HomeMy WebLinkAbout1998-07-27 P&Z Minutes (in Agenda Packet)MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, JULY 27, 1998. IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 8:15 p.m. with the following present: Chairman Mary Starr Vice -Chairman Tommy L. Scott Commissioner Jack D. Mathis Commissioner Pat Lopez Commissioner Emil A. Beltz Planning and Zoning Secretary Jennifer Mattingly Director of Planning & Community Development Dennis Smith Commissioners Don Baker and Nghiem Doan were absent. II. APPROVAL OF MINUTES The June 29, 1998 minutes were approved as presented with corrections. III. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - ZONING APPLICATION NO. 299, Request of Thomas A. Amundsen, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Light Industrial District (M-1) on the following described property, to wit: Being 4.9902 ac., being the N. '/2 Lot 47, HT & BRR Co. Survey, Section 85, A-304, according to the plat recorded in Volume 2, pg. 107, Brazoria Co., TX (1939 C.R. 93) Dennis Smith stated that he and John Bowman visited the site at Mr. Amundsen's request. He stated that several land owners did say that the land was well maintained, there was no noise, and he reminded that commissioners that Mr. Amundsen had been there for 7 years. He then recommended approval by the Planning and Zoning Commissioners. 1 Commissioner Pat Lopez commented that there seems to be a tremendous amount of spot zoning going on, in which they were trying to avoid. His concern was not with the business but with placing an M-1 on the whole acreage. Mr. Amundsen asked for permission to speak. He then addressed the board that he started his business 7 years ago, and some of the people they heard from that evening had built there homes after he was there. He stated Pearland should have a lot of homes, but they also need a work place as well. A lady then stood and stated she's been there since the early 80's and before he started he went to all the neighbors to tell them what he was doing and there was never any talk of any industrial. Commissioner Pat Lopez stated that it's always interesting for the people to refer to who was there first, but he has been here for 41 years and Renee West is swallowing his acres. Dennis Smith stated that if Mr. Amundsen is zoned M-1, it is unrestricted. Vice -Chairman Tommy L. Scott states that he gets confused because the ordinance has changed. He reminded the commissioners that in the Old Townesite there is GB zoning with homes there. He suggested that it remains SD, then request. a variance. Dennis Smith stated that you must have an active zone to pull a permit or request a variance. Vice Chairman Tommy L. Scott asked about a specific use, and Dennis Smith stated you must be in a zone for that also. He then asked if it could be zoned R-1, then have a specific use for building? Dennis Smith replied that there are no specific uses in R-1. Commissioner Pat Lopez stated that until staff could come up with a better option he is going to make a motion to deny the application. Vice - Chairman Tommy L. Scott seconded motion. Motion failed 2 to 3. B. CONSIDERATION AND POSSIBLE ACTION - ZONING APPLICATION NO. 295, Request of R. West Development Co., agent for Houston Pine Hollow Associates, Ltd., owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-3) & Commercial (C) to Single Family Dwelling District (R-4) on the following described property, to wit: 2 Being 51.412 ac. And all lots 27 & 44 and a poriton of lots 42,45,46,47,& 48 out of the George W. Jenkins subdivision recorded in Vol. 2, pg. 20, A-111, Brazoria Co., TX. Vice -Chairman Tommy L. Scott made a motion to approve, Jack D. Mathis seconded motion. Motion passed 5 to 0. C. CONSIDERATION AND POSSIBLE ACTION - ZONING APPLICATION NO. 294, Request of R. West Development Co., agent for Houston Pine Hollow Associates, Ltd., owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classication Single Family Dwelling District (R-3) & Commercial (C) to Single Family Dwelling District (R-4) on the following property, to wit: 45.6928 acres being all of lots 39 & 40, a portion of lots 41, 42, 45, 46, 47, & 48 out of the George W. Jenkins subdivision recorded in Vol. 2, pg. 20, of the Brazoria Co. Deed Records. (Dixie Farm Rd. And F.M. 518) Commissioner Emil Beltz motioned for approval of application no. 294 to send to City Council, and Vice -Chairman Tommy L. Scott seconded motion. Motion passed 5 to 0. D. CONSIDERATION AND POSSIBLE ACTION - ZONING APPLICATION NO. 311, Request of Jack McGuff, Jr., agent for Fran Coppinger, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Single Family Dwelling District (R-2) to Single Family Dwelling District (R-4) on the following described property, to wit: Being a 11.309 ac, tract in Lot 12 of the H. Masterson Subdivision, Sec. 6, HT & BRR Co. survey A-237 and all of lot 2, blk. 1 of the Malone Subdivision Vol. 18, pg. 103, Brazoria County Deed Records, Brazoria Co., TX. Dennis Smith explained that this was the gated community. Commissioner Pat Lopez asked what kind of fence will go around the area? Architect Jack McGuff then answered that a wooden fence would go around the perimeter and an iron gate will be in the entrances. Dennis Smith then recommended approval by the Planning and Zoning 3 Commissioners to send to City Council. Commissioner Pat Lopez made a motion to approve application no. 311, and Vice -Chairman Tommy Scott seconded the motion. Motion passed 5 to 0. IV. NEXT MEETING DATE: August 3, 1998, at 6:00 p.m. (Regular meeting) August 10, 1998 at 6:30 p.m. (JPH meeting) V.
