1996-09-09 P&Z Meeting MinutesMINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION, OF THE CITY OF PEARLAND, TEXAS, HELD MONDAY, SEPTEMBER 9,1996, IMMEDIATELY FOLLOWING THE JOINT PUBLIC HEARING IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 7:20 with the following present: Chairman Vice Chairman Commissioner Commissioner Commissioner Assistant City Manager Secretary Commissioner Marshall Eggers was absent. H. APPROVAL OF MINUTES: Robert Larsen Pat Lopez Emil Beltz Jeffery O'Brien Randy Patro Richard Burdine Judy Highburger Minutes of August 26, 1996 A motion was made by Commissioner Jeffery O'Brien and seconded by Vice Chairman Lopez to approve the Minutes of August 26, 1996. Motion Passed 5 to 0. III. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 75. On the request of Allen J. Robinson, owner, for an amendment to the Land Use and Urban Development Ordinance of said city from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Being a 0.9630 acre tract of land, and being a part of Lot "G" of Garden Acres Subdivision, Section 1, out of H.C. Johnston 99 acre tract, being the South 99 acres of the H. T. & B. R.R. Co. Survey, Section 7, Abstract No. 219, Brazoria 1 County, Texas, as described in deed recorded in Volume 595, Page 63, of the Deed Records of Brazoria County, Texas (6114 Laurie Street). B. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 76. On the request of Robin D. Zapalac, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: The West `2 of Tract-47, containing 5 acres, more or less, of the Allison- Richey Gulf Coast Home Company Subdivision, Section 19, in the H.T. & B. R.R. Survey, Abstract 243, Brazoria County, Texas, according to the recorded map or plat thereof in Volume 2, at Page 23 of the Plat Records of Brazoria County, Texas (2539 Zapalac Road). C. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 77. On the request of Reynaldo and Juanita Ramos, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lots 5 & 6, Block 1 of Garden Acres Subdivision, Section 2, being a subdivision in the South 99 acres of the H.T. & B. R.R. Survey, Section 7, A -219, as in deed recorded in Vol. 595, Page 63, of the Deed Records of Brazoria County, Texas (6329 Gardenia Street). D. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 78. On the request of Dan R. And Connie L. McMaster, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lot 3, Garden Acres, Section 3, a subdivision of 24 lots being 18.862 acres of land out of Tract 36 of a subdivision of the H.T. & B. R.R. Co. Survey, Section 7, Abstract 219, Brazoria County, Texas, according to the map of plat thereof recorded in Volume 10, Page 77, Plat Records, as corrected by Volume 923, page 645, of the Deed Records of Brazoria County, Texas (2614 Thelma St.). E. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 79. On the request of Anh Ngoc Ho, agent for Vo Vi Friendship Association of Pearland, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lots 3 & 4, Block 2 of Skyway Manor Subdivision, being a subdivision of 68.24 acres out of the West `z of the Northwest % of Section 15, H.T. & B.R.R. Company Survey, Abstract 241, Brazoria County, Texas, according to the recorded 01 map or plat thereof in Volume 7, Page 67 of the Plat Records of Brazoria County, Texas (2810 Piper Road). A motion was made by Commissioner O'Brien and seconded by Commissioner Emil Beltz to consolidate Application Numbers 75 -79 together as one motion. Motion passed 5 to 0. A motion was made by Vice Chairman Lopez and seconded by Commissioner Randy Patro to approve Application Numbers 75 -79 together under one motion. Motion passed 5 to 0. F. CONSIDERATION AND POSSIBLE ACTION - SPECIFIC USE NO. 44. On the request of Anh Ngoc Ho, agent for Vo Vi Friendship Association of Pearland, owners, for a Specific Use Permit to allow an institution of religious and philanthropic nature in a Single Family Dwelling District (R -1) on the following described property, to -wit: Lots 3 & 4, Block 2 of Skyway Manor Subdivision, being a subdivision of 68.24 acres out of the West / of the Northwest / of Section 15, H.T. & B. R.R. Company Survey, Abstract 241, Brazoria County, Texas, according to the recorded map or plat thereof in Volume 7, Page 67 of the Plat Records of Brazoria County, Texas (2810 Piper Road). Mr. Odell Harwell of 5005 Woodville Lane, owner, was present requesting approval of Specific Use No. 44. A discussion period followed with Commissioners' concerns as to the legality of the erection of the building. Mr. Harwell stated the mobile home on the property will be moved out and there will be someone on the premises at all hours. He said he will bring documentation for review. Consensus of the Commission was to allow the City Attorney to review Mr. Harwell's documents relating to the purchase and erection of the structure. Mr. Richard Burdine, Assistant City Manager, will be the liason and will report back to the Commission. A motion was made by Commissioner O'Brien, and seconded by Commissioner Randy Patro, to table Specific Use No. 44 until September 23, 1996, the next Joint Public Hearing or completion of City Attorney's review of nonconforming use issue.
