HomeMy WebLinkAbout1997-09-08 P&Z Minutes (in Agenda Packet)MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION, OF THE CITY OF PEARLAND, TEXAS, HELD MONDAY, SEPTEMBER 8, 1997, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 7:02 p.m. with the following present: Vice Chairman Commissioner Commissioner Commissioner Director of Planning and Development Secretary Emil Beltz Jack D. Mathis Tommy L. Scott., Mary Starr \ \ Dennis Smith Judy Highburger Chairman Pat Lopez, Commissioner Don Baker, City Engineer John Hargrove, and Project Coordinator Alan Mueller were absent. H. APPROVAL OF MINUTES: Minutes of August 25, 1997 A motion was made by Commissioner Mary Starr, and seconded by Commissioner Tommy Scott to approve the Minutes of August 25, 1997. Motion passed to approve 4 to 0. HI. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 224 Request of Mark and Robyn Smith, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: Lot 7, Block 3, Section 2 of the Garden Acres Subdivision of the H.C. Johnston 99 Acre Tract, also being the south 99 acres of section 7 of the H.T.&B.R.R. Company Survey, A-219 in Brazoria County, Texas. (2628 Lazy Bend Street) Commissioner Jack D. Mathis made a motion, seconded by Commissioner Starr to approve Application No. 224. Motion passed to approve 5 to 0. 1 B. CONSIDERATION AND POSSIBLE ACTION - Request of owner for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Multi -Family Dwelling District (MF) on the following described property, to -wit: Located in the Sandoval Subdivision, a part of Section 15 in the H.T.&B.R.R. Co. Survey, A-241, Brazoria County, Texas: 1. Zoning Application Owner: Agent: Legal Description: Address: 2. Zoning Application Owner: Agent: Legal Description: Address: No. 137 Linda A Halsey None .620 acres in the. west 1/2 of the northwest 1/4 of the northeast 1/4 of section 15, H.T.& B.R.R. Co. Survey, A-241, Brazoria County, Texas. None No. 138 Linda A Halsey None 1.285 acres out of Lots 10 & 11 of a partition of the east 1/2 of the northwest 1/4 of Section 15, H.T.&B.R.R. Co. Survey, A-241, Brazoria County, Texas. None Commissioner Scott questioned if Ms. Halsey Bracewell had another zone change application in process now, to which she replied no, that if the property was zoned R-1 a section could be pardoned for ingress, and she could replat it. Commissioner Starr made a motion, seconded by Commissioner Mathis to table Application No. 137. Motion passed to table 4 to 0. Commissioner Scott had concerns with Application No. 138's tract having 72' in depth which would make it difficult to build on. He went on to say that if it was zoned MF, single family residences could be built in a staggered fashion. Commissioner Scott referred to the Land Use and Urban Development Ordinance, page 26-27, Section 9- MF, Multi -Family, Section 9.4. General Conditions, a: which states minimum site areas must be at least 65,000' in area; and b: minimum width is 125'. Vice Chairman Emil Beltz said it would be difficult to build townhouses in that space. Commissioner Mathis questioned the density of the land use as MF, and Ms. Halsey Bracewell said it depends on how the property is designed and used. She went onto say that future building will have to be well planned so that it does not diminish the surrounding property. Director of Planning and Development Dennis Smith said the property could possibly accomodate a MF zoning through a variance. Commissioner Starr said that it would have to be a Planned Unit Development (PUD), and does not think it could be. Mr. Smith said he will get with Ms. Halsey Bracewell and reconfigure the application if she desired. Ms. Halsey Bracewell said she would withdraw the application and resubmit as R-1. A motion was made by Commissioner Scott, and seconded by Commissioner Mathis to deny Application No. 138. 2 Motion passed to deny 4 to 0. IV. NEXT MEETING DATE: September 15, 1997, 6:00 p.m. V. Variance Request: The proposed westerly commercial reserve (B) shall have a frontage of 135.70 fat on PM 518 with less than 150 feet of frontage required by criteria We respectfully request that the westerly reserve frontage be allowed since this reserve only contains easements for pipeline companies and the Southwestern Bell facility. There s no other space available for development of commercial improvements in this reserve. L.
