1964-06-18 - ELECTION CANVASS RETURNS - RES - Manually Move to Board Meetings Template NOTICE OF BOND ELECTION TO THE DULY QUALIFIED RESIDENT ELECTORS OF THE CITY OF PEARLAND, TEXAS, WHO OWN TAXABLE PROPERTY WITHIN SAID CITY AND WHO HA~ZE DULY RENDERED THE SAME FOR TAXATION, AND TO ALL OTHER INTERESTED PERSONS: NOTICE IS HEREBY GIVEN that a special election will be held in and throughout the City of Pearland, Texas, on the llth day of July, 1964, pursuant to and in keeping with the following resolution adopted by the City Council of said City, to-wit: A RESOLUTION CALLING A BOND ELECTION IN AND THROUGHOUT THE CITY OF PEARLAND, TEXAS; PRO- VIDING AND FIXING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THE STATE OF TEXAS § COUNTY OF BRAZORIA § The City Council of the City of Pearland, Texas, convened in ¢ ~ %O~*,~. . session at the City Hall within said City on the I~/~ \ day of~ June, 1964, with the following members present, to-wit: E. T. Gibbons Mayor Gene Sanders Alderman John Kegley Alderman '-- Victor Nolen Alderman W. A. McClellan City Secretary and the following member(s) absent, to-wit:~~t- ~'~t~ when the following business was transacted: The Mayor introduced a resolution which was read in full. Alderman c~ ~ ~ made a motion that the resolution be adopted as read. Alderman ~bt~ ~ seconded the motion for adoption of the resolution. The Motion, carrying with it the adop- tion of the resolution, prevailed by the following vote: AYES: Aldermen Sht6~enes, Sanders, Kegley, ~rl~xauma~T and Nolen, and Mayor Gibbons. NOES: None. The Mayor thereupon announced that the motion had duly and lawfully carried, and that the resolution had been duly and lawfully adopted. The resolution thus adopted follows: A P~ESOLUTION CALLING A BOND ELECTION IN AND THROUGHOUT THE CITY OF PEARLAND, TEXAS; PRO- VIDING AND FIXING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, the City Council of the City of Pearland, Texas, has determined, and hereby affirmatively determines~that an election should be called and held in and throughout said City of Pearland for the pur- pose of submitting propositions for the issuance of tax bonds of said City for the purposes hereinafter set forth; and WHEREAS, the City Council wishes to proceed with the ordering of said election; Therefore BE IT HESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND: Section 1. That an election shall be held in and throughout the City of Pearland, Texas, on the llth day of July, 1964, which is not less than fifteen nor more than thirty days from the date of this resolution, at which election the following propositions shall be submitted to the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation, for their action thereupon, to-wit: -2- PROPOSITION NO. ONE SHALL THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, BE AUTHORIZED TO ISSUE THE TAX BONDS OF SAID CITY IN THE AMOUNT OF $1,000,000, MATURING SERIALLY WITHIN FORTY (40) YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT TO EXCEED FIVE (5%) PER CENT PER ANNUM, FOR THE PUR- POSE OF CONSTRUCTING PERMANENT IMPROVEMENTS, ENLARGEMENTS, AND EXTENSIONS TO THE SANITARY SEWER SYSTEM OF SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? PROPOSITION NO. TWO SHALL THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, BE AUTHORIZED TO ISSUE THE TAX BONDS OF SAID CITY IN THE AMOUNT OF $500,000, MATURING SERIALLY WITHIN FORTY (40) YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT TO EXCEED FIVE (5%) PER CENT PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING PERMANENT IMPROVEMENTS, ENLARGEMENTS, AND EXTENSIONS TO THE WATERWORKS SYSTEM OF SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? PROPOSITION NO. THREE SHALL THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, BE AUTHORIZED TO ISSUE THE TAX BONDS OF SAID CITY IN THE AMOUNT OF $100,000~ MATURING SERIALLY WITHIN FORTY (40) YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT AT RATE OR RATES NOT TO EXCEED FIVE (5%) PER CENT PER ANNUM, FOR PUBLIC BUILDING PURPOSES~ TO-WIT: THE CON- STRUCTION AND EQUIPPING OF A CITY HALL, FIRE STATION~ AND POLICE STATION BUILDING IN AND FOR SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SD-FFI- CIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? Section 2o That the entire City of Pearland, Texas, is hereby established as one election precinct, and the City Hall within said City is hereby designated as the polling place for said election° The following named persons are hereby appointed officers to conduct said election: Mrs. Howard Suttle Presiding Judge Mrs° John Worrall Alternate Presiding Judge Mrs° Gene Remy, Sr. Clerk Mrs. Jack Miller Clerk Mrs. Josie Heflin Clerk Section 3. That said election shall be held in accordance with the Constitu- tion and laws of the State of Texas, and only duly qualified resident electors of said City of Pearland, Texas, who own taxable property within said City and who have duly rendered the same for taxation shall be qualified to vote. Section 4. That it is hereby determined by the City Council of the City of Pearland, Texas, that, except for absentee voting, voting in said election shall be by the use of voting machines. The ballots of said election shall conform to the requirements of the Election Code of the State of Texas, Chapter 492, Acts of the 52nd Legislature of Texas, Regular Session, 1951, as amended, and shall have printed thereon the following: OFFICIAL BALLOT PROEOSITION NO. QNE FOR AGAINST THE ISSUANCE OF $1,000,000 SANITARY SEWER SYSTEM IMPR01~MENTS, ENLARGEMENTS,AND EXTENSIONS TAX BONDS PROPOSITION NO. TWO FOR AGAINST THE ISSUANCE OF $500,000 WATERWORKS SYSTEM IM- PROVEMENTS,ENLARGEMENTS,AND EXTENSIONS TAX BONDS PROPOSITION NO. THREE FOR AGAINST THE ISSUANCE OF $100,000 CITY HALL, FIRE STATION, AND POLICE STATION BUILDING TAX BONDS. As to each proposition, each voter desiring to vote in favor of the proposition shall pull the voting pointer down indicating "For" such proposition, and each voter desiring to vote against such propo- sition shall pull the voting pointer down indicating "Against" such proposition, in accordance with said Election Code, as amended° Absentee voting in said election shall be by the use of paper ballots~ Such absentee voting shall be conducted by the City Secretary, Mr. W. A. McClellan, at the office of the City Secretary in the City Hall of the City of Pearland, Texas° Said City Secretary shall keep said office open for at least eight (8) hours, that is from 8:00 a.m. to 5:00 p.mo, on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday~ Said paper ballots shall have printed thereon the following: -5- ( OFFICIAL BALLOT PROPOSITION NO . THREE FOR THE ISSUANCE OF $100,000 CITY HALL, FIRE STATION, AND POLICE STATION BUILDING TAX BONDS AGAINST THE ISSUANCE OF $100,000 CITY HALL, FIRE STATION, AND POLICE STATION BUILDING TAX BONDS As to each proposition, the absentee voter shall vote on the proposition by marking out the statement for the proposition or the statement against the proposition, so that the one remaining shall indicate the way he wishes to vote, in accordance with said Election Code, as amended . Section 5 . That notice of said election shall be given by posting a copy of a notice containing a substantial copy of this Resolution at the City Hall and at two other public places within said City not less than fourteen (14+) days prior to the date upon which said elec- tion is to be held, and by publication of said notice on the same day 11 in each of two (2) successive weeks in THE ALVIN SUN, the first of said publications to be made not less than fourteen (14+) days prior to the date set for said election. It is hereby found and declared -6- that THE ALVIN SUN is a newspaper published in the City of Alvin, Texas, and is a newspaper of general circulation within the City of Pearland, Texas, and is the official newspaper of said City of Pearland, there being no newspaper published within said City of 11 Pearland . Section 6. That this resolution shall be in full force and effect from and after its adoption.
