioner Jack Mathis, to approve Zone Change Applications 365, 344, and 366. Motion passed 5 to 0. Director of Planning and Community Development, Dennis Smith informed Commission members that during the November 9, 1998 meeting, Shadow Creek Master Plan will be presented. 5 Planning and Zoning Commission October 12, 1998 Page 6 of 6 V. ADJOURNMENT Commissioner Nghiem Doan made a motion, seconded by Commissioner Jack Mathis, to adjourn the Planning and Zoning Commission meeting. Motion passed 5 to 0.
