1990-11-13 P&Z Meeting MinutesMINUTES OF A SPECIAL MEETING OF THE PLANNING AND ZONING COMMIS- SION OF THE CITY OF PEARLAND, TEXAS, HELD ON NOVEMBER 13, 1990, AT 7:30 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEART AND , TEXAS The meeting was called to order with the following present: Chairman Vice Chairman Commissioner Commissioner Commissioner Building Official Al Lentz Leroy Savoie Clyde Starns Benny Frank Helen Beckman Ernesto Buenrostro Assistant City Secretary Pat Jones Commissioners James Garner and Mary Starr had excused absences. APPROVAL OF MINUTES It was moved by Helen Beckman, seconded by Benny Frank, that the Minutes of the Meeting of November 6, 1990, be approved as sub- mitted. Motion passed 3 to 0, with Commissioners Savoie and Starns ab- staining. NEW BUSINESS PARTIAL AMENDED PLAT OF SUNSET MEADOWS, A 1.3928 ACRE TRACT, BEING A PORTION OF SUNSET MEADOWS AS RECORDED IN VOL 18, PAGE 261 -262 OF BRAZORIA COUNTY DEED RECORDS, OUT OF THE JAS. F. PERRY AND EMILY M. AUSTIN LEAGUE, A -111, SUNSET MEADOWS, JOINT VENTURE, RUSSELL PLANK, GENERAL PARTNER Chairman Al Lentz read into the record the following memo: TO: PLANNING AND ZONING COMMISSION FROM: ERNESTO BUENROSTRO, BUILDING OFFICIAL DATE: NOVEMBER 9, 1990 SUBJECT: PARTIAL AMENDED PLAT OF SUNSET MEADOWS SUBDIVISION The subject plat to be considered will have complied with the following by 11- 13 -90: 1. Tax Certificates will be submitted. 2. Title report will be available. 3. Brazoria County Drainage District No. 4 and District Engineer's signatures will be on plat. 4. Owners and lienholders signatures will be on plat. 5. Surveyors seal and signature will be on plat. xc: Municipal Engineering C/o Ted Bogrin 3301 Federal Street Pasadena, Texas 77504 Upon questioning by Chairman Lentz, Building Official Ernesto Buenrostro stated that all of the above had been complied with except for the signatures of lienholders as it was determined there were none. Mr. Buenrostro explained that the developer had encountered some problems resulting in the need for abandonment of a section of right-of-way by the City. Council should act on this at the November 26th meeting and the plat will not be recorded until the abandonment occurs. Russell Plank of Sunset Meadows gave a brief history of the situation wherein one of the nearby homeowners felt a roadway would be put in where none was wanted. Despite reassurances by the representatives of Sunset Meadows, legal action was taken by a group of homeowners and Mr. Plank stated they felt, after looking at many courses of action, that the simplest plan would be to ask the City to abandon the right -of -way and replat the area, even though they would lose one lot in the process as well as incurring other expenses. The Commission discussed abandonment procedures, relocation of the utilities, and access to the subdivision. Chairman Lentz suggested that the ownership of a a 25' strip of land at the end of Chester Drive be clarified. Mr. Plank stated it was given to the Civic Association and he would modify the plat accordingly. It was moved by Clyde Starns, seconded by Leroy Savoie, that the partial amended plat of Sunset Meadows be approved subject to the abandonment of the right -of -way, the conditions listed in Ernesto Buenrostro's memo having been met, and the plat is to show that there is no roadway on the east side of the property. In discussion, it was noted that the replatting laws have been met and the plat is being amended in accordance with same. Motion passed 5 to 0. ADJOURN The meeting adjourned at 7:52 P. M.
