COMMISSION, OF THE CITY OF PEARLAND, TEXAS, HELD MONDAY, MARCH 23,
1998, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING IN THE SECOND
FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND,
TEXAS.
1. CALL TO ORDER
The meeting was called to order at 8:30 p.m. with the following present:
Chairman Pat Lopez
Vice Chairman Emil Beltz
Commissioner Nghiem Doan
Commissioner Jack D. Mathis
Commissioner Mary Starr
Director of Planning and Development Dennis Smith
Secretary Judy Highburger
City Engineer John Hargrove, Project Coordinator Alan Mueller, and Commissioners Don Baker
and Tommy Scott were absent.
II. APPROVAL OF MINUTES: March 16, 1998
A motion was made by Commissioner Jack D. Mathis and seconded by Vice Chair Emil Beltz
to approve the Minutes of March 16, 1998.
Motion passed to approve 4 to 0.
Commissioner Nghiem Doan arrived at 8:32 p.m.
LEL NEW BUSINESS
A. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO.258
Request of Paul and Alice Gutierrez, owners, for an amendment to the Land Use
and Urban Development Ordinance of said City from Classification Single Family
Dwelling District (R-1) to Commercial District (C) on the following described
property, to wit:
Being designated as Tract 20, Sandoval Subdivision containing .370 ac. In the
west X of the northeast '/<, Section 15, HT & B RR Co. survey, A-241, Brazoria
Co. TX (6606 W. Broadway).

Director of Planning and Development Dennis Smith said Mr. Gutierrez's proposed use on the
application was for a mapping business, and he has since informed the Commission it is for a
beauty salon; therefore, General Business will suffice if that is approved by the prospective
buyer.
A motion was made by Vice Chairman Emil Beltz to deny Application No. 258. Motion failed
for lack of a second.
A motion was made by Commissioner Mary Starr to approve Application No. 258. Motion failed
for lack of a second.
Vice Chair Beltz made a motion, seconded by Commissioner Nghiem Doan to table Application
No. 258.
Motion to table passed 5 to 0.
B. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 265
Request of R. West Development Co., Inc., agent for Ravenwood Section One,
J.V., owner, for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development District (SD)
to Single Family Dwelling District (R-1) on the following described property, to
wit:
Being a 41.3692 acre tract out of the south 4 of the southeast /< of Sect. 16, HT
& B RR survey, A-546, Brazoria Co., TX (Harkey Rd. and C.R. 101).
A motion was made by Commissioner Mary Starr to approve Application No. 265, and was
seconded by Vice Chairman Beltz.
Motion passed to approve 5 to 0.
C. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 266
Request of R. West Development Co., Inc., owner, for an amendment to the Land
Use and Urban Development Ordinance of said City from Classification Suburban
Development (SD) to Single Family Dwelling District (R-1) on the following
described property -to -wit:
Being a parcel containing 16.6408 acres out of a 20 acre tract as recorded in Vol.
1068, pg. 144, Brazoria Co. Deed records and being out of the south 4 of the
southeast gi of Section 18, HT & B RR survey A-546, Brazoria County, TX
(adjacent to Ravenwood Estates).
A motion was made by Vice Chairman Beltz and seconded by Commissioner Starr to approve
Application No. 266.
Motion to approve passed 5 to 0.

D. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 270
Request of Alfred E. Lentz, agent for Willow Partners Ltd., owners, for an
amendment to the Land Use and Urban Development Ordinance of said City from
Classification' Office Professional (OP) to Single Family Dwelling District (R-2)
on the following described property, to wit:
Being 29.5472 ac. Out of Lot 14, Lots 2&3, Narregang's Subdivision and Lot 25
out of the O.W. Willits Subdivision recorded in Deed Records, Volume 1, 3, &
70, pgs. 92, 65 & 616, Brazoria County, TX.
A motion was made by Commissioner Mathis to approve Application No. 270 and correct the
acreage to 9.5472 acres, and was seconded by Vice Chairman Beltz.
Motion passed to approve 5 to 0.
E. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 263
Request of R. West Development Co., Inc., agent for Pearland West Oaks 3 & 4
Ltd., owner, for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development District (SD)
to Single Family Dwelling District (R-3) on the following described property, to
wit:
Being a 25.3514 acre tract located in the HT & B RR survey, A-241, Brazoria
Co., TX and also a called 34.98 acre tract in an instrument recorded in Vol. 72,
pg. 94, Deed Records of Brazoria Co., TX (south of Fite Road, west of Harkey
Rd.).
A motion wasmade by. Commissioner Doan to approve Application No. 263, and was seconded
by Commissioner Mathis.
Motion passed to approve 5 to 0.
F. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 260
Request of R. West Development Co., Inc., agent for West Oaks Village Section
Two Ltd., owner, for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development (SD) to Single
Family Dwelling District (R-4) on the following described property -to -wit:
Being a 28.3781 acre tract located in the HT & B RR survey, A-241, Brazoria
Co., TX and a 160 ac tract described in an instrument in Vo. 708, pg 109, Deed
Records of Brazoria Co. TX, (Fite Road).
G. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 261
Request of R. West Development Co., Inc., agent for Gallentine Associates,
owner, for an amendment to the Land Use and Urban Development Ordinance of

said City from Classification Suburban Development District (SD) to Single
Family Dwelling District (R-4) on the following described property, to wit:
Being a 35.4855 acre tract located in the HT & B RR survey, A-241, Bmzoria
Co., TX out of the residue of a 160 acre tract conveyed to John Massey on
instrument recorded in Vol. 708, pg 109, Deed Records of Brazoria Co., TX (off
Fite Road).
H. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 262
Request of R. West Development Co., Inc., agent for Gallentine Associates,
owner, for an amendment to the Land Use and Urban Development Ordinance of
said City from Classification Suburban Development (SD) to Single Family
Dwelling District (R-4) on the following described property -to -wit:
Being 20.5591 acre tract located in the HT & B RR survey, A-241, Bmzoria
County, TX, out of the residue of a 160 acre tract conveyed to John Massey per
an instrument recorded in Vol. 708, pg. 109, Deed Records of Brazoria Co., TX
(off Fite Road).
A motion was made by Commissioner Starr to combine Items F, G & H, and was seconded by
Commissioner Mathis.
Motion passed to combine Items F, G, & H - 5 to 0.
A motion was made by Commissioner Mathis to approve Items F, G, & H, and seconded by
Commissioner Starr.
Motion passed to approve Items F, G, & H - 5 to 0.
I. CONSIDERATION AND POSSIBLE ACTION - SPECIFIC USE PERMIT
NO. 60
Request of R. West, Development Co., Inc, agent for West Oaks Village Section
2, Ltd., owners, for an amendment to the Land Use and Urban Development
Ordinance of said City for a Specific Use Permit on the following described
property, to wit:
Being a 1.7915 acre tract located in the HT & B RR survey, A-241, Brazoria Co.,
TX and out of a called 160 acre tract in an instrument recorded in Vol. 708, pg.
109, Deed Records of Bmzoria Co., TX (west of West Oaks Village Section 1-B).
A motion was made by Conunissioner Starr to approve Specific Use No. 60, and seconded by
Commissioner Doan.
Motion passed to approve 5 to 0.

J. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 269
Request of Vincente Alonso, owner, for an amendment to the Land Use and
Urban Development Ordinance of said City from Classification Suburban
Development District (SD) to General Business District (GB) on the following
described property, to wit:
Tracts 1-6 and Tract 9, Block 2 in the West Lea Subdivision.
Mr. Smith said he has information from the West Lea civic organization that he and the Interim
City Attorney Darrin Coker have reviewed, and they have researched state law to check the
implications of deed restrictions versus zoning restrictions. He went on to say the City looks at
the best use of the land.
Commissioner Starr asked if there are future plans to widen FM 1128, and Mr. Smith said
currently there are no funds available; however, it is open for changes.
Vice Chairman Beltz asked if Mr. Alonso's lots were not platted like the other lots in West Lea,
were they redrawn, and Mr. Smith showed the Commissioners a layout of the subdivision.
A motion was made by Vice Chairman Beltz and seconded by Commissioner Mathis to deny
Application No. 269.
Motion passed to deny 5 to 0.
K. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 280
Request of Bob Lewis, agent for ML Partnership, owner, for an amendment to the
Land Use and Urban Development Ordinance of said City from Classification
Multi -Family District (MF) to Multi -Family District - Planned Unit Development
(MF-PUD) on the following described property -to -wit:
A 12.2400 tract of land situated in the Thomas J. Green Survey, Abstract 198,
Brazoria County, Texas. Being a part of a 9.883 acre tract recorded under C.C.F.
No. 97-025082, official recording, also being a part of a 9.883 acre tract recorded
under C.C.F. No. 96-045024, official records and a part of a 4.5925 acre tract,
recorded under C. C. F. No. 97-000221, official records of Brazoria County,
Texas.
Mr. Smith said that Project Coordinator Alan Mueller had presented plans at the last meeting of
the proposed apartments, and adjustments have been made; they now meet PUD and Overlay
requirements.
Commissioner Starr asked if there was a contingency to the plans, and Mr. Smith said no.
Chairman Pat Lopez said when plans are submitted to P&Z and City Council, and that is the time
to check if all requirements have been met.
Commissioner Starr made a motion to approve Application No. 280 subject to plat approval.
Motion was seconded by Commissioner Mathis.
