1996-09-23 P&Z Meeting MinutesMINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION, OF THE CITY OF PEARLAND, TEXAS, HELD MONDAY, SEPTEMBER 23, 1996, AT 6:00 P.M. IN THE COUNCIL CHAMBERS AT CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 7:33 p.m. with the following present: Vice Chairman Pat Lopez Commissioner Emil Beltz Commissioner Marshall Eggers Commissioner Jeffery O'Brien Commissioner Randy Patro Assistant City Manager Richard Burdine City Engineer John Hargrove Chairman Robert Larsen and Secretary Judy Highburger were absent. H. APPROVAL OF MINUTES: Minutes of September 9, 1996 A motion was made by Commissioner Jeffery O'Brien, and seconded by Commissioner Randy Patro to amend the Minutes of September 9, 1996 under Section E, Preliminary Plat of Weatherford: "A motion was made by Commissioner Beltz and seconded by Commissioner O'Brien to approve the preliminary plat of Racetrac..." be changed to Weatherford. Motion passed 5 to 0. III. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 80. Request of Melvin Dilling, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Heavy Industrial District (M -2) on the following described property, to -wit: 1 A tract of land called the East Y2 of the West % of Lot 64 of the Subdivision of Section 9, H.T. & B.R.R. Company Survey, Abstract 234, Brazoria County, Texas, according to the Map or Plat thereof recorded in Volume 2, Page 24, of the Deed Records of Brazoria County, Texas (7029 -A Broadway Street). Mr. Richard Burdine, Assistant City Manager, said staff recommends tabling Application No. 80 until the applicant is present. Commissioner Patro made a motion, seconded by Commissioner O'Brien to deny Application No. 80 as it stands. Motion passed 3 to 2. B. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 81. Request of Gerald Munger of Century Engineering, Inc.. Agent for R & S Land Co., Inc., owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Multi - Family Dwelling District (MF) to Single Family Dwelling District (R -2 PUD) on the following described property, to -wit: Multi - Family Reserve "A ", Block 2, being 5.2087 acres out of Cobblestone, a subdivision of 36.074 acres as recorded in Brazoria County Plat Records, Brazoria County, Texas, in Volume 19, Pages 323 and 324 (Magnolia Road). C. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 82. Request of Gerald Munger of Century Engineering, Inc., agent for R & S Land Co., Inc., owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification General Business District (GB) to Single Family Dwelling District (R -2 PUD) on the following described property, to -wit: General Business Reserve `B ", Block 2, being 3.6544 acres out of Cobblestone, a subdivision of 36.074 acres as recorded in Brazoria County Plat Records, Brazoria County, Texas, in Volume 19, Pages 323 and 324 (Magnolia Road & Veterans Road). Commissioner O'Brien made a motion, seconded by Commissioner Marshall Eggers, to join Applications No. 81 and 82 as one motion. Motion passed 5 to 0. Commisioner O'Brien made a motion to approve Applicantions No. 81 and 82, and then amended the motion to have the preliminary plat attached to both applications to satisfy the PUD requirements. This was seconded by Commissioner Eggers. Motion passed 5 to 0. 2 D. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 83. Request of Jasper Willis, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development. District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lot 14, Block 2, Skyway Manor Subdivision of the H.T. & B. R.R. Company Survey, Abstract 241, Brazoria County, Texas, according to the Plat Records recorded in Volume 7, Page 67, of the Deed Records of Brazoria County, Texas (2934 Piper Road). A motion was made by Commissioner O'Brien, and seconded by Commissioner Eggers, to combine Applications No. 83, 87, and 88 under one motion as they are all R -1. Motion passed 5 to 0. A motion was made by Commissioner O'Brien, and seconded by Commissioner Eggers to approve applications No. 83, 87, and 88. Motion passed 5 to 0. E. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 84. Request of Charles Mallynn III, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Commercial District (C) on the following described property, to -wit: The West Sixty -six feet (W. 66') of Lot Five (5) and the adjoining East Ninety- five feet (E. 95') of Lot Six (6) of the Partition of the East one -half (E. %) of the Northwest one - quarter (NW. %) of Section Fifteen (15) of H.T. & B. R.R. Co. Survey, Abstract 241 of Brazoria County, Texas, according to the map of record in Volume 441, Page 265, of the Deed Records of Brazoria County, Texas, said map being confirmed per C/C Judgement recorded in Volume 593, Page 56, of the Deed Records of Brazoria County, Texas (6830 Broadway Street). A motion was made by Commissioner O'Brien, and seconded by Commissioner Emil Beltz, to table Application No. 84, as there was no representative present, and it is unclear as to the future use of the property. Motion passed 4 to 0 (one abstention) F. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 85. Request of Dave E. And Diana Rickey Hamm, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Commercial District (C) on the following described property, to -wit: 3 Tract 15, of Westchester Estates, according to the Jack C. McKnight Survey thereof dated April 6, 1962, a partition of Section 17, H.T. & B.R.R. Company Survey, Abstract 242, patented to Samuel Meyer, Assignee, by Patent No. 15, Volume 12 (2726 Westchester Circle). A motion was made by Commissioner Patro, and seconded by Commissioner Beltz to table Application No. 85 and reschedule the item for another Public Hearing as the Public Hearing was flawed. Motion passed 5 to 0. G. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 86. Request of Jesus Garcia, agent for Susana Garcia, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to General Business District (GB) on the following described property, to -wit: Lot 34, a tract of land being part of and out of Westchester Estates, a partition in the H. T. & B. R.R. Survey, Abstract 242, in Brazoria County, Texas, (2812 Manvel Road). A motion was made by Commissioner Patro, and seconded by Commissioner Eggers, to approve Application No. 86. Motion passed 5 to 0. H. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 87. Request of Joyce A. and Jack D. McGuff, Jr., owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lots 5, 6 & 7 out of Westchester Estates, a partition of 38.2531 acres out of the H.T. & B. R.R. Co. Survey, A -242, Brazoria County, Texas (2850 Westchester Circle). Motion passed under Item D. I. CONSIDERATION AND POSSIBLE ACTION - APPLICATION NO. 88. Request of Larry D. And Teresa A. Hood, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R -1) on the following described property, to -wit: Lot 16 being 6.0 acres of land of the East One -Half (E /) of the Northwest One- Quarter (NW ' /,) of Section 15, H.T. & B. R.R. Co. Survey, Abstract 241, 4 Brazoria County, Texas, as shown by plat of partition recorded in Vol. 441, Pg. 265, Deed Records, Brazoria County, Texas (6725 Fite Road). Motion passed under Item D. J. CONSIDERATION AND POSSIBLE ACTION - SPECIFIC USE 45. Request of Larry D. And Teresa A. Hood, owners, for an amendment to the Land Use and Urban Development Ordinance of said City for a Specific Use Permit to allow animal husbandry in a Single Family Dwelling District (R -1) on the following described property, to -wit: Lot 16 being 6.0 acres of land of the East One -Half (E Y2) of the Northwest One- Quarter (NW '4) of Section 15, H. T. & B. R.R. Co. Survey, Abstract 241, Brazoria County, Texas, as shown by plat of partition recorded in Vol. 441, Pg. 265, Deed Records, Brazoria County, Texas (6725 Fite Road). A motion was made by Commissioner O'Brien, and seconded by Commissioner Patro, to table Specific Use 45 as the applicant was not present, and the Specific Use pertaining to animal husbandry was vague.
