1997-03-22 - ELECTION CANVASS RESULTS - RESRESOLUTION NO. R97-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE; ORDERING THE MAY 3, 1997 ELECTION TO BE CANCELLED; ORDERING POSTING OF THIS RESOLUTION AT CITY HALL AND EACH POLLING PLACE ON ELECTION DAY; AND MAKING OTHER PROVISIONS RELATED THERETO. WHEREAS, by Resolution No. R97-8, the City Council has previously ordered a general election on May 3, 1997, to elect two Councilmembers for Positions 2 and 4, respectively; and WHEREAS, by Resolution No. R97-9, the City Council has previously named the central counting station and appointed Election Judges and Clerks; and WHEREAS, the City Council has received the City Secretary's written certification, in accordance with Section 2.052 of the Election Code, that each candidate who filed for the positions set forth herein are unopposed, as follows: for Councilmember, Position Number Two (2) ...... Richard Tetens for Councilmember, Position Number Four (4) ...... William Berger; and WHEREAS, the City Council may, in accordance with Section 2.053 of the Election Code, declare unopposed candidates elected without conducting an election if the sole purpose of the election is to elect officers of the governing body, no seat is contested, and the write-in filing date has passed; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The City Council declares each unopposed candidate elected to Section 1. office as follows: Richard Tetens is declared elected to the office of Councilmember, Position Number Two (2), subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. RESOLUTION NO. R97-22 William Berger is declared elected to the office of Councilmember, Position Number Four (4), subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. Section 2. The municipal election scheduled for May 3, 1997, shall not be held. The City Secretary shall post a copy of this Resolution at City Hall and the Melvin Knapp Building, 2425 Grand Boulevard, on election day, May 3, 1997. Section 3. The City Secretary shall issue to each candidate a certificate of election in the same manner as provided for a candidate elected at the election. Section 4. Resolution Nos. R97-8 and R97-9 are repealed to the extent that they are inconsistent with this Resolution. Section 5. The City Secretary's certification of unopposed status is attached hereto as Exhibit "A" and incorporated herein for all purposes. Section 6. This Resolution shall take effect immediately upon second reading, provided, however, that the candidates elected to office herein shall not take office earlier than May 12, 1997. There is only one candidate's name to be place on the ballot for each office, and there are no candidate's names to be placed on a list of write-in candidates for any office under applicable law.
