IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 6:00 p.m. with the following present: Chairman Pat Lopez Vice Chairman Emil Beltz Commissioner Jack D. Mathis Commissioner Mary Starr Commissioner Tommy Scott Commissioner Don Baker City Engineer John Hargrove Director of Planning and Development Dennis Smith Secretary Judy Highburger Project Coordinator Alan Mueller was absent, and Commissioner Nghiem Doan arrived at 6:16 p.m.. II. APPROVAL OF MINUTES: Minutes of February 23, 1998. Commissioner Jack D. Mathis made a motion, seconded by Commissioner Don Baker to revise the Minutes of February 23, 1998, after Item B to indicate that Commissioner Doan arrived at 7:26 p.m. instead of Commissioner Mary Starr. Motion passed to revise 6 to 0. III. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - Final Plat of Weatherford, Phase II at Silverlake. A tract of 12.5102 acres of land being a replat of all of Reserve "E" out of Weatherford Phase I at Silverlake. A subdivision of 48.7859 acres of land out of the R.B. Lyle Survey, A-539, Brazoria County, Texas as recorded in Volume 19, Pages 707-710, B.C.P.R. 1 Variance Request: 1. Use of 20-foot building line setbacks on lots fronting the bulb portion of cul- de-sacs. 2. Use of 5-foot side lot building line setbacks. City Engineer John Hargrove said staff recommended approval with the removal of an unexplained graphic feature on Marble Falls Drive, lots 40-41, and he and the City Attorney will withhold signatures until completion of same. Discussion ensued around the comrnent of Director of Planning and Development Dennis Smith regarding Council Retreat and the expressed opinion of the members present that the Commission follow the Land Use Ordinance pertaining to Section 5.4.2(a)(c) of front yard requirements of 25' and side yard of 5' with an aggregate of 15'. The Council's concern is that there seems to be a large number of variances requested to change the requirements. Chairman Pat Lopez stated the Commission has been consistent with the variance requests, and Commissioner Tommy Scott said the Ordinance should be followed. Chairman Lopez said if the parameters are changed, then the developers should be made aware of it as soon as possible. Commissioner Scott said that if Council is unwilling to change the guidelines, the Commission needs to be made aware of it. Chairman Lopez requested a letter to the developers that Council is looking to eliminate the 5' side yard setbacks, and Mr. Smith said he would draft same. A motion was made by Commissioner Mathis and seconded by Commissioner Scottie) approve the Final Plat of Weatherford, Phase II at Silverlake, with the requested variances, and removal of the graphic feature noted above. "Motion passed to approve 7 to 0. B. CONSIDERATION AND POSSIBLE ACTION - Final Plat of West Oaks Village, Section Two. Being a 28.7349 acre tract of land located in the H.T. & B. R.R. Company Survey, A-241 Pearland, Brazoria County, Texas. Ms. Renee West, Mr. Rick Gadd, and Mr. John English were present representing the owner, R. West Development Company. Mr. Hargrove recommend approval of the Final Plat of West Oaks Village, Section Two, with the following exceptions: 1. Need an instrument from HL&P for assurance of the easement on Reserve B. 2. Take county road numbers off the vicinity map. 3. Get zoning approval (pending). 2 A motion was made by Commissioner Mary Starr and seconded by Vice Chair Emil Beltz to approve the Final Plat of West Oaks Village, Section Two with the above -stated recommendations, and that signatures by Mr. Hargrove and the City Attorney be withheld until exceptions are met. Motion passed to approve 7 to 0. C. CONSIDERATION AND POSSIBLE ACTION - Final Plat of Green Tee Terrace, Section 8. Being 2.811 acres of land in the W.D.C. Hall Survey, A-23, Harris County, Pearland, TX. Variance Request: 20 foot building line be allowed on lots fronting cul-de-sacs. Mr. Hargrove said staff recommended approval except for the note from Harris County Flood Control signed or removed, and change the city limits on the vicinity map. A motion was made by Commissioner Scott, and seconded by Commissioner Mathis to approve the Final Plat of Green Tee Terrace Section 8 with the mentioned changes, and requested variances, and that signatures by Mr. Hargrove and the City Attomey be withheld until exceptions are met. Motion passed to approve 7 to 0. D. CONSIDERATION AND POSSIBLE ACTION - Preliminary Family Funeral Home. 1.7998 acres of land out of 297.58 acres out Hall Survey, A-70 Pearland, Brazoria County, Texas. Mr. Dave Reynolds and Ms. Linda Fuqua were present representing the owner, SCI Services, Inc. Plat Pearland of the W.D.C. Texas Funeral Mr. Hargrove read a letter (attached) to Mr. Alan Mueller from David S. Reynolds dated January 26, 1998, concerning the generation of traffic onto Hwy 518. Commissioner Mathis stated he attended several funerals recently and the numbers stated in the letter seemed low based on his observations. Mr. Reynolds said this would be a full service facility; the numbers were based on historical figures, and as this is a new business it would be slow in starting. Chairman Lopez asked if the property has its own detention pond, and Mr. Hargrove said yes. A motion was made by Commissioner Starr, and seconded by Vice Chair Beltz to approve the Preliminary Plat of Pearland Family Funeral Home. Motion passed to approve 7 to 0. 3 ,• E. CONSIDERATION AND POSSIBLE ACTION - Preliminary Plat Sonic - Pearland. Being a subdivision of 0.8953 acre out of 4.8646 acres recorded in B.C.C. File No. 93-035649 and being a partial replat of Lot 64 of Section 9, H.T. & B. R.R. Company Survey, A-234 recorded in Volume 2, Page 24, B.C.D.R. Mr. Gonzalo Buentello, and Mr. Jeff Mallett were present representing the owner, Sonic, Inc.. Mr. Hargrove said staff recommended approval of the Preliminary Plat of Sonic - Pearland, with the addition of signatures from Brazoria Drainage District #4. He went on to say that Chairman Lopez should withhold his signature on the plat until that is complete. A motion was made by Commissioner Scott and seconded by Commissioner Starr to approve the Preliminary Plat of Sonic - Pearland. Motion passed to approve 7 to 0. F. CONSIDERATION AND POSSIBLE ACTION - The Lakes at Countryplace, Section 2. A Preliminary Plat of 19.104 acres out of the H.T. & B. R.R. Co. A-310 Survey, Brazoria County, Texas. Variance Request: 1. Minimum front setback of 20' and 15' on lots. 2. Minimum 5' side building line with an aggregate of 10' between houses. 3. Cul-de-sac longer than 600'. Mr. Stan Winter, Mr. Steve Gardner and Mr. Peter Boecher were present representing the owner, U.S. Homes Corporation. Mr. Hargrove had a comment that the mylar was sent folded and he was rejecting it. He recommended approval of The Lakes of Countryplace, Section 2 with the following conditions: 1. Need signatures of Brazoria Drainage District #4 on Preliminary Plat. 2. Need surveyors statement on Preliminary Plat. 3. Final plat needs Hold Harmless Agreement on pipeline being within 100'. 4. Reference bearings need to be stated on the final plat. Mr. Hargrove is also concerned about the right to enter and maintain water, sewer and storm sewer utilities in the private right-of-way, and he said that the north two lane of McHard Road needs to be under construction before starting construction on Section 2. 4 U.S. Home Corporation representative Don Lindsay said they plan to build the north half of McHard Rd. and the streets in Section 2 & 3 at the same time. Mr. Hargrove said they need to get an agreement with Mr. Alan Mueller at time of final platting. He recommended that the Preliminary Plat be signed later by Chairman Lopez after corrections were made. A motion was made by Commissioner Mathis, and seconded by Cotntnissioner Nghiem Doan to approve the Preliminary Plat of The Lakes at Countryplace, Section 2, with the requested variances and above -stated conditions. Motion passed to approve 7 to 0. G. CONSIDERATION AND POSSIBLE ACTION - The Lakes at Countryplace Section 3. A Preliminary Plat of 13.516 acres out of the F.B. Drake A-503 and F.B. Drake A-510 Surveys, Brazoria County, TX. 'Variance Request: 1. Minimum front setback of 15' and 20' on lots. 2. Minimum 5' side building line with an aggregate of 10' between houses. Mr. Don Lindsay, Mr. Steve Gardner and Mr. Peter Boecher were present representing the owner, U.S. Homes Corporation. Mr. Hargrove recommended approval of the plat with the same comments stated in Item F. A motion was made by Commissioner Scott and seconded by Commissioner Mathis to approve the Preliminary Plat of The Lakes of Countryplace Section 3 with the requested variances. Motion passed to approve 7 to 0. H. CONSIDERATION AND POSSIBLE ACTION - Preliminary Plat of Oakbrook Estates, Section Four and a Partial Replat of Oakbrook Estates Section One. A subdivision of 14.5836 acres out of the W.D.C. Hall League, Abstract No. 70, Pearland, Brazoria County, Texas. Variance Request: 1. Allow 20 foot front building lines on all cul-de-sacs and bulb cul-de-sacs. 2. Cul-de-sacs greater in length than 600 feet on Oak Point Drive and Oak Point Court. Mr. Al Lentz and Mr. Tom Langford were present representing the owner, Oakbrook Estates, Ltd. 5 Mr. Hargrove said staff recommended approval of the plat; however, he is rejecting the sepia as it is torn. He went on to say that a surveyor's statement is required and Chairman Lopez should sign the Preliminary Plat after the changes are made. A motion was made by Commissioner Starr and seconded by Commissioner Scott to approve the Preliminary Plat of Oakbrook Estates, Section Four and a Partial Replat of Oakbrook Estates Section One. Mueller, Project Coordinator City of Pearland 3519 Liberty Drive Pearland, Texas 77581 FEB 21996 -24 RE: Family Funeral Care Project FM 518, Pearland, Texas Dear Mr. Mueller: The following information is provided to aid in your understanding of traffic generated by this proposed project. This funeral home will be a new business. Our regional staff projects the first year's operations at 80 services. This equates to less than two per week. By the fifth year, projections call for 120 to 130 funerals. This would produce less than three funeralsper week. Visitations (private viewings) are normally held the day before the funeral. The average number of cars coming to a visitation is twelve. These trips are normally staggered throughout the day and evening. It is rare to have more than three vehicles at any one time in the parking lot at a single visitation. The average service will be attended by 40 to 50 people who arrivewith two to three individuals per vehicle. The average number of vehicles per service is approximately 20. Funerals are scheduled at 10:00 a.m., 12:00 noon and 2:00 p.m. (non -peak traffic hours). The average service lasts twenty minutes. Only 80% of the funeral attendees go in procession to the graveside service. An average funeral with 20 vehicles would have approximately 16 cars going to the cemetery. Approximately 10% of the families choose to have the deceased cremated which might involve a funeral service but would not have a procession to a cemetery. There are three cemeteries to which most processions will be taken. Approximately 45% of the processions would go east from the funeral home to Forest Park East Cemetery and the remainder would go west from the funeral home to South Park or Forest Lawn Cemeteries.
