Ernesto Buenrostro Pat Jones It was moved by Clyde Starns, seconded by Benny Frank, that the Minutes of the Meeting of October 1, 1990, be approved as pre- sented. Motion passed 5 to 0, with Mary Starr abstaining. NEW BUSINESS CHANGE IN THE ORDER OF BUSINESS INFORMAL DISCUSSION WITH G. L. RUSH, THE RUSH COMPANIES, AGENT FOR B. J. SERVICES COMPANY, USA, 3700 N. HWY 35, ALVIN, TEXAS Mr. Rush explained he is a real estate broker representing B. J. Services Company. He stated that he and two gentlemen of this oil- related company were appearing before the Commission on a fact - finding endeavor. They have met with the Development Com- mittee and wished to obtain additional information as to the procedures involved in relocating this company in Pearland. The Commission discussed several issues with the interested parties, among which were zoning in the area, type of business, storage and transportation of chemicals used in the operation, possible hazards to the community, and safety regulations on state and federal levels. The Commission discussed with Mr. Rush and representatives of B. J. Services Company options which could be taken and explained the procedures of a joint public hearing with the City Council. PRELIMINARY PLAT OF COUNTRYPLACE, SECTION THREE, A PROPOSED SUBDIVISION OF 16.5028 ACRES OUT OF THE F. B. DRAKE SURVEY A -510 AND THE JAMES CRAWLEY SURVEY A -174, U. S. HOME TEXAS, OWNER Chairman Lentz asked Building Official Ernesto Buenrostro for Staff comments and Mr. Buenrostro replied that, as the letter from Bernard Johnson, Inc. which was submitted with the plat stated, the City's approval with respect to Section Three has expired and he saw no significant changes from the previous plat. The Commission discussed frontage on circular lots, utility easements, and a lot shown on the plat designated for signage purposes. Whether McHard Road was a dedicated roadway in this area was considered as was the need for an emergency access road. The Commission also discussed screening, i.e., landscaping or fencing, adjacent to a major thoroughfare and building lines. Chairman Lentz read the following letter presented by representa- tives of Bernard Johnson into the records: October 23, 1990 Planning and Zoning Commission City of Pearland P. O. Box 2068 Pearland, Texas 77588 -2068 Reference: U. S. Home Corporation Countryplace Section Three BJI J.O. 79003 -50 Commissioners: On behalf of U.S. Home Corporation, we hereby request a variance on Countryplace Subdivision Section Three to use a 20- foot front building line in lieu of a 25 -foot building line as required by the City of Pearland Subdivision Ordinance. Our request for a variance is based on the following considerations: 1. The preliminary plat for Countryplace Sections Two and Three was approved on August 2, 1988 with the 20 -foot building line. A copy of the preliminary plat is enclosed. 2. The overall land plat that was approved and signed by Pear - land City Council on November 24, 1980 indicated a 20 -foot building line. This included Countryplace Section Two. A copy is enclosed. 3 . The adjoining Countryplace Section Two final plat was ap- proved with a 20 -foot building line. Houses built in this section are based on the 20 -foot building line. A copy of the plat is enclosed. 4. Pearland Subdivision regulations allow 50 -foot street rights -of -way. Countryplace Three has 60 -foot rights-of- way. A 25 -foot building line on a 50 -foot right -of -way (25 feet from street centerline plus a 25 -foot building line) provides the same separation as a 20 -foot building line on a 60 -foot right -of -way ( 30 feet from street centerline plus 20 -foot building line). The request for a 25 -foot building line could potentially mean that houses with a 50 -foot x 50 -foot pad could not be built on certain lots. This includes lot 12 of Block 2 and lots 8 and 25 of Block 3. Based on these considerations, we ask that the variance request for Countryplace Section Three be approved. No. 37265 Enclosure After much discussion, it was moved by Benny Frank, seconded by James Garner, that the preliminary plat of Countryplace, Section Three, be approved with two exceptions. Strike the words "Sign - age Only" on Reserve A and insure that the access easement con- tinues to County Road 94 from Reserve B. Mr. Thurber requested permission to record this access easement under a separate instrument and was instructed by the Commission that he did not have to change it on the preliminary but could do this on the final plat; however, a separate instrument was not satisfactory. A question was raised about the 16' utility easement along the westerly line as to whether it should be included in the plat. Building Official Ernesto Buenrostro stated he believed it to have been previously dedicated. Concerned with contradictions in the plats, it was suggested that the motion be amended to include the stipulation that research be done before the final plat is brought forward to make sure the plat is consistent with other plats. The maker and seconder of the motion agreed to so amend the motion. Motion passed 7 to 0. IONS CONCERNING THE SIGN The Commission reviewed the amendments to the Sign Ordinance subsequent to the joint workshop recently held with City Council. It was moved by Benny Frank, seconded by Helen Beckman, that these final recommendations, which are a culmination of all previous recommendations, be submitted to Council for amendment to the Sign Ordinance (copy attached with recommendations shown to the right of Sign Ordinance No. 509 -A). Motion passed 7 to 0. ADJOURN The meeting adjourned at 9:20 P. M. Minutes approved as submitted and /or corrected this day of A. Under Special Provisions, the second paragraph should read as follows: Churches, colleges, government -owned buildings and institu- tional education uses shall be allowed four off - premise signs, for directional purposes, not to exceed 32 square feet (2 sides maximum).
