AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSITY TO
ACQUIRE EASEMENTS FOR THE CONSTRUCTION OF DRAINAGE
IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED HEREIN;
AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, AND OTHER
CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO
ACQUIRE PROPERTY, LOCATED WITHIN THE CITY, BY DONATION,
PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT
DOMAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION
OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE
HEALTH, SAFETY AND WELFARE OF THE CITIZENRY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes that a public convenience and necessity
exists for the location, construction, operation, and maintenance of drainage improvements
on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the
public's best interest to acquire easements to certain property for the construction of
drainage improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public
convenience and necessity exists for the construction of drainage improvements on certain
real property located in Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of
drainage easements, by donation, purchase, condemnation, or otherwise, of certain real
property located within the City and situated in Brazoria County. Specifically the property
described in Exhibits "A" and "B", attached hereto, shall be used for the location
construction, operation and maintenance of drainage improvements, while the property
described in Exhibit "C", attached hereto, shall serve as a temporary construction
easement.

ORDINANCE NO. 1260
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to
acquire the property, described in Exhibits "A", "B" and "C" and any improvements thereon,
either by donation, purchase or the exercise of the power of eminent domain.
Section 4. The City Council hereby declares that a public emergency exists for
the acquisition of said property as the construction of improvements bears directly upon the
health, safety, and welfare of the citizenry; therefore this Ordinance shall be passed finally
on its first and only reading and shall take effect immediately upon its passage and
approval by the City Council.

BEGINNING at a 1/2-inch iron rod found marking the southwest corner of said 3.0 acre
tract and said Reserve "A", the northwest corner of Lot 1, Block 1 of said subdivision and on the
easterly right-of-way line of Corrigan Drive (called 80 feet wide), the beginning of a curve whose
center bears North 87° 30' 12" East;
Thence, with the lines of said 3.0 acre tract and said Reserve "B", 15.08 feet along the
arc of a curve to the right, having a radius of 126.50 feet, a central angle of 06° 49' 42" and a
chord which bears North 00° 55' 03" East, 15.07 feet to a 5/8-inch iron rod with plastic cap
stamped "LJA ENG." set for corner;
Thence, leaving said west lines and with a line 15 feet north of and parallel to the south
line of said 3.0 acre tract and said Reserve "A", South 83° 40' 04" East, 301.52 feet to a 5/8-inch
iron rod with plastic cap stamped "LJA ENG." set for corner;
Thence, continuing with said parallel line, South 77° 13' 40" East, 189.47 feet to a 5/8-
inch iron rod with plastic cap stamped "LJA ENG." set for corner on the east line of said 3.0 acre
tract and on the west line of that certain called 5.89 acre tract conveyed to Pearland Westside
